KITCHENER 945.1 JUNE 2004 945.1.2 WATER 945.2.1 945.1.2 Water- sprinkling-time for No person shall water or sprinkle,or cause or permit the watering or sprin- kling of any lawn,garden,tree, shrub or other outdoor plant in the City of Kitchener through a hose or other attachment except between the hours of 7:00 a.m.and 10:00 a.m.,and between the hours of 7:00 p.m.and 11:00 p.m. subject to the following: (a) premises with municipal addresses having even numbers may sprinkle or water within the designated times only on even-num- bered calendar days; (b) premises with municipal addresses having odd numbers may sprinkle or water within the designated times only on odd-num- bered calendar days. 945.1.3 New sod-trees-gardens-lawn treatment-exception Notwithstanding Section 945.1.2,watering is permitted for the following: (a) newly planted sod, trees, ornamental shrubs and flower gardens while being installed and during the next following twenty-four hours after the completion of installation;and (b) lawns being treated with any pesticide,herbicide spray or fertilizer which requires water while being treated and during the next fol- lowing twenty-four hours after the application.By-law 90-74, 14 May, 1990. 945.1.4 Water supply emergency-Chapter suspended Notwithstanding the provisions of this Chapter,upon a Stage 2 or Stage 3 water supply emergency being declared by the Regional Municipality of Waterloo pursuant to its By-law 03-025,the operation of this Chapter shall be suspended and the provisions of the said Regional by-law shall govern.In the event of the Stage 2 or Stage 3 water supply emergency being declared at an end,the provisions stated in this Chapter shall apply.By-law 2003-154, 25 August,2003. Article 2 ENFORCEMENT 945.2.1 Fine-for contravention Every person who contravenes any provision of this Chapter is guilty of an offence and is liable,upon conviction,to a fine not exceeding Five Thousand Dollars($5,000),exclusive of costs,for each offence,recovered under the Provincial Offences Pict. JUNE 2004 945.2 KITCHENER 945.3.1 WATER 945.4.1 Article 3 REPEAL 945.3.1 By-laws-previous By-law 89-153 and the contents of Chapter 945 are hereby repealed. Article 4 CODIFICATION 945.4.1 Inclusion-in Municipal Code The Clerk is hereby directed to make this Chapter a part of The City of Kitchener Municipal Code as Chapter 945,by adding it to the Concordance and arranging and numbering it so as to fit within the scheme of the Code.
