Saunderson, Committee Administrator Pursuant to Chapter 25 (Procedure) of the Municipal Code, a motion was brought forward by Councillor K. Galloway-Sealock to discuss Consent Items 1 and 3, which was then voted on and was Carried. 1. INS-15-069 - WOOLWICH CROSS BORDER SERVICING AGREEMENT REVISION The Committee considered Infrastructure Services Department report INS-15-069, dated October 8, 2015 recommending approval of a Cross Border Agreement with the Township of Woolwich to allocate 25% additional capacity of the Shirley Drive Sewage Pumping Station, including the operation, maintenance and any other requirements to the Township. Mr. S.Allen was in attendance and responded to questions from the Committee. On motion by Councillor K. Galloway-Sealock- it was resolved: "That the Mayor and Clerk be authorized to execute an amended Cross Border Agreement, subject to the satisfaction of the City Solicitor, with the Township of Woolwich to address allocation of an additional capacity of 25% of the Shirley Drive Sewage Pumping Station capacity to the Township of Woolwich, as well as the operation, maintenance and any other requirements, as outlined in Infrastructure Services Department report INS-15-069." 2. INS-15-082 - CROSS BORDER SANITARY SERVICING AGREEMENTS WITH CITY OF WATERLOO The Committee considered Infrastructure Services Department report INS-15-082, dated October 8, 2015 recommending approval of two Cross Border Agreements with the City of Waterloo to address existing cross border sanitary servicing between Kitchener and Waterloo. On motion by Councillor K. Galloway-Sealock- it was resolved: "That the Mayor and Clerk be authorized to execute a Cross Border Agreement, "Miscellaneous Properties-Cities of Kitchener and Waterloo", subject to the satisfaction of the City Solicitor, with the City of Waterloo to address existing cross border sanitary servicing between Kitchener and Waterloo and that the Chief Administrative Officer be delegated authority to make amendments and sign any ancillary documents related this Cross Border Agreement; and further, COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE OCTOBER 19. 2015 -49 - CITY OF KITCHENER 2. INS-15-082 - CROSS BORDER SANITARY SERVICING AGREEMENTS WITH CITY OF WATERLOO (CONT'D) That the Mayor and Clerk be authorized to execute a Cross Border Agreement, "Bridgeport Sanitary Pumping Station", subject to the satisfaction of the City Solicitor, with the City of Waterloo to address existing cross border sanitary servicing between Kitchener and Waterloo and that the Chief Administrative Officer be delegated authority to make amendments and sign any ancillary documents related this Cross Border Agreement, as outlined in Infrastructure Services Department report INS-15-082." 3. INS-15-083 - ON-STREET PARKING REGULATIONS -CARYNDALE DRIVE The Committee considered Infrastructure Services Department report INS-15-083, dated October 7, 2015 recommending a stopping prohibition anytime from 8:00 a.m. to 4:30 p.m., Monday to Friday, September 1 to June 30 on both sides of Caryndale Drive. Mr. J. Readman was in attendance and responded to questions from the Committee. Councillor K. Galloway-Sealock questioned whether consideration had been given to only restricting stopping on one side of the street. She noted that eliminating stopping/parking on both sides of the street could potentially cause any concerns identified to shift to neighbouring streets. She indicated that it would be her preference to undertake a staged approach, by restricting parking on one side of Caryndale Drive initially to determine whether further restrictions are necessary. She noted if there was no significant improvement, staff could bring back a further report asking for the prohibition on the other side of the street. In response to questions, Mr. Readman advised that he was unsure this date the full width of Caryndale Drive and whether two-way traffic could be accommodated if parking was permitted on one side of the street, noting he could follow up at a later date. Mr. Readman advised staff identified parking limitations on both sides of the street through a public consultation process. He noted that if it was the will of the Committee, staff would not be opposed to a staged approach to the stopping prohibition. A motion was brought forward by Councillor Galloway-Sealock to approve the recommendation outlined in Report INS-15-083, with an amendment to prohibit stopping only on the east side of the street closest to the school. On motion by Councillor K. Galloway-Sealock- it was resolved: "That the Uniform Traffic By-law be amended to prohibit stopping from 8:00 a.m. to 4:30 p.m., Monday to Friday, September 1 to June 30 on the east side of Caryndale Drive from Hearthwood Drive to a point 230 metres north thereof, as outlined in Infrastructure Services Department report INS-15-083." 4. INS-15-087 - DANE STREET-ONE-WAY ROAD DESIGNATION The Committee considered Infrastructure Services Department report INS-15-087, dated September 21, 2015 recommending the conversion of Dane Street to a one-way traffic operation from Borden Avenue North to Crescent Street. On motion by Councillor K. Galloway-Sealock- it was resolved: "That the Uniform Traffic By-law be amended so that traffic on Dane Street between Borden Avenue North and Crescent Street be limited to the southbound direction only, as outlined in Infrastructure Services Department report INS-15-087." 5. INS-15-088 - ON-STREET PARKING REGULATIONS -SIMS ESTATE PLACE The Committee considered Infrastructure Services Department report INS-15-088, dated September 24, 2015 recommending a parking prohibition at any time on the south side of Sims Estate Place. COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE OCTOBER 19. 2015 -50 - CITY OF KITCHENER 5. INS-15-088 - ON-STREET PARKING REGULATIONS -SIMS ESTATE PLACE (CONT'D) On motion by Councillor K. Galloway-Sealock- it was resolved: "That the Uniform Traffic By-law be amended to prohibit parking at any time on the south (even-numbered)side of Sims Estate Place from Sims Estate Drive to its easterly limit, as outlined in Infrastructure Services Department report INS-15-088." 6. INS-15-089 - ON-STREET PARKING REGULATIONS -ZELLER CRESCENT The Committee considered Infrastructure Services Department report INS-15-089, dated September 14, 2015 recommending a parking prohibition at any time on the north side of Zeller Crescent; and, 15 metre intersection restrictions at both intersections with Zeller Drive. On motion by Councillor K. Galloway-Sealock- it was resolved: "That parking be prohibited at any time on the north (odd-number side) of Zeller Crescent from a point 129 metres north of the western intersection with Zeller Drive to a point 123 metres north thereof; and, That 15 metre intersection restrictions be implemented at both intersections with Zeller Drive on both sides of the road; and further, That the Uniform Traffic By-law be amended accordingly, as outlined in Infrastructure Services Department report INS-15-089." 7. INS-15-081 - BALZER CREEK CLASS ENVIRONMENTAL ASSESSMENT The Committee considered Infrastructure Services Department report INS-15-081, dated October 8, 2015 regarding receipt of the Balzer Creek Environmental Study Report (ESR) and filing the ESR with the Ministry of Environment and Climate Change for the mandatory 30-day review period. Mr. N. Gollan was in attendance and responded to questions from the Committee. In response to questions, Mr. Gollan agreed to provide Council with a summary of all the feedback received from residents relating to the ESR. On motion by Councillor P. Singh - it was resolved: "That the Balzer Creek Environmental Study Report (ESR) prepared by Ecosystem Recovery Inc., dated October 8,2015, be received; and further, That the Balzer Creek Environmental Study Report (ESR) be filed with the Ministry of the Environment and Climate Change for the mandatory thirty (30)day review period as required by the Environmental Assessment (EA) Act, as outlined in Infrastructure Services Department report INS-15-081." 8. CSD-15-073 - KIWANIS PARK POOL RENOVATION The Committee considered Community Services Department report CSD-15-073, dated September 29, 2015 regarding the design and funding options for the Kiwanis Park pool renovation. Mr. M. Hildebrand, Ms. D. Keelan and Ms. C. Fletcher were in attendance and responded to questions from the Committee. Questions were raised regarding the public engagement survey and how the question was posed regarding the potential installation of a splash pad. Mr. Hildebrand advise that he would need to follow up regarding the exact wording of the question. COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE OCTOBER 19. 2015 -51 - CITY OF KITCHENER 8. CSD-15-073 - KIWANIS PARK POOL RENOVATION (CONT'D) Mayor B. Vrbanovic questioned the feasibility of having the pool open for the 2017 season, as it is the fiftieth anniversary of the Facility. Ms. Fletcher advised that staff would be challenged to complete the work sooner than 2016. She indicated that staff anticipate simultaneously completing the demolition of the existing facility in early fall 2016 while completing the detailed design. Mr. M. May further advised that the Region of Waterloo Public Health Department has advised that the existing facility does not comply with current Public Pool Regulations, noting that they have granted approval of a short-term solution to 2017. He noted that it would be unlikely to get a further extension beyond the current approval. Mayor Vrbanovic acknowledged the constraints and requested staff to continue investigating whether an adjustment to the proposed timeline is possible. In response to questions, Mr. May advised that staff are currently seeking private sector partners to assist with the procurement of the splash pad feature, noting that it would not be exclusive specifically to the splash pad. He indicated that if a partner identified interest in partnering with the pool, that opportunity would be available. The following motion was voted on and Carried by recorded vote, with Mayor B. Vrbanovic and Councillor B. Ioannidis, D. Schnider, F. Etherington, K. Galloway-Sealock, P. Singh, S. Marsh, S. Davey and Z. Janecki voting in favour; and, Councillor J. Gazzola voting in opposition. Councillor Y. Fernandes was absent and accordingly did not vote. On motion by Councillor S. Davey- it was resolved: "That the preferred Option `A' for the renovated Kiwanis Park pool design, be endorsed, as outlined in Community Services Department report CSD-15-073, and, That funding for the renovation of the Kiwanis Park pool be referred to the 2016 Capital Budget process for further consideration; and further, That staff be directed to pursue funding opportunities to assist with the funding of both the preferred option and/or the potential addition of spray features, through the following sources, including: a) government grants; b) private sector partnerships; and/or, c) the capital budget process." 9. INS-15-074 - MAINTENANCE ON TRAILS LEADING TO SCHOOLS The Committee considered Infrastructure Services Department report INS-15-074, dated September 3, 2015 regarding a pilot project to asphalt and provide winter maintenance for the trails leading to Glencairn Public School. Messrs D. Tyagi and R. Schirm were in attendance and responded to questions from the Committee. In response to questions, Mr. Tyagi advised that through the pilot project, staff will maintain the City portion of the trails leading to Glencairn Public School. He noted that one of the current challenges identified through the pilot program is the lack of connection, as the School Board is not winter-maintaining their property beyond the City portion of trail. He stated that staff intend to have further discussions with the School Board to find a solution to this problem. He further advised that staff anticipate monitoring the success of the program and reporting back on the status of the pilot program in approximately two years. Questions were raised on whether there have been any cost-sharing discussions with the School Board if the City expands the program and begins winter-maintaining trails leading toward more schools. Mr. Schirm advised that there have been no discussions to date regarding potential cost-sharing measures. Councillor P. Singh made reference to a petition signed by over 300 residents in support of the maintenance of trails leading to schools in the Country Hills West neighbourhood. A motion was brought forward by Councillor P. Singh to approve the recommendation as outlined in Report INS-15-074. COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE OCTOBER 19. 2015 -52 - CITY OF KITCHENER 9. INS-15-074 - MAINTENANCE ON TRAILS LEADING TO SCHOOLS (CONT'D) Councillor K. Galloway-Sealock suggested and the Committee agreed that the school name in Clause 1 of the staff recommendation should be substituted with the neighbourhood which the school is located in. She noted that by substituting the school name, it may be more clear that this is a City-driven initiative rather than a school board program. Councillor F. Etherington also proposed and the Committee agreed that Clause 2 of the recommendation should include continued dialogue with the School Board as well as School Councils in addition to the neighbourhood associations. Councillor S. March brought forward a motion to amend Councillor Singh's motion to include an additional Clause directing staff to draft a letter to the Waterloo Region District School Board and Glencairn Public School to encourage participation in the pilot program and improving their winter maintenance to help provide a safer route to school. Recorded votes were requested on Clauses 2 and 4 of the amended recommendation. It was noted on the agenda that any recommendation arising from this matter would be considered at Special Council later this date. On motion by P. Singh - it was resolved: "That the pilot project to asphalt and winter maintain trails leading to schools in the Country Hills West Neighbourhood, with staff monitoring the use of those trails through two winter seasons, be approved, as outlined in Infrastructure Services Department report INS-15-074; and, That staff continue to meet with neighbourhood associations, the school board and school councils regarding school access routes; and, That staff be directed to report back on the finding of the pilot project and seek future direction regarding winter maintaining trails leading to schools; and further, That staff be directed to draft a letter to the Waterloo Region District School Board and Glencairn Public School encouraging them to participate in the pilot program as well as improving their winter maintenance on the school property."
