CSD-15-076 - NOISE EXEMPTION REQUEST - STANLEY PARK COMMUNITY ASSOCIATION The Committee considered Community Services Department report CSD-15-076, dated August 12, 2015 recommending approval of a noise exemption to the Stanley Park Community Association, for a community celebration being held at the Stanley Park Community Centre on September 19, 2015. On motion by Councillor K. Galloway-Sealock- it was resolved: "That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to the Stanley Park Community Association, for a community celebration to be held at the Stanley Park Community Centre, between the hours of 10:00 a.m. and 2:00 p.m., on September 19, 2015, as outlined in Community Services Department report CSD- 15-076." 2. CSD-15-079 - NOISE EXEMPTION REQUEST-CONESTOGA STUDENTS INC. The Committee considered Community Services Department report CSD-15-079, dated August 17, 2015 recommending approval of a noise exemption to Conestoga Students Inc., for an outdoor event being held at Conestoga College on September 10, 2015. On motion by Councillor K. Galloway-Sealock- it was resolved: "That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to the Conestoga Students Inc., for an outdoor event to be held at Conestoga College, between the hours of 9:00 a.m. and 1:00 a.m., on September 10, 2015, as outlined in Community Services Department report CSD-15-079." 3. INS-15-070 - PURCHASE ORDER EXTENSION - ROLAND STREET BRIDGE REPLACEMENT Pursuant to Chapter 25 (Procedure) of the Municipal Code, a motion was brought forward by Councillor Y. Fernandes to discuss the extension of a Purchase Order to Resource Industrial Group Ltd.for the Roland Street bridge replacement. Councillor Fernandes' motion was then voted on and was Carried. The Committee considered Infrastructure Services Department report INS-15-070, dated July 30, 2015 recommending an extension of a Purchase Order to Resource Industrial Group Ltd. for the Roland Street bridge replacement. Mr. D. Tyagi was in attendance and responded to questions from the Committee. The following motion was was voted on by a recorded vote and was Carried, with Mayor B. Vrbanovic and Councillors K. Galloway-Sealock, D. Schnider, J. Gazzola, P. Singh, B. COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE AUGUST 31. 2015 -40 - CITY OF KITCHENER 3. INS-15-070 - PURCHASE ORDER EXTENSION - ROLAND STREET BRIDGE REPLACEMENT(CONT'D) loannidis, S. Davey, S. Marsh and F. Etherington voting in favour; and, Councillors Y. Fernandes and Z. Janecki voting in opposition. On motion by Councillor F. Etherington - it was resolved: "That an extension of the purchase order 206424 issued to Resource Industrial Group Ltd., Ayr, Ontario, for the Roland Street Bridge Replacement, Victoria Park, be increased in the amount of $15,449.12., plus H.S.T. of $2,008.39, for a total of $17,457.51, be approved, as outlined in Infrastructure Services Department report INS-15-070." 4. INS-15-072 - NOISE EXEMPTION REQUEST - MINISTRY OF TRANSPORTATION, ONTARIO -HIGHWAY 7 TO HIGHWAY 8 RAMP The Committee considered Infrastructure Services Department report INS-15-072, dated August 7, 2015 recommending approval of a noise exemption to the Ministry of Transportation (MTO)for construction work during the asphalt surface repairs to the approaches to Highway 7 to Highway 8 ramp from September 1, 2015 to September 30, 2015. On motion by Councillor K. Galloway-Sealock- it was resolved: "That the Ministry of Transportation, Ontario (MTO) and its contractor(s) be exempt from the provisions of Chapter 450 Noise of the City of Kitchener Municipal Code Article 6 Construction Work, between the hours of 7:00 p.m. and 7:00 a.m. for the period from September 1, 2015 to September 30, 2015, during the asphalt surface repairs to the approaches to the Highway 7 to Highway 8 ramp, as outlined in Infrastructure Services Department report INS-15-072." 5. INS-15-073 - CITY HALL LEASE RENEWAL-FEELINGS FROM THE HEART The Committee considered Infrastructure Services Department report INS-15-073, dated August 17, 2015 recommending approval of a lease renewal to Patricia Fretwell to operate a wedding chapel, named "Feelings from the Heart', at City Hall. On motion by Councillor K. Galloway-Sealock- it was resolved: "That the Mayor and Clerk be authorized to execute a lease renewal agreement, subject to the satisfaction of the City Solicitor, with the business known as "Feelings From the Heart" to operate one wedding chapel at City Hall, be approved for an additional three year period commencing on September 1, 2015 until August 31, 2018, as outlined in Infrastructure Services Department report INS-15-073." 6. CSD-15-061 - KITCHENER GROWTH MANAGEMENT STRATEGY - 2015 ANNUAL MONITORING REPORT The Committee considered Community Services Department report CSD-15-061, dated August 10, 2015 regarding the 2015 Kitchener Growth Management Strategy Annual Monitoring Report. Mr. A. Pinard and Ms. N. Goss were in attendance and responded to questions from the Committee. In response to questions regarding intensification and employment growth and the potential for expediting commercial development; Mr. Pinard advised that generally most development starts with the majority being residential, noting it could take 10 to 15 years for a development to reach its full potential. He noted that the current plans and policies in place support the 10 to 15 year time frame for complete development. He indicated that staff could review those policies to see determine whether the current timelines are supported or could be improved. COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE AUGUST 31. 2015 -41 - CITY OF KITCHENER 6. CSD-15-061 - KITCHENER GROWTH MANAGEMENT STRATEGY - 2015 ANNUAL MONITORING REPORT(CONT'D) On motion by Councillor K. Galloway-Sealock- it was resolved: "That Kitchener Growth Management Strategy - 2015 Annual Monitoring Report, be received for information, attached as Appendix `A' to Community Services Department report CSD-15-061, and further; That Report CSD-15-061 be submitted to the Regional Municipality of Waterloo in fulfillment of Clause 22.1 of the Administrative Agreement between the City of Kitchener and the Region of Waterloo regarding delegated approval of authority." 7. CSD-15-077 - NOISE EXEMPTION REQUEST-FROSH CIRCUS -BINGEMANS The Committee considered Community Services Department report CSD-15-077, dated August 18, 2015 regarding a noise exemption request for an outdoor pool party, known as Frosh Circus, being held at Bingemans on September 11, 2015 and September 12, 2015. Mr. S. Turner was in attendance and responded to questions from the Committee. The Committee was in receipt this date of an amendment proposed by staff to substitute Clause `e' of the recommendation within the staff report pertaining to maximum decibel level requirements. On motion by Councillor S. Davey- it was resolved: "That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to the organizers of the Frosh Circus event, to be held at the Bingemans facility between the hours of 3:00 p.m. and 11:00 p.m, on Friday September 11, 2015 and Saturday September 12, 2015, as outlined in Community Services Department report CSD-15-077. This exemption is subject to the following conditions, which, if not complied with,will render the noise exemption null and void: a) There shall be no offensive language, in the opinion of City staff, generated from this music festival, audible in any adjacent residential neighbourhood; and, b) The event organizers will ensure that there is an on-site contact person accessible to correspond with City staff at all times during the event; and, c) The event organizer will be responsible for the cost of a pay-duty Noise Officer, to be assigned specifically to this event; and, d) The event organizers agree to respond accordingly to requests from City staff, during the event, in order to address community concerns that may arise with regard to the impact of noise heard within adjacent residential areas; and further, e) That the event organizer comply with the maximum decibel level (dba) requirement as prescribed by the By-law Enforcement Division. Such decibel level requirement to be provided to the event organizer at least 3 days prior to the event." 8. ADJOURNMENT On motion, this meeting adjourned at 3:06 p.m. D.
