SUBJECT: ENCROACHMENT AGREEMENT REQUEST — ROGERS VAULT
ENCROACHMENT ON CITY LAND AT KING STREET EAST AND
BENTON STREET
RECOMMENDATION:
"That, subject to obtaining all necessary approvals, the Mayor and Clerk be authorized to
execute an Encroachment Agreement with Rogers Communications Inc. for a flush -to-
grade vault located on City land at 69 King Street East near the corner of Benton Street
and King Street East, said agreement to be to the satisfactory of the City Solicitor."
BACKGROUND:
Rogers Communications Inc. approached the City of Kitchener for permission to enter onto City
land at the corner of Benton Street and King Street East to upgrade an existing Atria GLB2436
vault with a new GLB3660 vault.
REPORT:
Rogers Communications Inc. would like to be authorized to encroach for the purposes of
installing an upgraded vault to provide service to customers. There are three vaults of a similar
type belonging to telecommunication companies in this location and Rogers Communications
Inc. would be replacing one vault that already exists.
The dimensions of the vault are 1.52m long by 0.91 m wide by 0.76m deep.
Through the encroachment circulation process, it was discovered that there is an existing
Allstream vault, but there is no objection from MTS Allstream as long as Rogers
Communications Inc. maintains a standard clearance of 0.6m horizontal, 0.3m vertical and hand
trench within 1.0m. Rogers Communications Inc. has confirmed that they will be hand digging
within 1.0m of all existing underground services.

Furthermore, please find a drawing in Appendix A illustrating the location of the proposed
connections.
ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN:
The recommendation of this report supports the achievement of the City's strategic vision
through the delivery of core services.
FINANCIAL IMPLICATIONS:
The application fee of $269 has been paid in accordance with the City's fee schedule. An
additional $230 processing fee is payable once authorized by Council, and it is expected to be
received in accordance with the City's fee schedule.
COMMUNITY ENGAGEMENT:
INFORM — This report has been posted to the city's website with the agenda in advance of the
Council meeting.
CONSULT - Internal staff and outside utility companies have been circulated for their comments
and /or approval.
CONCLUSION:
Once support for authorizing the installment the vault has been received from Council, it will be
in order to authorize the execution of an encroachment agreement with Rogers
Communications Inc.
