Article 1
INTERPRETATION
554.1.1 City-defined
"City"shall mean The Corporation of the City of Kitchener.
554.1.2 Council- defined
"Council"means the council of The Corporation of the City of Kitchener.
554.1.3 Manager of Licensing-defined
"Manager of Licensing"shall mean the Manager of Licensing of The Cor-
poration of the City of Kitchener.
554.1.4 Order in Council- defined
"Order In Council"shall mean Order In Council Number 1413/08 made on
August 12,2008,by the Lieutenant Governor in Council under the Gaming
Control Act, 1992, S.O. 1992,c. 24.
Article 2
LOTTERY LICENSING OFFICER
554.2.1 Appointment
The Manager of Licensing is appointed Lottery Licensing Officer for the
City.
554.2.2 Duties
The Lottery Licensing Officer shall receive applications, collect fees and
make investigations on applications for lottery licences within the power of
this Council.

GENERAL PROVISIONS
554.3.1 Application-favourable-licence issue
If all information received by the Lottery Licensing Officer on an applica-
tion is favourable and he/she knows no reason why such application should
not be granted,the proper fee having been paid,he/she shall issue a licence
over his/her signature.
554.3.2 Application-unfavourable-licence refused-appeal
When all information on an application is not favourable or the Lottery Li-
censing Officer knows of any reason why the licence should be refused,
he/she may refuse the licence,subject to the right o fthe applicant to appeal to
Council; or the Lottery Licensing Officer may refer the application to
Council for direction.

554.3.3 Fees-calculation
In accordance with the Lottery Licensing Policy Manual issued by the Alco-
hol and Gaming Commission of Ontario,the following lottery licensing fees
shall be charged:
Bazaar-$10 per wheel and 3 per cent of the value of the prizes offered
for a raffle or bingo event
Raffle-3 per cent of the total value of the prizes to be awarded
Break Open Tickets-3 per cent of the total prize to be awarded
Bingo-the annual rate set by the Manager of Licensing which shall not
exceed$165 per event.
554.3.4 Criminal Code-violation-prohibited
In no case shall any licence be issued for any lottery which would,notwith-
standing such licence,be contrary to section 206,207 or 208 of the Criminal
Code of Canada or to the Order in Council.
554.3.5 Forms-use
The City shall use such forms as maybe prescribed or provided by the Regis-
trar of the Alcohol and Gaming Commission of Ontario pursuant to section
13(e)of its Order in Council.
Article 4
REPEAL
554.4.1 By-law-previous
By-law 87-180, By-law 89-60, section 2 of By-law 92-264, By-law
2000-158 and the contents of Chapter 554 are hereby repealed. By-law
2009-025,26 January,2009.
