SPECIAL COUNCIL MINUTES
AUGUST 31, 2015 CITY OF KITCHENER
A special meeting of City Council was held at 5:00 p.m. this date, chaired by Mayor B. Vrbanovic with
all members present.
Notice of this meeting had been previously given to all members of Council by the City Clerk pursuant
to Chapter 25 (Council Procedure) of the Municipal Code.
1. FCS-15-129 – P15-056 – COLUMBARIUM DESIGN BUILD INSTALL – WILLIAMSBURG
CEMETERY
Council considered Finance and Corporate Services Department report FCS-15-129 (M. Palmer-
Novakovic), dated August 25, 2015.
Councillor Y. Fernandes requested information be provided in an email detailing the amounts
submitted by other vendors.
Moved by Councillor K. Galloway-Sealock
Seconded by Councillor S. Marsh
“That Proposal P15-056 Columbarium Design Build Install: Williamsburg Cemetery, be
awarded to Sunset Memorial & Stone Ltd., Calgary, Alberta, at their proposed price of
$252,390.00, including optional work of $22,790., plus H.S.T. of $32,810.70, for a total of
$285,200.70.”
Carried.
2. CSD-15-077 – NOISE EXEMPTION REQUEST – FROSH CIRCUS - BINGEMANS
Council considered a recommendation arising from the Community and Infrastructure Services
Committee meeting held earlier this date.
A recorded vote was requested.

Seconded by Councillor F. Etherington
“That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted
to the organizers of the Frosh Circus event, to be held at the Bingemans facility between the
hours of 3:00 p.m. and 11:00 p.m., on Friday September 11, 2015 and Saturday September
12, 2015, as outlined in Community Services Department report CSD-15-077. This exemption
is subject to the following conditions, which, if not complied with, will render the noise
exemption null and void:
a) There shall be no offensive language, in the opinion of City staff, generated from
this music festival, audible in any adjacent residential neighbourhood; and,
b) The event organizers will ensure that there is an on-site contact person accessible
to correspond with City staff at all times during the event; and,
c) The event organizer will be responsible for the cost of a pay-duty Noise Officer, to
be assigned specifically to this event; and,
d) The event organizers agree to respond accordingly to requests from City staff,
during the event, in order to address community concerns that may arise with
regard to the impact of noise heard within adjacent residential areas; and further,
That the event organizer comply with the maximum decibel level (dba) requirement
e)
as prescribed by the By-law Enforcement Division. Such decibel level requirement
to be provided to the event organizer at least 3 days prior to the event.”

3. CSD-15-079 – NOISE EXEMPTION REQUEST – CONESTOGA STUDENTS INC.
Council considered a recommendation arising from the Community and Infrastructure Services
Committee meeting held earlier this date.

Seconded by Councillor F. Etherington
“That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted
to the Conestoga Students Inc., for an outdoor event to be held at Conestoga College,
between the hours of 9:00 a.m. and 1:00 a.m., on September 10, 2015, as outlined in
Community Services Department report CSD-15-079.”
Carried.
4. BY-LAW FOR THREE READINGS
Moved by Councillor P. Singh
Seconded by Councillor F. Etherington
“That leave be given the Mover and Seconder to introduce a by-law to confirm all actions and
proceedings of the Council and that the same be taken as read a first, second and third times, be
finally passed and numbered 2015-095 by the Clerk.”
Carried.
