Gosse, Committee Administrator DTS-04-002 HOLBORN DRIVE ON-STREET PARKING CHICOPEE - GRAND RIVER WARD The Committee considered Development and Technical Services Department report DTS-04-002 dated December 23, 2003 dealing with prohibited parking on the east side of Holborn Drive near Old Chicopee Drive. On motion by Councillor M. Galloway - it was resolved: "That on-street parking be prohibited at any time on the east side of Holborn Drive from Old Chicopee Drive to a point 45 metres north thereof; and further, That the Uniform Traffic By-law be amended accordingly." DTS-04-003 RIVERBEND DRIVE AND WELLINGTON STREET NORTH TRAFFIC CONTROLS BRIDGEPORT - CENTRE WARD The Committee considered Development and Technical Services Department report DTS-04-003, dated December 23, 2003 dealing with traffic control signals at the intersection of Riverbend Drive and Wellington Street North. On motion by Councillor M. Galloway - it was resolved: "That the Region of Waterloo include the installation of traffic control signals at the intersection of Riverbend Drive and Wellington Street North in their 2004 new signal program; and, That a temporary all-way stop control be installed at the intersection of Riverbend Drive and Wellington Street North, to be removed upon the installation of traffic control signals; and further, That the Uniform Traffic By-law be amended accordingly." DTS-04-005 PINE MARTIN CRESCENT ON-STREET PARKING SOUTH WARD The Committee was in receipt of Development and Technical Services Department report DTS- 04-005 dated January 7, 2004 dealing with prohibited parking on Pine Martin Crescent near Wilderness Drive. DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES JANUARY 19, 2004 - 9- CITY OF KITCHENER 3. DTS-04-005 PINE MARTIN CRESCENT (CONT'D) On motion by Councillor M. Galloway - it was resolved: "That on-street parking be prohibited at anytime on the north (inside curve) side of Pine Martin Crescent from a point 55 metres west of Wilderness Drive (east intersection) to a point 30 metres west thereof; and, That on-street parking be prohibited at anytime on the north side (inside curve) of Pine Martin Crescent from a point 195 metres west of Wilderness Drive (east intersection) to a point 45 metres west thereof; and further, That the Uniform Traffic By-law be amended accordingly." 4. CRPS-04-006 ENVIRONMENTAL COMMITTEE APPOINTMENTS - CO-CHAIR FORMER MEMBER, DEREK LIPPERT REPRESENTATIVE TO CITIZENS ADVISORY COMMITTEE ON AIR QUALITY The Committee was in receipt of Corporate Services Department report CRPS-04-006 dated January 9, 2004 dealing with recommendations from the Environmental Advisory Committee regarding the Committee's composition. On motion by Councillor M. Galloway - it was resolved: "That Mr. Patrick O'Toole be appointed Co-Chair of the Environmental Committee for a term to expire on November 30, 2004; and further, That Mr. Derek Lippert be appointed to the Environmental Committee for a term to expire on November 30, 2004." DTS-003-185 ZONE CHANGE APPLICATION ZC 03/05/L/TB 310, 316, 320, 340 LOUISA STREET 175 AND 225 ST. LEGER STREET I ADAM STREET BRIDGEPORT - CENTRE WARD The Committee was advised that the City has initiated a zone change application to re-zone the remaining industrial lands within the block bounded by Margaret, Blucher, St. Leger, and Louisa Streets. This application proposes to change the zoning from the General Industrial (M-2) Zone to the Residential Six (R-6) and the Residential Eight (R-8) with a number of Special Use and Holding Provisions Special Regulations, in conformity with the direction of the Kitchener Municipal Plan. In this regard, the Committee considered Development and Technical Services Department report DTS-03-185, dated January 5, 2004, and a proposed By-law dated January 5, 2004 attached to the report. Mr. J. Willmer summarized the purpose of the application noting that the proposed zone change was in compliance with Council's direction, through the Municipal Plan, for the transition of the area from industrial use to a mixed use of primarily residential development. He also noted that staff are recommending a community consultation process prior to the submission of a site plan or plan of subdivision on the subject properties. Mr. T. Boutilier provided an overview of the zone change application noting that the properties within the subject area range from residential to industrial uses. The application is proposing to re-zone those properties currently zoned industrial to residential which would allow a higher density residential development to take place with maximum building heights of 10.5 metres and 35 metres for the R-6 and R-8 Zones respectively. DTS-003-185 ZONE CHANGE APPLICATION ZC 03/05/L/TB (CON'T) industrial properties would have a holding provision which would require a record of site condition to be completed prior to residential dwellings being developed on the lands. Mr. Boutilier concluded his presentation noting that concerns expressed by the area residents and businesses involved mainly increased traffic in the area and the need for any development to blend in with the existing community. Ms. Mary Pappert, representing the Estates Tenant's Association, 188 Margaret Avenue, attended stating that the association did not have any objection to the proposed re-zoning but had concerns regarding the allowable building heights and densities, assurances for adequate parking for any residential high-density development, traffic issues resulting from any development and the possibility of site contamination from the previous industrial uses. Ms. Pappert pointed out that the association is in agreement with the process so far, but would reserve any decision regarding any application to develop the properties until a site plan has been reviewed by the association. Mr. Geoff Van der Baron, Mark Dorfman Planner Inc., and representing The De Luca Group, attended noting that although his client supports the re-zoning application he has a concern regarding the public consultation process. Mr. Van der Baron explained that there are properties owned by his client that are currently zoned for residential uses and should not be part of any proposed public consultation process. He added that the public consultation should be restricted to those properties that are directly subject to the re-zoning application before the Committee. J. Willmer advised that staff were in agreement with Mr. Van der Baron and suggested that Clause B of the recommendation be amended so that a community consultation process be conducted for the lands subject to this zone change application. No other delegations were registered respecting this matter. On motion by Councillor J. Smola - it was resolved: "That Zone Change Application ZC03/05/L/TB, proposing a change in zoning from General Industrial Zone (M-2) and Residential Eight Zone (R-8) with Special Use Provision 177U and Special Regulation 166R and Holding Provision 21H to Residential Six Zone (R-6) with revised Special Use Provision 177U and Holding Provision 21H, Residential Eight Zone (R-8) with revised Special Use Provision 177U and Holding Provision 21H, Residential Six Zone (R-6) with revised Special Use Provision 177U and Holding Provision 47H, Residential Six Zone (R-6) with Special Use Provision 334U and Holding Provision 48H, on lands legally described as P376 L461 PT L460 PTL 464 TO PTL466 PT526 TO PTL533 PT PARK LOT L PART ADAM ST CLOSED; Plan 376 PT LOTS 464,465,466; PLAN 376 PT PARK M & N RP 58R1278 PARTS; and PLAN 376 PT PARK LOT M 58R4897 PART 1; P376 L461 PT L460 PTL 464 TO PTL466 PT526 TO PTL533 PT PARK LOT L PART ADAM ST CLOSED; and PLAN 376 PT PARK M & N RP 58R1278 PARTS 1 & 2; PLAN 376 PT LOT 459 PT LOT 460 and PLAN 376 PT LOT 460; PLAN 376 PT LOT 458 PT LOT 459; in the City of Kitchener, be approved, in the form shown in the "Proposed By-law" attached to Report DTS-03- 185, dated January 5, 2004, without conditions; and further, That prior to the acceptance of a Site Plan or Plan of Subdivision application for the lands subject to Zone Change Application ZC 03/05/L/TB, a community consultation process be conducted involving adjacent residents, property owners, interested parties, Planning staff, and the Adam Blucher Development Corporation with the objective of preparing a development concept for the redevelopment site to address compatibility between the subject lands and adjacent land uses." 6. CRPS-04-007 ENVIRONMENTAL COMMITTEE COMMENTS RE: DTS-03-211 - MASTER STORMWATER MANAGEMENT POLICY 2003 ANNUAL AUDIT The Committee was in receipt of Corporate Services Department report CRPS-04-007, dated DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES JANUARY 19~ 2004 6. - 11- CITY OF KITCHENER CRPS-04-007 ENVIRONMENTAL COMMITTEE COMMENTS RE: (CONT'D) January 9, 2004 regarding the Environmental Advisory Committee's comments on the Master Stormwater Management Policy - 2003 Annual Audit. Councillor B. Vrbanovic advised that the Environmental Advisory Committee has reviewed the Master Stormwater Management Policy - 2003 Annual Audit report attached to DTS-03-211 and have endorsed the report and the recommendations being made to the Committee this date. DTS-03-211 MASTER STORMWATER MANAGEMENT POLICY ANNUAL AUDIT REPORT 2003 The Committee considered Development and Technical Services Department report DTS-03-211 and the attached Executive Summary for the 2003 Annual Audit report with respect to the Master Stormwater Management Policy. It was noted that the Master Stormwater Management Policy requires an annual audit of the City's stormwater management plan. Ms. Carrie Curtis, Totten Simms Hubicki, attended and provided a presentation on the 2003 Annual Audit report with respect to the stormwater management plan. Ms. Curtis reviewed the objectives of the plan, overview of the plan, the audit report outline, overview of the audit and the recommended approaches for 2004. Ms. Curtis presented the revised priority lists with respect to stormwater management projects including new ponds, retro-fitting existing ponds, installation of oil / grit separators and stream system restorations. Ms. Curtis concluded her presentation outlining the recommendations contained in the audit which included the original recommendations from the Master Stormwater Management Policy of December 2001, a stormwater management charge for all sites less than 0.1 hectares, a proposed 2004 monitoring plan to be carried out and developing a ranking system for creeks. Councillor M. Galloway pointed out that the Master Stormwater Management Policy does not address regular maintenance of existing sites and facilities and asked when this could be implemented. Ms. Curtis advised that regular maintenance was not part of the annual audit report but that her company has been requested to implement standard reporting features regarding this matter which should be completed in the first half of 2004. Councillor G. Lorentz raised a concern regarding the problem with the amount of rainwater entering the system which in the past has caused flooding and asked if any results have been formulated on the infiltration and inflow studies which have taken place. R. Shamess responded that staff would be having a public consultation to provide the results of those studies and recommended changes with respect to infiltration and inflow including re-trenching and re-lining of stream systems. Councillor Lorentz requested that staff notify members of Council when the public consultation is to take place. Councillor B. Vrbanovic raised a concern regarding the depth in some of the stormwater management ponds and the possible safety issue due to the fact that many of the ponds are open and accessible to children. He requested that staff report back on this matter. On motion by Councillor G. Lorentz - it was resolved: .... That the Executive Summary attached to Report DTS-03-211, for the 2003 Annual Audit Report for the period November 2002 - October 2003, which has been prepared to indicate that the stormwater management (SWM) facilities being provided meet the volume of stormwater resulting from infill/redevelopment sites be received for information; and, That the actions for the original recommendations, from the Master Stormwater Management Policy - Dec 2001, as outlined in Section 5 of the Executive Summary, which have been updated accordingly be endorsed; and, That the additional recommendations, as outlined in Section 6.0 of the Executive Summary be approved and be incorporated as part of the Annual Audit included in DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES JANUARY 19~ 2004 7. DTS-03-211 - 12- CITY OF KITCHENER MASTER STORMWATER MANAGEMENT POLICY (CONT'D) subsequent reports; and, That the services of Totten Simms Hubicki be retained to undertake the Annual Audit review and Creek Monitoring for the years 2004 - 2006 for an upset limit of $19,990 per year, respectively, as per recommendations 10, 11 and 12 of the Master Stormwater Management Policy, and in the event that additional funding is provided for this work, staff be authorized to extend the work program and purchase orders accordingly; and further, That Report DTS-03-211 be forwarded to the GRCA, Region of Waterloo and any other applicable agencies for their information." 8. CNL-04-001 DOON VILLAGE ROAD TRAFFIC STUDY The Committee considered Council report 04-01 dated January 14, 2004 submitted by Councillor M. Galloway recommending that the Transportation Planning division review the survey results from the area residents of the Doon Village Road and prepare a traffic study report. Councillor M. Galloway advised that the Doon Village Road diversion was completed in mid- November and since that time he has received comments from the area residents regarding the removal of the existing one-way restriction on Doon Village Road. In December 2003 he sent a questionnaire to the area residents which have been returned and the results have been compiled and he recommended that the results be referred to transportation staff for a traffic report. Councillor J. Gazzola raised a concern regarding the timing of the traffic survey, noting that the previous Council had directed staff to wait for a period of time in order to allow traffic patterns to emerge following the construction of the diversion road. Councillor Gazzola advised that written comments from Richard Haalboom dated January 19, 2004 on this issue have been received and circulated to members of the Committee. In response to questions from the Committee, J. McBride advised that the survey in question was sufficient for the purposes of completing a traffic report and he confirmed that it was staff's understanding that the original intent was to send out this survey in May or June 2004. Councillor Galloway reiterated that he believed that due to the number of comments he has received from the area residents, the timing for the survey sent out in December was appropriate and he requested that results be referred to staff. On motion by Councillor B. Vrbanovic - it was resolved: "That staff in the Transportation Planning division review the questionnaires returned from the Doon Village Road traffic study, for analysis; and, That in order to maintain the integrity of the survey, that results of the survey be broken down and analyzed separately for both Upper Doon Heritage District and Wyldwoods Community; and further, That based on the results of the analysis that staff prepare a report with their recommendations to be presented to the Development and Technical Services Committee on February 2, 2004." 8.
