(PIN 225020079) to authorize the installation of light fixtures, cornice, stone sill, and signage which will encroach 2 feet 2 inches or 70cm, more or less, over the City's King St. E. and Cedar St. S. road allowances." BACKGROUND: The original business at this address was known as St. Clair Appliance. The current owner, 2343439 Ontario Inc., proposes office space on the second floor of the building and retail on the lower level. The current owner has hired an architectural firm to design building features. The property owner approached the City of Kitchener for permission prior to building any of these features. The property owner must enter into an encroachment agreement to receive other approvals to successfully complete building the structure. REPORT: The property owner is asking for permission to place architectural features and signage for its new businesses on the fagade of the building. These architectural features will slightly project over the road allowances and will be above ground. None of the features are expected to interfere with pedestrian traffic. In the past, when the property was known as St. Clair Appliance, there were projections over the City road allowance since there is zero set -back. Of the new proposed features, the light fixtures would extend the most, approximately 2 feet 2 inches or about 70cm (measured from the building's front), and the light fixtures are at least 10 feet above the sidewalk. * ** This information is available in accessible formats upon request. * ** Please call 519- 741 -2345 or TTY 1- 866 - 969 -9994 for assistance. 7. -1 The architectural firm, James Fryett Architect Inc., have submitted drawings of the proposed architectural features which will slightly encroach over both King St. E. and Cedar St. S. The drawing is attached to this report. These drawings will be circulated to city staff and to external utility companies for their comments. Any comments will be taken under consideration. The encroachment agreement may include a condition that the owner applies for a sign permit, and submit drawings in accordance with the City's Sign By -law. ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: Efficient and Effective Government — Customer Service FINANCIAL IMPLICATIONS: The application fee of $264 has been paid in accordance with the City's fee schedule. COMMUNITY ENGAGEMENT: Community engagement is not necessary for this process. Internal staff and outside utility companies will be circulated for their comments and /or approval. CONCLUSION: All appropriate staff and outside utility companies will review the drawings. Once the proposal has received staff approval, it would be in order to authorize the execution of an encroachment agreement with the property owner(s) and any mortgagee(s) of 357 King Street East.
