Saunderson, Committee Administrator INS-15-047 - ON-STREET PARKING REGULATIONS - EAST AVENUE 1. The Committee considered Infrastructure Services Department report INS-15-047, dated April 24, 2015 recommending approval of a three-hour parking limit, between 10:00 p.m. and 6:00 p.m., and a 1-hour parking limit, between 6:00 p.m. and 10:00 p.m., on the south-west side of East Avenue. On motion by Councillor K. Galloway-Sealock - it was resolved: “That the Uniform Traffic By-law be amended to permit parking for a maximum period of three consecutive hours, between 10:00 p.m. and 6:00 p.m., and for a maximum period of one hour, between 6:00 p.m. and 10:00 p.m., on the south-west side of East Avenue from Borden Avenue North to Weber Street East; and further, That the City-wide winter overnight parking prohibition, 2:30 a.m. to 6:00 a.m., December 1 to March 31, remain in effect, as outlined in Infrastructure Services Department report INS-15-047.” INS-15-048 - ON-STREET PARKING REGULATIONS - PELTZ AVENUE 2. The Committee considered Infrastructure Services Department report INS-15-048, dated April 24, 2015 recommending approval of a parking prohibition at any time on both sides of Peltz Avenue. On motion by Councillor K. Galloway-Sealock - it was resolved: “That the Uniform Traffic By-law be amended to prohibit parking at any time on the both sides of Peltz Avenue from Dekay Street to Waterloo Street, as outlined in Infrastructure Services Department report INS-15-048.” INS-15-049 - ON-STREET PARKING REGULATIONS - COMMONWEALTH CRESCENT 3. The Committee considered Infrastructure Services Department report INS-15-049, dated May 25, 2015 recommending approval of a stopping prohibition from Monday to Friday, September 1 to June 30, between the hours of 8:00 a.m. and 4:30 p.m. on the east side of Commonwealth Crescent. On motion by Councillor K. Galloway-Sealock - it was resolved: “That the Uniform Traffic By-law be amended to prohibit stopping from 8:00 a.m. to 4:30 p.m., Monday to Friday, September 1 to June 30, on the east (odd-numbered) side of Commonwealth Crescent from the east intersection with Commonwealth Street to the east intersection with Isabella Street, as outlined in Infrastructure Services Department report INS-15-049.” COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE JUNE 15, 2015 - 29 - CITY OF KITCHENER INS-15-050 - UPPER CANADA DRIVE - SPEED HUMP REVISION 4. The Committee considered Infrastructure Services Department report INS-15-050, dated May 27, 2015 recommending the replacement of the seasonal rubberized speed hump with a permanent asphalt speed hump on Upper Canada Drive. On motion by Councillor K. Galloway-Sealock - it was resolved: “That the existing seasonal (spring/summer/fall) rubberized speed hump, in the area of 25 Upper Canada Drive, be replaced with a permanent, year-round asphalt speed hump, as outlined in Infrastructure Services Department report INS-15-050.” CSD-15-028 - NOISE EXEMPTION - KITCHENER HARLEY-DAVIDSON 5. The Committee considered Community Services Department report CSD-15-028, dated May 25, 2015 recommending approval of a noise exemption to Kitchener Harley-Davidson, for their annual Summer Block Party, being held at 2255 Kingsway Drive on August 15, 2015. On motion by Councillor K. Galloway-Sealock - it was resolved: “That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to Kitchener Harley-Davidson, at 2255 Kingsway Drive, between the hours of 12:00 p.m. and 5:00 p.m., on August 15, 2015, as outlined in Community Services Department report CSD-15-028.” CSD-15-053 - NOISE EXEMPTION - KITCHENER-WATERLOO SCHOOL OF ROCK 6. The Committee considered Community Services Department report CSD-15-053, dated May 25, 2015 recommending approval of a noise exemption to the Kitchener-Waterloo School of Rock, for six outdoor performances being held at 78 Francis Street North on July 17, 20, 31 and August 6, 14 and 28, 2015. On motion by Councillor K. Galloway-Sealock - it was resolved: “That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to The School of Rock, at 78 Francis Street North, for six outdoor performances taking place on July 17, 20, 31, August 14 and 28, between the hours of 2:30 p.m. and 4:00 p.m., and on August 6, 2015, between the hours of 6:30 p.m. and 8:00 p.m., as outlined in Community Services Department report CSD-15-053.” CSD-15-054 - NOISE EXEMPTION - 134 SHANTZ LANE 7. The Committee considered Community Services Department report CSD-15-054, dated May 25, 2015 recommending approval of a noise exemption to Lisa Miller, for an outdoor party being held at 134 Shantz Lane on July 25, 2015. On motion by Councillor K. Galloway-Sealock - it was resolved: “That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to Lisa Miller, for an outdoor party being held at 134 Shantz Lane, between the hours of 6:00 p.m. and 10:00 p.m., on July 25, 2015, as outlined in Community Services Department report CSD-15-054.” CSD-15-056 - ZONE CHANGE APPLICATION ZC15/012/L/AP 8. - NORTHWEST CORNER OF LOUISA STREET AND ST. LEGER STREET - 1841362 ONTARIO INC. The Committee considered Community Services Department report CSD-15-056, dated May 6, 2015 recommending approval of Zone Change Application ZC15/012/L/AP, for lands located COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE JUNE 15, 2015 - 30 - CITY OF KITCHENER CSD-15-056 - ZONE CHANGE APPLICATION ZC15/012/L/AP 8. - NORTHWEST CORNER OF LOUISA STREET AND ST. LEGER STREET - 1841362 ONTARIO INC. (CONT’D) at the northwest corner of Louisa Street and St. Leger Street, for the purpose of removing Holding Provision 21H from the Zoning regulation on the above noted lands, as the requirements for removal have been fulfilled. On motion by Councillor K. Galloway-Sealock - it was resolved: “That Zone Change Application ZC15/012/L/AP for 1841362 Ontario Inc. (northwest corner of Louisa Street and St. Leger Street) for the purpose of changing the Zoning by removing Holding Provision 21H from the lands specified in the attached Map No.1, be approved in the form shown in the “Proposed By-law” dated May 1, 2015, attached as Appendix ‘A’ of Community Services Department report CSD-15-056.” INS-15-043 - ARDELT PLACE SNOW DUMP FACILITY LEASE RENEWAL 9. The Committee considered Infrastructure Services Department report INS-15-043, dated June 2, 2015 recommending a lease agreement extension with the property owner of 75 Ardelt Place for the use of their lands to provide City staff and its contractors a snow dump facility. On motion by Councillor K. Galloway-Sealock - it was resolved: “That the Mayor and Clerk be authorized to execute a lease agreement extension, subject to the satisfaction of the City Solicitor, with the property owner at 75 Ardelt Place in the City of Kitchener, for the use of the lands for the purpose of continuing to provide a snow dumping facility for the exclusive use of City staff and their contractors, as outlined in Infrastructure Services Department report INS-15-043.” INS-15-046 - HEIMAN STREET - TRAFFIC CALMING REVIEW 10. The Committee considered Infrastructure Services Department report INS-15-046, dated June 6, 2015 recommending that traffic calming measures not be implemented on Heiman Street. On motion by Councillor K. Galloway-Sealock - it was resolved: “That traffic calming measures not be implemented on Heiman Street, as outlined in Infrastructure Services Department report INS-15-046.” INS-15-045 - EAST AVENUE BICYCLE LANE IMPLEMENTATION 11. The Committee considered Infrastructure Services Department report INS-15-045, dated May 18, 2015 regarding the installation of on-street bicycle lanes and sharrows on both sides of East Avenue and the proposed on-street parking changes. Mr. J. Readman presented the Report. Mr. T. Boutilier and Ms. S. Taka, Cycling and Trails Advisory Committee members, addressed the Committee in support of the staff recommendation. On motion by Councillor S. Marsh - it was resolved: “That Schedule 1 - No Parking of the Uniform Traffic By-law, be amended to reflect the proposed on-street parking changes for specified sections of East Avenue, as outlined in Appendix ‘A’ of Infrastructure Services Department report INS-15-045; and, That on-street bicycle lanes be installed on both sides of East Avenue from Frederick Street to Stirling Avenue and sharrows be installed on both sides of East Avenue between Stirling Avenue and Borden Avenue; and, COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE JUNE 15, 2015 - 31 - CITY OF KITCHENER INS-15-045 - EAST AVENUE BICYCLE LANE IMPLEMENTATION (CONT’D) 11. That on-street parking areas be defined through on-road pavement markings, and further, That the Uniform Traffic By-law be amended accordingly.” CSD-15-031 - NEIGHBOURHOOD PROPERTY STANDARDS COMPLIANCE STRATEGY 12. The Committee considered Community Services Department report CSD-15-031, dated June 2, 2015 regarding the Neighbourhood Property Standards Compliance Strategy. Mr. S. Turner presented the Report and responded to questions from the Committee. It was suggested as part of the review that By-law Enforcement investigate potential proactive enforcement areas where possible. Mr. Turner acknowledged the suggestion and stated that staff will speak to it as part of the review. Questions were raised on whether the enforcement processes regarding vacant buildings was going to be included as part of the review. Mr. Turner advised that there will be a focus on property standards of vacant buildings as part of the review. He noted that staff will be consulting with other municipalities regarding their procedures pertaining to the maintenance enforcement of vacant properties. It was suggested that the Compliance Strategy take into consideration abandoned shopping carts and oversized garbage containers left on private property for extended periods of time. Mr. Turner noted the request. Councillor P. Singh entered the meeting at this time. Mr. Turner further advised that staff will be reaching out to the Neighbourhood Associations as part of the public consultation process in November 2015, at an all-neighbourhood meeting to receive feedback as part of the review process. He noted that he anticipates the first Compliance Strategy report to be available in Spring 2016. He commented that depending on the issue, there may be a series of reports brought forward for consideration throughout the review process. Questions were raised on whether existing enforcement files would be reviewed for challenges, as part of the process review. Mr. Turner advised that staff will be completing both internal and external reviews as part of the Compliance Strategy. On motion by Councillor K. Galloway-Sealock - it was resolved: “That staff proceed with the action items relating to the neighbourhood property standards compliance strategy, as outlined in Community Services Department report CSD-15-031.” CSD-15-044 - NOISE EXEMPTION AND PARKING ENFORCEMENT 13. - BIG MUSIC FEST 2015 The Committee considered Community Services Department report CSD-15-044, dated June 2, 2015 regarding a noise exemption request to Big Music Fest, being held at McLennan Park on July 10 to 12, 2015; and, to designate the area around McLennan Park as a special events parking area. Mr. S. Turner presented the Report, noting that the event promoter has recently cancelled the events planned for July 12, 2015 and requested that the recommendation be amended to remove the reference to that date. Questions were raised on whether the number of parking infractions issued in 2014 for the music festival covered the cost for enforcement. Mr. Turner advised that the number of tickets issued resulted in approximately $4500. to $4800. in revenue, noting that it did not cover all of the enforcement costs for the event, which totalled approximately $14,000. He noted that the Division was not compensated for the difference in costs. Councillor J. Gazzola stated that he COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE JUNE 15, 2015 - 32 - CITY OF KITCHENER CSD-15-044 - NOISE EXEMPTION AND PARKING ENFORCEMENT 13. - BIG MUSIC FEST 2015 (CONT’D) was under the understanding that the event promoter would be responsible for the charges relating to enforcement and questioned why they were not billed for the excess costs. Mr. Turner noted that he would need to follow up with Special Events staff but could respond back. Councillor J. Gazzola noted that he had previously requested a detailed report following Big Music Fest 2014. He stated that he does not recall seeing a follow-up report and questioned whether one could be provided. Mr. J. Willmer advised that staff were not in attendance this date to provide a response to that request, noting that he would follow up. Councillor S. Marsh stated that recently there was another large music event in the City that received numerous complaints on the sound levels and requested that staff consider investigating qualitative measures for measuring sound for events of this nature. She indicated with measurable qualities, event promoters could be provided direction not to exceed certain decibel levels. Mr. Turner noted the suggestion and indicated that staff have already begun to review potential options for measuring sound levels and will follow up at a later date on a potential process for handling noise exemptions of this nature. On motion by Councillor P. Singh - it was resolved: “That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to the Big Music Fest, to be held at McLennan Park on July 10 and 11, 2015, between the hours of 10:00 a.m. and 11:00 p.m., each day; and further, That a by-law be enacted to designate the area around McLennan Park as a special events parking area, pursuant to the City of Kitchener Traffic and Parking By-law 2007- 138, during the event, as outlined in Community Services Department report CSD-15- 044.” CSD-15-058 - AMENDMENT TO CHAPTER 680 (SIGN BY-LAW) OF THE MUNICIPAL 14. CODE GENERAL REGULATIONS The Committee considered Community Services Department report CSD-15-058, dated May 19, 2015 regarding amending Chapter 680 (Sign-By-law) of the City of Kitchener Municipal Code to include a provision for the continued use of existing legal signs when they must be relocated due to a road widening. Ms. J. Oosterveld presented the Report, noting that an amended By-law was circulated this date. She indicated that the one change within the By-law is related to Clause A, to include ‘lot width’ as an additional area of compliance. On motion by Councillor K. Galloway-Sealock - it was resolved: “That Chapter 680 (Sign By-law) of the City of Kitchener Municipal Code be amended by adding a paragraph to section 680.3.4, recognizing the relocation of signs resulting from a road widening, as outlined in Community Services Department report CSD-15- 058 and in the revised Appendix ‘A’ circulated June 15, 2015.” ADJOURNMENT 15.
