RECOMMENDATION:
That Tender T16 -017 Forfar Park Wetland Retrofit and Kolb Creek Trail
Construction (Pond 6 to Rothsay Avenue), be awarded to TDI International Ag Inc.
dba Eco Blue Systems, Mono, Ontario at their adjusted tendered price of
$634,368.96, including provisional items and contingencies of $130,200.80, plus
H.S.T. of $82,467.97, for a total of $716,836.94.
BACKGROUND:
Kolb Creek is supported by a 455 ha watershed located entirely within the City of
Kitchener municipal boundaries. The watershed is predominantly urban in land use,
and is located in the northeastern section of the City. The creek was originally
constructed as a drain in 1944 when the watershed was mostly comprised of rural land
uses. Kolb Creek has been identified as having the potential to support cold water fish
habitat.
In 2013, the City retained consulting services to complete the Kolb Creek Schedule `B'
Class Environmental Assessment (EA) (Aquafor Beech, 2013) to address flooding and
erosion issues within the study area. The preferred alternative resulting from the EA
involves detailed design and construction of an overflow sewer along Rothsay Avenue
and a wetland retrofit within Forfar Park (Pond 6) to improve the quality of water
entering into Kolb Creek.

The project is being completed in two phases. Phase I, involving the design and
construction of the overflow sewer along Rothsay Avenue, has already been completed.
This contract is for Phase II including design and construction of the wetland retrofit of
Pond 6 within Forfar Park and the design and construction of a multi -use trail in
accordance with the recommendations of the City of Kitchener Multi —use Pathways and
Trails Master Plan, final Report (May 2012).
Upon Council award, construction is anticipated to begin in early April 2016 and be
completed in October 2016.
REPORT:
Tenders were advertised publicly in the Daily Commercial News, on the City of
Kitchener website and the internet through the Ontario Public Buyers Electronic
Tendering Information System. Documents were picked up by ten (10) interested
parties and by the closing date of Thursday March 3, 2016, nine (9) tenders had been
received.
The tenders were reviewed by E. Hinton, Aecom, the City's Consultant for the project
and M. Wilson, Project Manager, Stormwater Utility who concur with the above
recommendation.

The recommendation of this report supports the achievement of the city's strategic
vision through the delivery of core service.

FINANCIAL IMPLICATIONS:
In addition to the costs anticipated in this tender, the design and implementation of
these types of projects typically involves city staff and resources from across the
corporation. These costs are included in the line item "Projected Costs: Staff
Time /Permitting /Material testing ", and will be itemized when they exceed $125,000.
Included in this line item are staff time and expenses for all city staff in support of the
project such as Engineering, Kitchener Utilities, and Transportation Planning. The line
item also includes all regulatory permitting, geotechnical and material testing,
detouring and traffic control, alternate access and parking requirements and any other
miscellaneous costs. Projects utilizing in -house staff will include costs for inspection
during construction and contract administration.
The net cost for this tender (A), is fair and reasonable for a purchase of this scope and
the upset limit is within the budget allowance (B) provided within the budget. Funding
for this purchase is included within the approved capital budget. The estimated
surplus (E) will be returned to the contributing funding sources of this project upon
completion of work.
