MAY 2, 2016 CITY OF KITCHENER
A special meeting of City Council was held at 12:02 p.m. this date, chaired by Mayor B. Vrbanovic
with all members present except Councillors Y. Fernandes, S. Marsh and P. Singh. Councillor D.
Schnider was in attendance for part of the meeting.
Notice of this meeting had been previously given to all members of Council by the City Clerk pursuant
to Chapter 25 (Council Procedure) of the Municipal Code.
INS -16 -045 — LEGAL AGREEMENT WITH MTO — SHIRLEY AVENUE EXTENSION
Council considered Infrastructure Services Department report INS -16 -045 (S. Allen), dated April 26,
2016, regarding agreements pertaining to the extension of Shirley Avenue by the Ministry of
Transportation (MTO) as part of the construction of Highway 7.
Moved by Councillor B. loannidis
Seconded by Councillor F. Etherington
"That the Chief Administrative Officer or a Deputy Chief Administrative Officer be authorized to
execute an agreement regarding the extension of Shirley Avenue and any other Agreements
or ancillary documents with the Ministry of Transportation (MTO) related to the construction of
Highway 7, provided that where there are any costs to be incurred by the City, the costs are
within approved budgets; any agreements or ancillary documents are to be to the satisfaction
of the City Solicitor."
Carried.
IN- CAMERA MEETING AUTHORIZATION
Councillor D. Schnider entered the meeting at this time.
Responding to questions as to why the subject matter was proposed to be discussed in- camera, Ms. L.
MacDonald, Director of Legal Services & City Solicitor, indicated that as it pertains to ongoing
negotiations which may have implications for future litigation, it is permitted to be discussed at a closed
meeting in accordance with Section 239 of the Municipal Act.

Seconded by Councillor S. Davey
"That an in- camera meeting of City Council be held immediately following this special meeting to
consider a person matter and a litigation / potential litigation matter which is also subject to
solicitor - client privilege."

The meeting then recessed at 12:05 p.m. and re- convened at 4:29 p.m., chaired by Mayor B.
Vrbanovic with all members present except Councillor P. Singh.
FCS -16 -071 — REQUEST TO OPERATE HOT DOG CART DURING ANNUAL COMMUNITY
GARAGE SALE
Council considered a recommendation arising from the Finance and Corporate Services Committee
meeting held earlier this date regarding a request to operate a hot dog cart during an annual
community garage sale event.
Moved by Councillor S. Davey
Seconded by Councillor S. Marsh
"That permission be granted to Mr. Les Halat to operate a hot dog cart at 273 Stoke Drive and
112 Wexford Crescent during the annual Community Garage Sale on May 7, 2016, provided
the necessary Special Event licence is obtained by the applicant including Waterloo Regional
Health approval and a valid Propane Fitter Inspection report."

"That leave be given the Mover and Seconder to introduce the following by-laws for three
readings and that the same be taken as read a first, second and third times, be finally passed and
numbered serially by the Clerk.
a. Being a by-law to exempt certain lots from Part Lot Control — Part of Blocks 2 and 3,
Registered Plan 58M-561 — 1 Adam Street
(By-law No. 2016-047)
b. To confirm all actions and proceedings of the Council.
(By-law No. 2016-048)."
