SUBJECT: NOISE EXEMPTION REQUEST - OKTOBERFEST EVENTS
RECOMMENDATION:
That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code
be granted to K-W Oktoberfest Inc. for a series of events being held at various
clubs between October 2 and October 17, 2015, as outlined in the letter from K-W
Oktoberfest Inc., dated May 15, 2015, attached to Report CSD-15-061.
BACKGROUND:
The K-W Oktoberfest Inc. is requesting an exemption to Chapter 450 (Noise) of the
City's Municipal Code for a series of events that are being held at 8 clubs, during the
2015 Oktoberfest festivities, running from October 2nd to the 17th, 2015. A copy of their
request is attached.
REPORT:
Staff within the By-law Enforcement Division reports that the number of noise
complaints relating to these events over the past several years has been minimal at
best. Typically, there appears to be a large a degree of acceptance by City residents to
these events, given their vast popularity and broad community benefits. The level of
cooperation that staff has received from event organizers has been positive.
ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN:
Approval of a noise exemption request supports the Community Priorities of Quality of
Life and Dynamic Downtown, as contained in the City's Strategic Plan.

SUBJECT: Blanket Noise By-Law Exemption
As per our request of the 2014 Festival, we are herewith requesting a blanket exemption from the
Municipal By Law governing noise for the duration of K-W Oktobertest which officially runs from
October 9 to 17, 2015, however,we will also have some Festhallen operating on Friday, October 2
and Saturday, October P. These pre-Festival dates are in response to the devastating effects of the
Wilfrid Laurier reading week during last year's Festival and the anticipation that the University of
Waterloo and Conestoga College may implement the same reading week this year.
K-W Oktoberfest has been designated an event of"municipal significance" and as such would respectfully
request a little latitude in the enforcement of municipal law on certain days involving a limited number of
festival facilities. Specific dates of operation for each Festhallen will be confirmed towards the end of
May. For now we are suggesting using the entire range of dates far the By Law, however, this is our best
guess at what the schedule may look like for this upcoming Festival:
