HomeMy WebLinkAboutFCS-16-056 - Encroachment Agreement Request -bus Shelters on City Land at Various LocationStaff Report rR finance and Corporate Services Department www.kitchener.ca REPORT TO: Committee of the Whole DATE OF MEETING: March 21, 2016 SUBMITTED BY: Erin Mogck, Associate City Solicitor, 519 - 741 -2200 x7060 PREPARED BY: Erin Mogck, Associate City Solicitor, 519 - 741 -2200 x7060 WARD(S) INVOLVED: Ward 9 DATE OF REPORT: March 16, 2016 REPORT NO.: FCS -16 -056 SUBJECT: ENCROACHMENT AGREEMENT REQUEST— BUS SHELTERS ON CITY LAND AT VARIOUS LOCATIONS RECOMMENDATION: "That the Mayor and Clerk be authorized to execute an Encroachment Agreement with The Regional Municipality of Waterloo to authorize the installation of three bus shelters requiring a surface area of 2m x 6m, more or less, over City of Kitchener land at the following locations: Duke Street West and Young Street, Charles Street East and Pandora Avenue South, Courtland Avenue East and Borden Avenue South, said agreement to be to the satisfaction of the City Solicitor." BACKGROUND: The Regional Municipality of Waterloo assumed the responsibility for the operation of the Kitchener Transit System as of January 1, 2000. Since then, Grand River Transit (GRT), as an entity of The Regional Municipality of Waterloo, has operated the transit system. The current ION Light Rail Transit (LRT) project is ongoing throughout the Region of Waterloo. Grandlinq is a private company that has entered into a public - private partnership with The Regional Municipality of Waterloo (the "Region ") to construct, operate, and maintain the LRT project, which includes transit infrastructure. REPORT: As part of the ION project, Grandlinq is currently constructing new GRT infrastructure, including bus shelters at a number of locations in the City of Kitchener. Three new bus shelters will be located directly on land owned by The Corporation of the City of Kitchener (the "City "). In each location, the bus shelter, and its associated signs and benches, will be placed on City land beyond the road allowance. * ** This information is available in accessible formats upon request. * ** Please call 519- 741 -2345 or TTY 1- 866 - 969 -9994 for assistance. 6 -1 In order to meet construction deadlines Grandlinq has requested that the Region secure the right to install these shelters by March 31, 2016. Grandlinq, or a subcontractor, would install these new GRT shelters at a later date in 2016 following a 3 -4 month procurement process. Following construction, each shelter would be owned, operated and maintained by the Region (or a Regional subcontractor). The bus shelters will be on City -owned land at the following locations: • Duke Street West and Young Street, behind City Hall at 200 King Street West (GRT stop #071); • Charles Street East and Pandora Avenue South near Cameron Heights Collegiate Institute, municipal address 104 Stirling Avenue South (GRT stop #087); • Courtland Avenue East and Borden Avenue South at 406 Courtland Ave. E., which was an older hydro substation site (GRT stop #098). Duke Street West and Young Street: Regional and City staff have collaborated in reviewing the bus shelter locations to ensure they are compatible with future plans. For instance, the bus shelter proposed for the Duke Street West and Young Street location will be behind City Hall at 200 King Street West. The City will redesign the outdoor space as part of the City Hall Outdoor Spaces Master Plan, and when the plans for the streetscape are developed in more detail, the Region and the GRT will work together to develop a concept to integrate the shelter into the streetscape. One option may be an overhead canopy structure. A drawing of this location is attached as Appendix A. Charles Street East and Pandora Avenue: The Charles and Pandora bus shelter (GRT stop #087) would serve Cameron Heights Collegiate Institute, a secondary school as well as other nearby locations. It is possible that an expanded waiting area with improved amenities would be developed later in 2017 or 2018. GRT will explore the possibility of constructing an expanded concrete waiting area around the shelter and the parties will consider the provision of seating around the expanded waiting area, such as armor stone or concrete slab seating. City staff has identified a light standard is in the vicinity of the proposed bus shelter at Charles and Pandora, as well as a storm sewer of 21 00m diameter and a gas main. The encroachment agreement will address the cautionary measures required for the installation near these structures. A drawing of this location is attached as Appendix B. Courtland Avenue East and Borden Avenue South: At the Courtland and Borden site, an older hydro substation is an existing structure. The Courtland bus shelter would be part of a new stop on a new GRT iXpress route that would be implemented to connect West Kitchener to the Borden ION light rail station via Ottawa Street, Courtland Avenue and Borden Avenue. City staff has identified a water service and a new 200mm polyethylene gas main nearby the Courtland and Borden site. Furthermore, Kitchener - Wilmot Hydro has identified the nearby location of an underground pull -box. The bus shelter will be installed to reflect these underlying structures. A drawing of this location is attached as Appendix C. 6 -2 ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: The recommendation of this report supports the achievement of the City's strategic vision through the delivery of core services. FINANCIAL IMPLICATIONS: The application fee of $269 is to be paid in accordance with the City's fee schedule. The processing fee of $230 is also expected to be received in accordance with the City's fee schedule. COMMUNITY ENGAGEMENT: INFORM — This report has been posted to the city's website with the agenda in advance of the Council meeting. CONSULT - Internal staff and outside utility companies have been circulated for their comments and /or approval. Regional staff has meet with city staff on several occasions to discuss the particulars. CONCLUSION: Once authorized by City Council, an encroachment agreement will be executed.
