HomeMy WebLinkAbout2015-12-01 HERITAGE KITCHENER MINUTES DECEMBER 1, 2015 CITY OF KITCHENER The Heritage Kitchener Committee met this date, commencing at 4:00 p.m. Present: Mr. G. Zeilstra-Chair Councillor Z. Janecki, Ms. M. Bell, and Messrs. S. Hamoen, S. Miladinovic, B. Page, S. Thomson and M.Timmerman. Staff: L. Bensason, Coordinator of Cultural Heritage Resources S. REGION OF WATERLOO PUBLIC BUILDING INVENTORY The Committee considered a presentation by Ms. Lindsay Benjamin, Region of Waterloo Heritage Planning Advisory Committee, regarding the recently completed Public Building Inventory. She advised all municipal Heritage Committees within the Region of Waterloo would receive the presentation as an introduction to the resource. In addition, she requested Heritage Kitchener provide input for the properties included in the inventory. She indicated an electronic copy of the Inventory would be available once consultation with area municipal Heritage Committees is complete. The Committee agreed to provide feedback to Ms. Benjamin via email and requested that a copy of the Inventory be provided to members. Ms. D. Livingstone agreed to circulate the PDF copy to the Committee. 2. CSD-15-091 - HERITAGE BEST PRACTICES The Committee considered Community Services Department report CSD-15-091, dated November 12, 2015, including Best Practices Summary Table attached as Appendix W. In addition, the Committee was in receipt this date of comments from Ms. M. Rowell, on behalf of the North Waterloo Branch of the Architectural Conservancy of Ontario (ACO) dated December 1, 2015. Mr. L. Bensason presented the Report which identifies five best practice measures with eight tangible actions. He indicated that Committee is being asked for feedback and to endorse the Heritage Best Practices as presented, and advised the final version of the Report will be brought forward for Council consideration on December 14, 2015. Ms. Margaret Rowell, North Waterloo Branch ACO, addressed the Committee in support of the Heritage best practices as outlined in the Report, and emphasized the measures should be priorities for the City of Kitchener to ensure preservation of cultural heritage resources. She referred to the correspondence distributed this date which supports the measures as presented and indicated that the North Waterloo Branch ACO would be pleased to assist with promoting greater public education and awareness of heritage conservation issues. In response to questions, Ms. Rowell clarified the Heritage Best Practices, as presented, are endorsed by the North Waterloo Branch of the ACO. Mr. Bensason responded to questions from the Committee, advising the list of prequalified engineers described as part of the Built Heritage Emergency Protocol is under review by the Chief Building Official. He noted there are criteria for consideration such as proximity in the case of an emergency, with the list being finalized within the coming months. He clarified the Protocol identifies the parties to be included in the decision-making process as well as establishes a sequence for notification during an emergency. He noted a draft of the Protocol will be reviewed by Heritage Kitchener prior to Council consideration. Mr. G. Zeilstra requested stronger wording than "professional engineers who may be used by the City in emergency situations affecting heritage property" within the Built Heritage Emergency Management Protocol, stating it should be imperative that the engineer selected to provide advice is on the pre-qualified list. CSD-15-091 - HERITAGE BEST PRACTICES (CONT'D) has expressly requested the wording as presented for inclusion in the draft Protocol, as there may be an emergency situation which dictates the use of a professional even if not pre- qualified. He noted the Protocol will identify specific situations when membership in the Association of Heritage Professionals is required before providing advice. By consensus the Committee agreed to endorse the Best Practice Measures identified in Report CSD-15-091. 3. CSD-15-086 - DESIGNATION UNDER PART IV OF THE ONTARIO HERITAGE ACT - 1683 HURON ROAD The Committee considered Community Services Department report CSD-15-086, dated November 3, 2015 requesting the Clerk be directed to publish a Notice of Intention to designate the property municipally addressed as 1683 Huron Road under Part IV of the Ontario Heritage Act, as being of cultural heritage value and interest. Ms. S. Parks presented the Report. Mr. Tim Schnarr, Mattamy Homes, addressed the Committee in support of the designation of 1683 Huron Road under Part IV of Ontario Heritage Act. In response to questions from the Committee, Mr. Schnarr indicated the front facade of the home would remain facing Huron Road, which is representative of the historical vista noted in the attributes of the property; however, access to the property would be from the new court proposed within the subdivision development. Mr. B. Page referred to the pictures included with the Report, indicating the condition of the trees is poor, and suggested they should be removed from Appendix 'B' which identifies the trees as key cultural landscape attributes. Ms. Parks clarified that alterations to the property, including removal of the trees, once Designated would require a Heritage Permit Application; however, she agreed to review the inclusion of the trees. On motion by Mr. B. Page- it was resolved: "That pursuant to Section 29 of the Ontario Heritage Act, the Clerk be directed to publish a Notice of Intention to designate the property known as 1683 Huron Road, more specifically described as Parts 14, 15 and 16 of Reference Plan 58R-18300, and Parts 13 and 19 of Reference Plan 58R-18664, as being of cultural heritage value or interest, as outlined in Community Services Department report CSD-15-086." 4. CSD-15-090 - HERITAGE PERMIT APPLICATION HPA-2015-V-022 - 48 WEBER STREET WEST - INSTALL BALCONY RAILINGS; CONVERT A WINDOW INTO A DOOR; AND INSTALL BATHROOM EXHAUST FANS The Committee considered Community Services Department report CSD-15-090, dated October 30, 2015 recommending approval of Heritage Permit Application HPA-2015-V-022 to permit installation of balcony rails; convert a window into a door; and, install bathroom exhaust fans at 48 Weber Street West. Ms. S. Parks presented the Report. Mr. Steven Litt, Owner and Applicant, addressed the Committee in support of the application and responded to questions advising ventilation for the bathrooms in each unit are next to the balcony alcove and face the front or side of the building. He invited the members to an upcoming open house as an opportunity to see the preservation efforts of the building. On motion by Mr. S. Miladinovic- it was resolved: HERITAGE KITCHENER MINUTES DECEMBER 1, 2015 -30 - CITY OF KITCHENER 4. CSD-15-090 - HERITAGE PERMIT APPLICATION HPA-2015-V-022 - 48 WEBER STREET WEST - INSTALL BALCONY RAILINGS; CONVERT A WINDOW INTO A DOOR; AND INSTALL BATHROOM EXHAUST FANS (CONT'D) "Pursuant to Section 42 of the Ontario Heritage Act, Heritage Permit Application HPA- 2015-V-022, be approved to permit installation of balcony railings; conversion of a window into a door; and installation of bathroom exhaust vents on the property municipally addressed as 48 Weber Street West, in accordance with the plans and supplementary information submitted with the application, as outlined in Community Services Department report CSD-15-090, and subject to the following condition: i) That the final building permit drawings be reviewed and heritage clearance provided by Heritage Planning staff prior to the issuance of a building permit." 5. 101 GLASGOW STREET/149 STRANGE STREET -UPDATE Mr. L. Bensason provided a verbal update on the property municipally addressed as 101 Glasgow Street/149 Strange Street which was recommended by Heritage Kitchener to be listed on the Municipal Heritage Register as a non-designated property of cultural value or interest. He advised at the October 5, 2015 Council meeting, the recommendation was deferred by Council with direction to staff to meet with the property owner and report back on December 14, 2015. He noted the original concerns expressed by the owner regarding listing the property on the Municipal Heritage Register were the requirement for a Heritage Impact Assessment (HIA) prior to any redevelopment, as well as the 60 day waiting period which allows the municipality to consider designation of the property under Part IV of the Ontario Heritage Act. He explained on December 14, 2015, a report will be brought forward for Council consideration advising the owner and staff have come to a resolution. He stated that although the requirements of the Act cannot be waived, Mr. Bensason indicated he would ensure Council is informed of the owner's concerns as well as the heritage attributes of the property. In addition, he noted that there are allowances within the Official Plan that do not require an HIA as long as the alterations to the site do not change the existing use. 6.
