SUBJECT: ZONE CHANGE APPLICATION ZC15/016/H/BB
1402, 1424 & 1430 Highland Road West
Savic Holdings Inc./Savic Homes Ltd.
RECOMMENDATION: That Zone Change Application ZC15/016/H/BB (1402, 1424 & 1430
Highland Road West) for the purpose of removing Holding Provision 7HSR from the
lands specified on the attached Map No.1, in the form shown in the "Proposed By-law"
dated October 15, 2015, attached to Report CSD-15-084 as Appendix A, be approved.
REPORT:
The subject lands are located at 1402, 1424 and 1430 Highland Road West near the
intersection of Ira Needles Boulevard and Highland Road West. The applicant is proposing to
rezone the property for the purpose of removing a holding provision. Holding Provision 7HSR is
further described in Zoning By-law 85-1 as R-9 K (F) 9R). The symbol R-9 refers to existing
Residential Nine (R-9) zoning and the symbol K requires that in order to lift the holding
provision, approval is required from the City of Kitchener's Director of Engineering. The (F) and
(R) symbols indicate the intent of the holding provision being placed on the property was to limit
development until full municipal services and road extension/road improvements were provided
to adequately accommodate any proposed future development.
The owner has entered into a Section 41 Development Agreement with the City for the
development of these lands. Engineering staff are satisfied that adequate measures have been
put in place to ensure these lands can be serviced and have provided their clearance
accordingly (see Appendix "C"). As such, Planning staff recommends that Holding Provision
7HSR be removed from the lands as shown on Map No.1 (Appendix "A").

The recommendation of this report supports the achievement of the City's strategic
vision through the delivery of core service.

FINANCIAL IMPLICATIONS:
There are no financial implications associated with this recommendation.
COMMUNITY ENGAGEMENT:
INFORM - Notice of the intention to pass an amending by-law to remove Holding Provision 62H
will be advertised in The Record on November 13, 2015. (Appendix "B"). Under the Planning
Act, no statutory public meeting or neighbourhood circulation are required for zone change
amendments to remove a holding provision. This report has been posted to the City's website
with the agenda in advance of the council / committee meeting.
CONCLUSION:
Planning staff are of the opinion that the requested Zone Change to remove Holding Provision
7HSR from the lands specified on the attached Map No.1 of Appendix "A" is appropriate at this
time since the requirements to remove the holding provision have been met. Planning Staff
recommend approval of the application as outlined in the Recommendation section of this
report.

(Being a by-law to amend By-law 85-1, as amended, known as
the Zoning By-law for the City of Kitchener— Savic Holdings
Inc./Savic Homes Ltd.
— 1402, 1424 and 1430 Highland Road West)
WHEREAS it is deemed expedient to amend By-law 85-1 for the lands specified above;
NOW THEREFORE the Council of the Corporation of the City of Kitchener enacts as
follows:
1. Schedule Number 11 of Appendix "A" to By-law Number 85-1 are hereby amended by
changing the zoning applicable to the parcel of land specified and illustrated on Map No. 1,
in the City of Kitchener, attached hereto, from Residential Nine Zone (R-9) with Holding
Provision 7HSR to Residential Nine Zone (R-9).
PASSED at the Council Chambers in the City of Kitchener this
day of 12015.

The purpose of this Zone Change Application is to remove Holding Provision 7HSR from the zoning of the above noted
lands as requirements for removal including servicing and road improvements have been fulfilled.
This application will be considered by the Community and Infrastructure Services Committee on Monday, December 7,
2015, Council Chambers, 2nd Floor, City Hall, 200 King Street West, Kitchener.
