INTERPRETATION
930.1.1 Biochemical oxygen demand-defined
"biochemical oxygen demand"or B.O.D.means the quantity of oxygen uti-
lized in the biochemical oxidation of organic matter in five(5)days at twenty
degrees centigrade,expressed in milligrams per litre,as determined in accor-
dance with Standard Methods.
930.1.2 Body of water-defined
"body of water"includes any brook,creek,stream,river,lake,pond,water-
way,watercourse,canal or other flowing or standing water.
930.1.3 Building drain- defined
"building drain"means that part of the lowest horizontal piping of drainage
system in or adjacent to a building and which receives the discharge from a
soil pipe,or waste pipe,or other drainagepipe,and conveys it to thebuilding
sewer.

930.1.4 Building sewer-defined
"building sewer" means that part of a drainage system outside a building
commencing at a point three feet from the outer face of the wall of the build-
ing, and connecting the building drain to the public sewer or place of dis-
posal of sewage.
930.1.5 City-defined
"City"means The Corporation of the City of Kitchener.
930.1.6 Coliform count- defined
"coliform count"means the number of all coliform bacteria, expressed in
number of coliform bacteria per 100 millilitres of solution,as determined in
accordance with Standard Methods.
930.1.7 Colour of a liquid-defined
"colour of a liquid"means the appearance of a liquid from which the sus-
pended solids have been removed,as determined in accordance with Stan-
dard Methods.
930.1.8 Combined sewer- defined
"combined sewer"means a sewer intended to function simultaneously as a
storm sewer and a sanitary sewer.
930.1.9 Force main-defined
"force main"means a sewer main under pressure by means of pumping.
930.1.10 Garbage-defined
"garbage"means solid wastes from the preparation,cooking,dispensing of
food and from the handling,storage and sale of produce.By-law 87-343,14
December, 1987.
930.1.11 Director-defined
"Director"means the Director,Engineering Services of The Corporation of
the City of Kitchener,or the person duly authorized to act in the Director's
stead.By-law 2011-047,28 March,2011.
930.1.12 Industrial wastes-defined
"industrial wastes"means the liquid wastes from industrial processes as dis-
tinct from sanitary sewage and includes any liquid, solid or gaseous sub-
stance, or combination thereof, resulting from any process of industry,
manufacturing,commercial food processing,business,trade or research,in-
cluding the development, recovering and processing of natural resources,
and water from cooling or condensing systems and air conditioning systems.
930.1.13 Matter-defined
"matter"includes any gaseous,liquid or solid matter.

930.1.14 Natural outlet-defined
"natural outlet"means any outlet into a watercourse,pond, ditch, lake, or
other body of surface or ground water.
930.1.15 mg/1 - defined
11mg/1"means milligrams per litre.
930.1.16 Person-defined
"person" means any person, firm, co-partnership or corporation or any
trustee,manager, or other person either individually or jointly with others,
owning or occupying any building or place or having the management or su-
pervision of any building or place to which this by-law applies,and shall also
include any agent, servant or employee of such person, firm or
co-partnership or corporation.
930.1.17 Phenolic compounds-defined
"phenolic compounds"means those hydroxy derivatives of benzene, or its
condensed nuclei, which can be identified by the 4-Aminoantipyrene
method in accordance with Standard Methods.
930.1.18 pH- defined
"pH"means the logarithm to the base 10 of the reciprocal of the concentra-
tion of hydrogen ions in grams per litre of solution,as determined in accor-
dance with Standard Methods.
930.1.19 Private sewage disposal- defined
"private sewage disposal"means any method of disposing of sewage except
those mentioned in Schedule `B' of the Public Health Pict, being R.S.O.
1960,chapter 321.
930.1.20 Regional Corporation-defined
"Regional Corporation"means The Regional Municipality of Waterloo.
930.1.21 Sanitary sewer-defined
"sanitary sewer"means a sewer for the collection and transmission of do-
mestic,commercial and industrial wastes or any of them.
930.1.22 Sewage-defined
"sewage" includes drainage, storm water, commercial wastes and
wastewater.
930.1.23 Sewage works-defined
"sewage works"means all sewers,sewer systems,sewage pumping stations,
sewage treatment plants and other works for the collection, acceptance,
transmission,treatment and disposal of sewage for any one or more of them.

930.1.24 Standard methods-defined
"standard methods" means the edition, current at the date of testing, of
"Standard Methods for the Examination of Water and Waste Water,"pub-
lished jointly by the American Public Health Association, the American
Water Works Association and the Water Pollution Control Federation.
930.1.25 Storm sewer-storm drain-defined
"storm sewer"or"storm drain"means a sewer for the collection and trans-
mission of storm water run-off,drainage or sewage derived from the drain-
ing of land or from a watercourse or any one or more of them.
930.1.26 Suspended solids-defined
"suspended solids"means solid matter in or on a liquid,which matter is re-
movable by filtering with a glass fibre filter paper equivalent to a Reeve An-
gel Glass Fibre Filter Paper No. 934AH.
930.1.27 Treatment works-defined
"treatment works"means building,structures,plant,machinery,equipment,
devices, intakes and outfalls or outlets and other works designed for the
treating of sewage or land drainage, or both, and includes facilities for the
collection,dispersing and disposing of sewage or land drainage as incidental
thereto, and land appropriated for such purposes and uses.
930.1.28 Watercourse-defined
"watercourse"means an open channel or ditch constructed as or resulting
from construction of a municipal work,in which a flow of storm water oc-
curs either continuously or intermittently,including road ditches and includ-
ing other natural depressions or watercourses draining into any such open
channel or ditch whether connected to a storm sewer or not.By-law 87-343,

Article 2
DRAINS AND CONNECTIONS
930.2.1 Uncover-disturb -written permission-required
No person shall uncover,make any connections with or opening into,use,
alter or disturb any public sewer or appurtenance thereof without first ob-
taining permission in writing, from the Director,Engineering Services.
930.2.2 Disconnect-notice in writing-exception
No person shall disconnect,except for the purpose of repair,any drain carry-
ing sanitary sewage or other waste to the sewer without first notifying in
writing,the Chief Building Official and the Director,Engineering Services.

930.2.3 Sewer-discharge into-limited
No person shall discharge any gaseous,liquid,or solid matter into any sewer
which mediately or immediately enters into any City sewer,except in accor-
dance with this Chapter.
930.2.4 Watercourse-discharge into -limited
No person shall discharge any gaseous,liquid or solid material into any wa-
tercourse, except in accordance with this Chapter. By-law 87-343, 14 De-

930.2.5 Prosecutions-local- statutory
The Director, Engineering Services is responsible for the enforcement of
this Chapter and may cause prosecutions to be initiated hereunder or under
the Ontario Water Resources Act,R.S.O. 1990,c.0.40,or the Environmen-
tal Protection Pict,R.S.O. 1990,c. E.19.
Article 3
SEWAGE WORKS
930.3.1 Standards- design-construction
The Director,Engineering Services may,from time to time,establish such
standards as are necessary to govern the design and construction of all sew-
age works and all persons must conform to such standards when initiating
any new sewage works.
930.3.2 Building sewer-application-to construct
All persons desiring to construct a building sewer which directly connects to
a City sewer shall make written application to the Director,Engineering Ser-
vices and no person shall construct a building sewer without having first ob-
tained approval to connect to the City system.
930.3.3 Building sewer-inspection-fee payable
Upon approval of the application,the City may require the applicant to pay
to the Treasurer of the City such sums as may be required which will entitle
the applicant to:
(a) an inspection by the Director, Engineering Services of the
sewer and the connection to the City sewer or building sewer at
the street line,or
(b) the installation of the connecting sewer from the City's sewer to
the property line.

930.3.4 Building sewer-existing-inspection
No existing building sewer connected to a City sewer shall be used fora con-
nection to a new building unless it has first been examined and tested by the
Director, Engineering Services and found to comply with all the require-
ments of this Chapter. By-law 87-343, 14 December, 1987; By-law

930.3.5 Discharge-hazardous-limited
Except as permitted under Section 930.4.1 of this Chapter no person shall
discharge into land drainage works,private branch drains or connections to
any sewer,sewer system or sewage works which are connected directly or
indirectly to the City Sewage System,any matter or quantity of matter which
may be or become harmful to any sewage works or which may interfere with
their proper operation, or which may impair or interfere with any sewage
treatment process, or which may be or may become a hazard to persons,
property or animals and,without limiting the generality of the foregoing,any
of the following:
(a) sewage containing more than a total of 100 milligrams per litre
of oil,fat and grease of animal and vegetable origin;
(b) sewage containing more than a total of 15 milligrams per litre of
oil,grease or tar of mineral origin;
(c) sewage at a temperature in excess of 65 degrees Celsius;
(d) subject to subparagraph (b) hereof, flammable or explosive
matter, and without limiting the generality of the foregoing,
gasoline,benzene,naphtha fuel oil, acetone or other solvents;
(e) any quantity of matter capable of obstructing the flow in or in-
terfering with the proper operation of any part of the sewage
works,and without limiting the generality of the foregoing,any
such quantity of ashes, cinders, sand, straw, mud, shavings,
metal,glass,rags,feathers,plastic,wood or cellulose;
(f) sewage having a pH less than 6.0 or greater than 10.5 or which,
due to the sewage s nature or content,becomes less than 6.0 or
greater than 10.5 during transmission to a sewage treatment
plant,or having any other corrosive property capable of causing
damage or hazard to structures,equipment,and personnel of the
sewage works;
(g) sewage of which the B.O.D. exceeds 300 milligrams per litre;
(h) sewage in which suspended solids exceed 350 milligrams per
litre;

(i) sewage that may cause a nuisance,and without limiting the gen-
erality of the foregoing,sewage containing hydrogen sulphide,
carbon disulfide,ammonia,trichloro ethylene,sulphur dioxide,
formaldehyde,chlorine,bromine,or pyridine,in such quantity
that an offensive odour could emanate from the sewage works
or could cause a nuisance;
(j) sewage containing any matter in quantity or concentration that
will or may cause the death of or injury to any person,property
or animal;
(k) sewage containing animal waste,and without limiting the gen-
erality of the foregoing,containing intestines,stomach casings,
intestinal contents, hides, hooves, toenails, homy, bones or
poultry heads, or sewage containing hair, wool, fur, feathers,
paunch manure or fleshing in a quantity sufficient to interfere
with the proper operation of the sewage works;
(1) any garbage,provided that garbage from garbage disposal units
or grinders,and food waste which has been properly shredded
so that all particles will be carried freely under flow conditions
normally prevailing in public sewers shall be permitted if the
disposal unit or grinder was installed prior to the 26th day of
April,A.D. 1973.
(m) sewage containing any of the following matter in excess of the
indicated concentrations:
phenolic compounds 1.0 milligrams per litre
total cyanides
expressed as HCN 2.0 milligrams per litre
total sulphides 3.0 milligrams per litre
expressed as H2S
total copper 5.0 milligrams per litre
expressed as Cu

Atomic Ener�U Control Act, R.S.C. 1952, Chapter 11, and
amendments thereto and regulations thereunder;
(o) storm run-off, sewage derived from the drainage of lands or
roofs,or water used for cooling purposes;
(p) sewage which consists of two or more separate layers.
930.3.6 Discharge-limits exceeded
(a) Where sewage exceeds the above maximum limits,the person
discharging the sewage shall provide, at their own expense,
such preliminary treatment as may be necessary to:
(i) reduce thebiochemical oxygen demand to 300 mil-
ligrams per litre and the suspended solids to 350
milligrams per litre; or

(ii) reduce objectionable characteristics or constitu-
ents to within the maximum limits provided for in
Section 930.3.5 prior to discharge into the City's
sewers.
(b) All such private treatment installations must meet the require-
ments of the Regional Corporation.
(c) Plans,specifications,and otherpertinent information relating to
proposed preliminary treatment facilities shall be submitted for
approval to the Commissioner of Engineering of the Regional
Corporation.
(d) No construction of such facilities shall be commenced until the
said approvals are obtained in writing.
(e) Where preliminary treatment facilities are provided for any wa-
ter or wastes,they shall be maintained continuously in satisfac-
tory and effective operation by the owner, at the owner s

930.3.7 Grease-oil- sand interceptors- required
For other than private living quarters or dwelling units,grease,oil or sand in-
terceptors shall be provided for the proper handling of liquid wastes contain-
ing grease, flammable wastes, sand or other harmful ingredients. These
facilities shall be provided in accordance with the standards and specifica-
tions provided by the Chief Building Official,including those under Section
930.3.5 of this Chapter. By-law 87-343, 14 December, 1987; By-law

Article 4
AGREEMENT-RECEIVE- TREAT WASTES
930.4.1 No violation-where entered into
No person shall be deemed to violate this Chapter by discharging or permit-
ting to be discharged into a sanitary sewer,wastes with B.O.D.,suspended
solids or treatable phenolic equivalents higher than those stipulated in Sec-
tion 930.3.5, if the person discharging is in possession of a current agree-
ment issued pursuant to Section 930.4.2 below.
930.4.2 Terms-higher equivalents
The Commissioner of the Regional Corporation may make agreements on
behalf of the Region to receive and treat wastes with B.O.D.suspended sol-
ids or treatable phenolic equivalents higher than those permitted by Section
930.3.5 .

930.4.3 Fee-execution
No agreement shall be made until the applicant has paid a fee of$25.Every
agreement shall be executed by the proper signing officers of the industry
under its corporate seal and by the Commissioner of Engineering on behalf
of the Region.
930.4.4 Surcharge-payment-four times per year
The holder shall pay four times per year on the last day of periods consisting
of three (3) months, a surcharge for the cost of treating the holders over
strength wastes during the said period.
930.4.5 Surcharge-calculation
The surcharge shall be calculated as follows:

930.4.6 Expiry-December-following issue
Unless otherwise expressly stated on the face thereof or sooner revoked,ev-
ery agreement shall expire on the 31 st day of December next following the
date of its issue.
930.4.7 Discharge-hazardous- not affected
No agreement shall affect the operation of Sections 930.3.5 and 930.3.7.
930.4.8 Testing- measuring
The Commissioner of Engineering of the Regional Corporation is autho-
rized to take such steps as are necessary for the purpose of:
(a) testing wastes,and
(b) measuring wastes.
930.4.9 Sewage meter-installation-required
Any person having an agreement with the Regional Corporation shall install
a sewage meter satisfactory to the Regional Corporation and shall discharge
all sewage through such meter.In default of the person installing and main-
taining a sewage meter,the person shall be charged for the same number of
gallons of sewage as the number of gallons of water supplied,as shown by
the water meter of any area municipality supplying water or as may be other-
wise supplied to the person.If the supply of water is unmetered,the Regional
Corporation shall determine the amount of water supplied in any manner or
method practicable and the quantity of water so determined shall be used in
computing the applicable charges.
930.4.10 Strengths-of water-measurement
For the purposes of Sections 930.4.4 and 930.4.5 of this Chapter, the
strengths of wastes shall be deemed to be as determined by tests conducted
by or authorized by the Commissioner of Engineering of the Regional Cor-
poration,or in such other manner as the Engineering Committee of the Re-
gional Council may approve from time to time.
930.4.11 Acceptability- decided on case-by-case basis
The acceptability of the discharge to a particular sewage treatment plant of
phenolic equivalent discharges shall be decided on a case-by-case basis and
the cost of demonstrating this acceptability for treatment shall be home by
the industry in question.

Article 5
INDUSTRIAL WASTE
930.5.1 Manholes-observation-sampling-measurement
The owner of any property served by a building sewer carrying industrial
wastes shall install one or more suitable sampling manholes in the building
sewer to facilitate observation,sampling and measurement of the wastes.
(a) Such manholes shall be easily accessible and safely located and
shall be constructed in accordance with plans approved by the
Commissioner of Engineering of the Regional Corporation.
(b) Such manholes shall be installed by the owner at the owner s ex-
pense,and shall be maintained by the owner so as to be safe and
accessible at all times.
930.5.2 Measurement-test-analyses-standard methods
All measurements, tests, and analyses of the characteristics of waters and
wastes to which reference is made in Section 930.3.5 shall be determined in
accordance with Standard Methods and shall be determined at the control
manholes provided for in the preceding Section or upon suitable samples
taken at said control manholes.
Article 6
STORM SEWERS
930.6.1 Discharge into -prohibition
No person shall discharge,cause or permit the discharge of,or deposit into or
in any storm sewer,storm sewer system for the collection and transmission
of storm water run-off,drainage or sewage derived from the draining of land
or from a watercourse of any one or more of them;that are capable of dis-
charging into any City storm sewer or any storm sewer which immediately
or mediately enters into City storm sewers or into any City watercourse:
(a) sewage at a temperature in excess of sixty-five degrees Celsius
(65°C).
(b) sewage containing more than a total of fifteen(15)milligrams
per litre of fat, oil, grease or other matter which is soluble in
ether.
(c) subject to subparagraph (b) hereof, flammable or explosive
matter, and without limiting the generality of the foregoing,
gasoline,benzene,naphtha,fuel oil,acetone or other solvents.
(d) any quantity of matter capable of obstructing the flow in or in-
terfering with the proper operation of any part of the sewage

works and without limiting the generality of the foregoing,any
such quantity of ashes, cinders, garbage, sand, straw, mud,
shavings,metal,glass,rags,feathers,plastics,wood,cellulose,
tar or animal wastes.
(e) sewage containing any matter in a quantity or concentration that
will or may cause the death of or injury to any person,property
or animal.
(f) sewage having a pH of less than 6.0 or greater than 9.5 or which,
due to the sewage s nature or content becomes less than 6.0 or
greater than 9.5 during transmission through the sewage works.
(g) sewage in which the suspended solids content exceeds fifteen
(15)milligrams per litre or sewage containing any suspended
solids which are incapable of passing through a screen having
openings not larger than 3.35 millimetres square(#6 standard
sieve).
(h) sewage that has or may cause an offensive odour,and without
limiting the generality of the foregoing,sewage containing hy-
drogen sulphide,carbon disulfide,ammonia,trichloroethylene,
sulphur dioxide, formaldehyde, chlorine,bromine or pyridine
in such quantity that an offensive odour could emanate from the
sewage works or could cause a nuisance.
(i) sewage of which the B.O.D.exceeds fifteen(15)milligrams per
litre.
(j) sewage containing coloured matter to the degree that the waste
would require a dilution in excess of four(4)parts of distilled
water to one(1)part of such sewage to produce a mixture the
colour of which is not distinguishable from that of distilled
water.
(k) sewage containing toxic or poisonous matters in sufficient
quantity to constitute a hazard to persons,property or animals,
and without limiting the generality of the foregoing, sewage
containing any of the following matter in excess of the indicated
concentrations:

(m) radioactive materials, except as may be permitted under the
Atomic Enemy Control Act, R.S.C. 1952, Chapter II and
amendments thereto and regulations thereunder.
930.6.2 Waste water-treatment-expense
Where a waste water is not amenable to treatment in the Regional Sewage
Works, the Regional Corporation may direct that it be treated to meet the
provisions of Section 930.6.1 of this Chapter at the expense of the person
discharging the waste water, and then discharged to storm sewer or
watercourse.
Article 7
DAMAGE- TO STRUCTURE
APPURTENANCE-EQUIPMENT
930.7.1 Malicious-wilful-negligent-prohibited
No person shall maliciously, wilfully, or negligently break, damage, de-
stroy,uncover,deface or tamper with any structure,appurtenance,or equip-
ment which is part of the sewage works of the City.
Article 8
COMMISSIONER-POWER AND AUTHORITY
930.8.1 Entry-upon lands-premises-inspection
The Commissioner shall be permitted at all reasonable times to enter upon
any lands or premises served by any combination sewer, sanitary sewer,
storm sewer or drain, for the purpose of observation,inspection,measure-
ment,sampling and testing to ascertain if the provisions of this Chapter are
being observed.
930.8.2 Duty- enforcement
It shall be the duty of the Commissioner to enforce the provisions of this

ENFORCEMENT
930.9.1 Fine-for contravention
Every person who contravenes any of the provisions of this Chapter is guilty
of an offence, and is liable,upon conviction, to a fine not exceeding Five
Thousand Dollars($5,000),exclusive of costs,for each offence recoverable
under the Provincial Offences Act. By-law 87-343, 14 December, 1987;

Article 10
SEVERABILITY
930.10.1 Severability
Any section,clause,sentence or provision of this Chapter or any part or parts
thereof held to be invalid shall be severable and shall not affect the validity of
