SUBJECT: ENCROACHMENT AGREEMENT REQUEST — SIGN OVER
SIDEWALK AT 44 -54 QUEEN STREET SOUTH
RECOMMENDATION:
"That the Mayor and Clerk be authorized to execute an Encroachment Agreement,
satisfactory to the City Solicitor, with the property owner(s) and any mortgagee(s) of the
property municipally known as 44 -54 Queen Street South (PIN 22427 -0069) to authorize
the installation a sign which will project 2 feet, more or less, over the City of Kitchener's
Queen Street South road allowance."
BACKGROUND:
The current owner, 2374957 Ontario Inc., has agreed to allow their tenant, Queen Street Yoga
to install a business sign on the building's fagade, provided the tenant follow City processes,
which involve obtaining an encroachment agreement and a sign permit.
REPORT:
The property owner is asking for permission to install a sign for its tenant, Queen Street Yoga,
on the fagade of the building. This sign will slightly project over the Queen Street South
sidewalk by about 2 feet and will be about 10 feet above ground. There is zero set -back.
The sign consultants, Signs Galore Incorporated, have submitted drawings of the proposed
sign. The drawings are attached to this report. These drawings have been circulated to city staff
and to external utility companies for their comments.
Of important note is the location of the sanitary service pipe which is located underneath the
proposed sign. However, since the sign will be placed 10 feet about the ground, the sanitary
service pipe is not an issue.
The encroachment agreement will include a condition that the owner applies for a sign permit,
and submit drawings in accordance with the City's Sign By -law.

Queen Street Yoga would benefit from the placement of the sign on the building's fagade since
the business operates out of an upper unit and does not have a storefront.
ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN:
The recommendation of this report supports the achievement of the city's strategic vision
through the delivery of core services.
FINANCIAL IMPLICATIONS:
The application fee of $264 has been paid in accordance with the City's fee schedule.
COMMUNITY ENGAGEMENT:
Community engagement is not necessary for this process. Internal staff and outside utility
companies have been circulated for their comments and /or approval.
CONCLUSION:
All appropriate staff and outside utility companies have reviewed the drawings. The proposal
has received staff approval and it would be in order to authorize the execution of an
encroachment agreement with the property owner(s) and any mortgagee(s) of 44 -54 Queen
Street South.
