HomeMy WebLinkAboutFCS-15-149 - Encroachment Agreement - Signage of King Street West Road Allowance REPORT TO: Committee of the Whole th DATE OF MEETING: October 5, 2015 SUBMITTED BY: Erin Mogck, Associate City Solicitor, 519-741-2200 x7060 PREPARED BY: Erin Mogck, Associate City Solicitor, 519-741-2200 x7060 WARD(S) INVOLVED: Ward 9 DATE OF REPORT: September 30, 2015 REPORT NO.: FCS-15-149 SUBJECT: ENCROACHMENT AGREEMENT REQUEST – SIGNAGE ON KING STREET WEST ROAD ALLOWANCE ___________________________________________________________________________ RECOMMENDATION: “That, the Corporation of the City of Kitchener as owner of the building at 10 King Street West in which The Museum is located, hereby consents to The Museum’s subtenant, Cambridge Hotel and Conference Centre Limited, installing a sign on the building façade; and, That, subject to obtaining all necessary approvals, the Mayor and Clerk be authorized to execute an Encroachment Agreement, satisfactory to the City Solicitor, with the tenant/subtenant of the property municipally known as 10 King Street West to authorize the installation of the signage which will encroach 3.5 feet, more or less, over the City’s King St. W. road allowance.” BACKGROUND: Cambridge Hotel and Conference Centre Limited is the current tenant of the Museum, and they will operate a restaurant in the Museum called B@TheMuseum. Cambridge Hotel and Conference Centre Limited has hired sign consultants to design and install signage for B@TheMuseum. The tenant must enter into an encroachment agreement prior to receiving the approval for the sign permit to install the sign. REPORT: The tenant, Cambridge Hotel and Conference Centre Limited, is asking for permission to place signage for its new business on the façade of the building. The sign will project over the road allowance and will be above ground. The sign is not expected to interfere with pedestrian traffic. The sign would extend 3.5 feet or about 1m (measured from the building’s façade). Sign consultants, Westmount Signs and Printing, have submitted drawings of the proposed sign. The drawings are attached to this report. These drawings have been circulated to city staff and to external utility companies for their comments. Any comments will be taken under consideration. Cambridge Hotel and Conference Centre Limited would benefit from the placement of the sign on the building’s façade since the restaurant operates out of the Museum. ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: The recommendation of this report supports the achievement of the city’s strategic vision through the delivery of core services. FINANCIAL IMPLICATIONS: The application fee of $264 has been paid in accordance with the City’s fee schedule. COMMUNITY ENGAGEMENT: Community engagement is not necessary for this process. Internal staff and outside utility companies will be circulated for their comments and/or approval. CONCLUSION: All appropriate staff and outside utility companies will review the drawings. Once the proposal has received staff approval, it would be in order to authorize the execution of an encroachment with the tenant of 10 King Street West.
