INTERPRETATION
298.1.1 City-defined
"City"means The Corporation of the City of Kitchener.
298.1.2 Council- defined
"Council"means the Council of The Corporation of the City of Kitchener.
298.1.3 Farmers' Market- defined
"Farmers'Market"means that portion of Your Kitchener Market designated
for use by Farmers' Market Vendors.
298.1.4 Farmers' Market Vendor-defined
"Farmers' Market Vendor"means any person holding a current permit to
operate a stand at the Farmers'Market on days established for this purpose.
298.1.5 Manager-defined
"Manager" means the Market Manager appointed by City Council and
his/her delegate.
298.1.6 Market Shops-defined
"Market Shops"means that portion of Your Kitchener Market designated
for use by market shops vendors.
298.1.7 Market Shop Vendor-defined
"Market Shops Vendor"means any person holding a current lease to operate
a business at the Market Shops on days established for this purpose.

298.1.8 Permit-defined
"permit"means the permission granted by the Manager to Farmers'Market
Vendors to locate their business at the Farmers' Market and shall include
terms and conditions of use.
298.1.9 Person-defined
"person"means an individual,sole proprietorship,partnership,unincorpo-
rated association,trust, or a body corporate.
298.1.10 Regulations-defined
"regulations"means the Market Management and Operations Manual as ap-
proved and amended from time to time by City Council.
298.1.11 Vendor-defined
"vendor"means any Farmers' Market Vendor or Market Shops Vendor as
herein defined.
298.1.12 Your Kitchener Market-defined
"Your Kitchener Market" means both the Farmers' Market and Market
Shops as herein defined.
Article 2
GENERAL PROVISIONS
298.2.1 Establishment-location
Your Kitchener Market shall be established on King Street East,more par-
ticularly described as those lands belonging to the City for Market purposes
and bounded by King Street East,Eby Street,Duke Street and Cedar Street,
and shall include portions of Market Lane and Eby Street when closed for
Market purposes.
298.2.2 Policy and regulation-established by Council
Your Kitchener Market shall be governed by policy and regulations estab-
lished by Council.
298.2.3 Permit fees-prescribed by Council
Permit fees shall be in an amount as prescribedby Council from time to time.
298.2.4 Management-authority
Your Kitchener Market shall be under the direct charge,care and manage-
ment of a Manager who shall have full responsibility for the administration
of Your Kitchener Market and enforcement of the policy and regulations.
298.2.5 Sale of goods-permit required
No person shall sell or offer to sell at the Farmers'Market,directly or indi-
rectly,any produce,articles or goods without first having obtained a permit
from the Manager.

298.2.6 Operation of business-lease requirement
No person shall operate a business at the Market Shops without first having
obtained a lease from The Corporation of the City of Kitchener.
298.2.7 Operation in compliance with regulations
Vendors shall operate in accordance with any regulations established by
Council.
Article 3
ENFORCEMENT
298.2.8 Fine-for contravention
Every person who contravenes any of the provisions of this Chapter shall be
guilty of an offence and liable,upon conviction,to a fine of not more than
Five Thousand Dollars($5,000).
Article 4
SEVERABILITY
298.4.1 Validity
Each and every of the provisions of this Chapter is severable and if any pro-
vision of this Chapter should for any reason be declared invalid by any court,
it is the intention and desire of this Council that each and every of the then re-
maining provisions shall remain in full force and effect.
Article 5
REPEAL
298.5.1 By-law-previous
By-law 88-58 as amended and the contents of the former Chapter 255 are
hereby repealed.By-law 2004-98, 17 May,2004.
