Singh, Chair Mayor B. Vrbanovic and Councillors S. Davey, Y. Fernandes, K. Galloway-Sealock, J. Gazzola, B. Ioannidis, Z. Janecki, S. Marsh and D. Schnider. Staff: J. Livingstone, Committee Administrator Councillor P. Singh read aloud the following statement: “This is a formal public meeting to consider applications under the Planning Act. If a person or public body does not make oral or written submissions to the City of Kitchener before the proposed applications are considered, the person or public body may not be entitled to appeal the decision to the Ontario Municipal Board and may not be added as a party to a hearing of an appeal before the Ontario Municipal Board.” CSD-15-019 - DRAFT PLAN OF CONDOMINIUM - 30CDM-14207 1. - BLAIR CREEK DRIVE/DOON SOUTH DRIVE - HALLMAN CONSTRUCTION LIMITED The Committee considered Community Services Department report CSD-15-019, dated August 24, 2015, recommending approval of a Draft Plan of Condominium to allow Hallman Construction Limited to develop a residential townhouse development. Mr. G. Stevenson presented the Report. Mr. Pierre Chauvin, MHBC Planning, addressed the Committee in support of the application. On motion by Councillor Y. Fernandes - it was resolved: “That the City of Kitchener, pursuant to Section 51(31) of the Planning Act R.S.O. 1990, c.P.13, as amended, and By-law 2002-164 of the City of Kitchener, as amended, hereby grants draft approval to Condominium Application 30CDM-14207 for Block 95 of Plan 58M-588 in the City of Kitchener, subject to the conditions as shown in Community Services Department report CSD-15-019, Appendix ‘A’.” INS-15-077 - ACTIVA DRAINAGE PETITION 2. The Committee considered Infrastructure Services Department report INS-15-077, dated August 31, 2015, recommending approval of the Engineering Report for the Gravel Ridge Drain (Activa Drainage Petition); and, the adoption of the report by by-law to formally establish the Gravel Ridge Drain as a municipal drain. Mr. E. Riek introduced the Report. Mr. Joel Miller, K. Smart Associates Ltd., presented the Engineering Report for the Gravel Ridge Drain, attached to Report INS-15-077. In response to questions from the Committee, Mr. Miller stated confirmed all affected property owners received a copy of Report INS-15-077 as well as notice of the meeting this date. He explained that pursuant to the Drainage Act, if Council does not adopt the Engineer’s Report by by-law, the Petitioner may appeal to the Drainage Tribunal. Councillor Singh questioned if there were any individuals in attendance who would like to add or remove their names from the Petition. No members of the public indicated a desire to address the Committee with questions of a technical nature or to add or remove their names from the Petition. Mr. Miller then confirmed the Petition as being valid. On motion by Councillor S. Davey - it was resolved: “That the Engineering Report for the Gravel Ridge Drain (Activa Drainage Petition), prepared by K. Smart Associates Ltd., dated August 31, 2015, as outlined in Infrastructure Services Department report INS-15-077, be received and approved; and further, That the Engineering Report for the Gravel Ridge Drain be adopted by by-law, in the prescribed form specified by the Drainage Act, to formally establish the Gravel Ridge Drain as a municipal drain.” CSD-15-070 - KITCHENER GROWTH MANAGEMENT PLAN (KGMP) 3. - FALL 2015 TO FALL 2017+ The Committee considered Community Services Department report CSD-15-070, dated September 2, 2015, recommending approval of the Kitchener Growth Management Plan (KGMP) Fall 2015 to Fall 2017+. In addition, the Committee was in receipt this date of correspondence dated September 11, 2015 from Mr. M. Dorfman on behalf of Ms. M. Ruttkowski, owner of 500 Stauffer Drive; and, a submission from Mr. Mark Nowak dated September 2015 on behalf of B&B Kieswetter Ltd, Kieswetter Holdings Inc., and Select Sand and Gravel. Ms. N. Goss introduced the Report. Ms. Stephanie Massel addressed the Committee on behalf of the Woolner Trail Community, advising that the group is in support of the recommended KGMP. In addition, she requested that the second sentence of the Future Plans section be modified for clarity to read as follows: “The portion of the parcel immediately south of the Woolner Heritage Farm extending to the Grand River is to be conserved for floodplain/open space purposes”. Ms. Goss responded stating that staff agrees in principle to this request; however, the delineation between environmental features is determined by the GRCA. Mr. Mark Nowak addressed the Committee to request that the lands owned by B&B Kieswetter Ltd, Kieswetter Holdings Inc. and Select Sand and Gravel, identified as parcels 134,135 and 136 in the KGMP be reprioritized from Priority ‘C’ to Priority ‘B’. He referred to the correspondence distributed this date and provided an overview of his request, advising that the lands have been mined for gravel extraction for decades and should be considered greyfields/brownfields rather than for greenfield development. In addition, he indicated that although servicing would need to be extended to the subject lands, planning the development to the draft plan approval stage would enable grading to protect the water recharge area. He stated that he has been in contact with the Region of Waterloo and has confirmation that they are in support of the lands being rehabilitated to residential condition. Councillor B. Ioannidis brought forward a two-month deferral of consideration of the lands referenced by Mr. Nowak to allow more time for the owners to meet with staff and the Region of Waterloo to discuss the request and the prioritization of parcels identified as 134,135,136 in the KGMP. Mr. B. Sloan responded to questions, stating that staff would be willing to work with Mr. Nowak in the pre-submission process to position the parcels for a development application and priority ‘B’ in the next KGMP. Councillor K. Galloway-Sealock indicated that as the Ward Councillor, she would like the deferral to be for a two-week period, to the October 5, 2015 Council meeting, to allow an opportunity to discuss the prioritization of the parcels with staff and the owners of the properties. Councillor Ioannidis agreed to withdraw his deferral. PLANNING & STRATEGIC INITIATIVES COMMITTEE MINUTES SEPTEMBER 21, 2015 -33- CITY OF KITCHENER CSD-15-070 - KITCHENER GROWTH MANAGEMENT PLAN (KGMP) 3. - FALL 2015 TO FALL 2017+ (CONT’D) Councillor Galloway-Sealock’s deferral motion for consideration of parcels 134,135 and 136 Carried was then voted on and was . Councillor S. Davey brought forward the amended motion, including the request to revise the wording within the Future Plans section of the KGMP, as requested by Ms. Massel of the Woolner Community Trail Group, subject to approval by the GRCA. Carried Unanimously The following motion was then voted on and was on a recorded vote by all members present. On motion by Councillor S. Davey - it was resolved: “That the Kitchener Growth Management Plan Fall 2015 to Fall 2017+, as attached to Community Services Department report CSD-15-070, be approved, save and except the following: Deferral of consideration of 134, 135 and 36 within the Rosenberg area to the October 5, 2015 Council meeting to allow time for the Ward Councillor to meet with the owners to discuss the prioritization of their parcels; and further, Revisions to the ‘General Comments’ and ‘Future Plan’ section related to Parcel 66 within the Grand River South area, that subject to the approval of the GRCA, the portion of the parcel immediately south of the Woolner Heritage Farm be extended to the Grand River to be conserved for floodplain/open space purposes.” ADJOURNMENT 4.
