SPECIAL COUNCIL MINUTES
SEPTEMBER 21, 2015 CITY OF KITCHENER
A special meeting of City Council was held at 12:32 p.m. this date, chaired by Mayor B. Vrbanovic
with all members present except Councillor F. Etherington.
Notice of this meeting had been previously given to all members of Council by the City Clerk pursuant
to Chapter 25 (Council Procedure) of the Municipal Code.
1. IN-CAMERA MEETING AUTHORIZATION
Moved by Councillor K. Galloway-Sealock
Seconded by Councillor B. Ioannidis
“That an in-camera meeting of City Council be held this date to consider a land acquisition /
disposition matter and three matters subject to solicitor-client privilege”
Carried.
The meeting then recessed at 1:06 p.m. and re-convened at 6:13 p.m., chaired by Mayor B.
Vrbanovic with all members present except Councillor F. Etherington.
2. CSD-15-030 – NOISE EXEMPTION REQUEST – EMMANUEL BIBLE COLLEGE
Council considered any recommendation arising from the Community & Infrastructure Services
Committee meeting held earlier this date.

Seconded by Councillor D. Schnider
“That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted
to Emmanuel Bible College, for their homecoming event being held at 100 Fergus Avenue,
between the hours of 10:00 a.m. and 10:00 p.m. on October 3, 2015, as outlined in Community
Services Department report CSD-15-030.”
Carried.
3. CAO-15-019 – NOTICE TO PROCEED FIT 3.1 ROOFTOP SOLAR APPLICATIONS UNDER
THE INDEPENDENT ELECTRICITY SYSTEM OPERATOR (IESO) FEED IN TARIFF (FIT)
PROGRAM – FIT 4 PROGRAM
Council considered Chief Administrator’s Office report CAO-15-019 (R. Regier), dated September 21,
2015 regarding the blanket endorsement of the previously approved solar roof top projects in the City of
Kitchener that have extended beyond the Feed-In Tariff (FIT) 3 program, and will continue into the FIT 4
project timeline.

“WHEREAS capitalized terms not defined herein have the meanings ascribed to them in the Feed
In Tariff (FIT) Contract, Version 3.1; and,
WHEREAS the Province's FIT Program encourages the construction and operation of rooftop
and other solar generation projects (the "Projects"); and,
WHEREAS one or more Projects may be subject to FIT Contracts and may be constructed and
operated in The City of Kitchener ("Local Municipality"); and,
WHEREAS in accordance with the FIT Rules, Version 3.0, the Council of the Local Municipality
("Council") had previously indicated, by a resolution, its support for Projects in the Local
Municipality (the "Prior Resolution"); and,
WHEREAS Council now indicates, by a resolution dated no earlier than June 10, 2015, Council's
continued support for the construction and operation of the Projects anywhere in the Local
Municipality (the "New Resolution"); and,

WHEREAS pursuant to the FIT Contract, where a New Resolution is received in respect of the
Projects in the Local Municipality, Suppliers will be recognized as fulfilling the requirements under
Section 2.4(d)(vii) of the FIT Contract, which may result in Suppliers being offered Notice to
Proceed in accordance with the terms of their respective FIT Contract(s);
THEREFORE BE IT RESOLVED that Council of the City of Kitchener supports the construction
and operation of the Projects anywhere in the City of Kitchener;
BE IT FURTHER RESOLVED that this resolution's sole purpose is to enable Suppliers to achieve
Notice to Proceed under their FIT Contracts and may not be used for the purpose of any other
form of municipal approval in relation to a FIT Contract or Project or for any other purpose; and,
BE IT FINALLY RESOLVED that this resolution shall expire twelve (12) months after its adoption
by Council.”
4. BY-LAW FOR THREE READINGS
Moved by Councillor S. Davey
Seconded by Councillor S. Marsh
“That leave be given the Mover and Seconder to introduce a by-law to confirm all actions and
proceedings of the Council and that the same be taken as read a first, second and third times, be
finally passed and numbered 2015-100 by the Clerk.”
Carried.
On motion the meeting adjourned at 6:14 p.m.
