SUBJECT: REQUEST FOR FIREWORKS VENDORS SALE DATES
EXTENSION JULY 2016

RECOMMENDATION:
That permission be granted to extend the sale of fireworks at all licensed Fireworks
Vendor locations in The City of Kitchener to July 2, 2016.
BACKGROUND:
The City of Kitchener Municipal Code Chapter 544 - Fireworks Vendors requires that a business
licence be obtained for any vendor of fireworks within the City. Municipal Code Chapter 739-
Fireworks and Firecrackers restricts the sale of fireworks in the City to the 6 business days
immediately preceding Canada Day and Victoria Day each year for those vendors.The
licensing process coordinates the requirement to have a fireworks vendor licence with the sale
date restrictions.
REPORT:
Asubmission has been received from a current Fireworks Vendor requesting permission to

extend the sale of fireworks within The City of Kitchener until July 2 2016. The request for this
extension is because Canada Day falls on a Friday this year and the vendor would like to be
able to sell their fireworks to the public who may wish to hold their displays on Saturday, July 2
instead of Canada Day as permitted within Chapter 739. The requested sale period connected
to Canada Day would therefore be June 26 to July 2 2016 (7 days total). In order to provide an
equal opportunity to all licensed Fireworks Vendors it is being recommended that permission for
this extension be granted to all vendors who obtain a business licence to sell fireworks.There
are approximately twenty vendors that are licensed annually.
Since the by-law does not currently permit sales after Canada Day,
required to allow for an extension. A similar request was granted by Council in 2006 and 2011.
As part of the Comprehensive Business Licensing Review, staff will be reviewing bylaws such
as the Fireworks Vendor for consistent language and practices.

FINANCIAL IMPLICATIONS:
The business licensing fee is $517.00 for a Fireworks Vendor that does not have a
licensed permanent place of business and is $217.00 for a new vendor / $59.00 for a
renewal vendor when the vendor has an established place of business (e.g.,
convenience store which adds the sale of fireworks).
COMMUNITY ENGAGEMENT:
Inform
of the council / committee meeting.
Consult
The Kitchener Fire Department, Bylaw Enforcement, Legal Services and the
Pyrotechnics/Fireworks, Explosives Safety and Security Branch for Natural Resources Canada
have been consulted regarding the request and have no objections to the sale extension.
