HomeMy WebLinkAboutFCS-15-183 - Encroachment Agreement - 150 King St W REPORT TO: Committee of the Whole DATE OF MEETING: December 14, 2015 SUBMITTED BY: Erin Mogck, Associate City Solicitor, 519-741-2200 x7060 PREPARED BY: Erin Mogck, Associate City Solicitor, 519-741-2200 x7060 WARD(S) INVOLVED: Ward 9 DATE OF REPORT: December 9, 2015 REPORT NO.: FCS-15-183 SUBJECT: ENCROACHMENT AGREEMENT REQUEST – AWNING OVER SIDEWALK AT 150 KING STREET WEST ___________________________________________________________________________ RECOMMENDATION: “Subject to staff approval, that the Mayor and Clerk be authorized to execute an Encroachment Agreement, satisfactory to the City Solicitor, with the property owner(s) and any mortgagee(s) of the property municipally known as 150 King Street West to authorize the installation an awning which will project 1.5 feet, more or less, over the City of Kitchener’s King Street West road allowance.” BACKGROUND: The current owner of 144-150 King Street West has received approval of a Façade Improvement Grant. Prior to modifying the building’s façade, the owner must meet certain conditions and follow City processes, which involve obtaining an encroachment agreement. REPORT: The property owner has asked for permission to install an awning on the façade of the building. This awning will slightly project over the King Street West sidewalk by about 1.5 feet and will be about 8.5 feet above ground. There is zero set-back. The owner has submitted drawings of the proposed awning. The drawing is attached to this report. This drawing has been circulated to city staff and to external utility companies for their comments. Of important note, any wording beyond the municipal address (number and/or street name) requires a sign permit. If the owner wishes to include the historical name of the building then the encroachment agreement will include a condition that the owner applies for a sign permit, and submit drawings in accordance with the City’s Sign By-law. *** This information is available in accessible formats upon request. *** Please call 519-741-2345 or TTY 1-866-969-9994 for assistance. 5. - 1 ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: The recommendation of this report supports the achievement of the City’s strategic vision through the delivery of core services. FINANCIAL IMPLICATIONS: The application fee of $264 has been paid in accordance with the City’s fee schedule. COMMUNITY ENGAGEMENT: INFORM – This report has been posted to the city’s website with the agenda in advance of the Council meeting. CONSULT - Internal staff and outside utility companies have been circulated for their comments and/or approval. CONCLUSION: Most of the appropriate staff and outside utility companies have reviewed the drawings. Once the proposal has received all staff approval, it would be in order to authorize the execution of an encroachment agreement with the property owner(s) and any mortgagee(s) of 150 King Street West.
