REPORT: i r F i ����J/ The subject property is located on the , ° ° south side of Joseph Schoerg Crescent between Joseph Schoerg Place and Langton Drive. The property left sight line is designated under Part IV of the Ontario Heritage Act. It is also subject to a Heritage Conservation Easement Agreement. Historically, it is associated with the earliest inland non- native settlement of what would become Waterloo County. Architecturally, the Betzner farmhouse and the driveshed are significant features. The landscape, which includes unobstructed views to the Grand River, is also significant. , � y r Construction of Cedar Fence This proposal will require issuance of a Heritage Permit to carry out the work as both the Part IV Designation By-law and Easement Agreement identify the unob- centre sight line structed views to the Grand River as significant. Review of the Application by Heritage Kitchener is required. If recommended for approval by Heritage Kitchener, the Permit may be issued by i1'f y staff under delegated authority. „ /f / / ✓ r The owner is proposing to erect a two- rail style `cedar urban post & rail fence' system with bevelled post design and ` old fashioned heavy duty hinges'. The °f height of the fence will not exceed three feet. Approximately 60 linear feet of fence and gates are proposed. The r/✓�I I Illf Vff I applicant states that the materials will enhance the character of the driveshed and are consistent with the overall aesthetic of the property. Specifications right sight line 2 - 2 from the manufacturer are included in the complete application, attached. The owner z proposes the construction of this fence to protect her dogs from running onto the street. A sample photo of the proposed post and rail,after weathering, is shown at right. The style and design of the proposed fence is consistent with the rural nature of the property and will not ��� a detract from the character of the property. f The fence will be situated on the property from the drystone wall to the east of the driveway, around the perimeter of the driveway to the driveshed, and continue the fence at the ? � northwest corner of the driveshed to the other portion of drystone wall (see altered photos on l% next page). Two openings in the first section of the fence will provide pedestrian access to the walk up to the house and vehicle access to the yard between the house and driveshed. In reviewing the merits of the application, City staff note the following: proposed post& rail, after weathering • the property in question is designated under Part IV of the Ontario Heritage Act and subject to a Heritage Conservation Easement , Agreement, both of which consider unobstructed views to the Grand River as significant; • the open nature of the cedar rail fence system will not obstruct views of the Grand River from Joseph Schoerg Crescent; • the design of the cedar rail fence system will allow the cedar members to weather to the same colour as the driveshed; and altered photos, above & below, showing • construction of a cedar rail fence location of fence in relation to driveshed will not detract from the character of the property. In accordance with the heritage permit f application form, the approval of an application under the Ontario Heritage Act shall not be a waiver of any of the provisions of any by-law of the City of m. �r Kitchener or legislation, including, but not limited to, the requirements of the Ontario Building Code and Zoning By-law. 2 - 3 ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: The processing of Heritage Permit Applications supports the Quality of Life Community Priority of the City of Kitchener Strategic Plan by helping conserve the community's unique heritage and promoting culture as both an economic driver and a central element of a healthy community. Heritage Permit Applications also support the Development Community Priority to honour and protect our heritage.
