SUBJECT: Noise Exemption —T15-057 Stahl Avenue and Wilhelm Street
Road Reconstruction
RECOMMENDATION:
That Steed and Evans Limited be exempt from the provisions of Chapter 450 Noise of the
City of Kitchener Municipal Code Article 6 Construction Work during the Wilhelm Avenue
reconstruction project, in the City of Kitchener. The request for the noise by-law
exemption is between the hours of 7:00 p.m. and 7:00 a.m. for the period September 28,
2015 and ending October 19, 2015.
BACKGROUND:
Steed and Evans Limited has been awarded the contract for the reconstruction of Stahl Avenue
and Wilhelm Street. The project involves the replacement of the roadway, curb and gutter,
existing sidewalk and all underground services and surface works. This includes work around
the Waterloo Spur Line located on Wilhelm Street.
REPORT:
As part of the contract, Steed and Evans Limited is required to complete work within the railway
right of way on Wilhelm Street. It has been communicated to Steed and Evans Limited that this
work can only be completed during the weekend as trains do not run during this time. In order to
ensure construction work is completed during the weekend, Steed and Evans has indicated that
24 hour shifts may be required.
Steed and Evans Limited is requesting an exemption from September 28 to October 19, 2015,
in order to complete this work.

It is anticipated that the work expected to be completed during these hours is excavation, casing
and sewer installation and backfill at the railway crossing on Wilhelm Street. It is expected that
the noise generated will be that of typical road reconstruction.
Steed and Evans Limited will be providing written notification to all residents prior to the start of
weekend work.
ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN:
This initiative falls under the Community Priority of Quality of Life. "Work with partners, including
all orders of government, to create a culture of safety in our community." The implementation of
improved traffic flow and safety will provide positive direction for motorists.
FINANCIAL IMPLICATIONS:
None.
COMMUNITY ENGAGEMENT:
INFORM — Steed and Evans Limited will be providing a letter of notification to affected property
owners prior to commencing weekend work
