Pursuant to Chapter 25 (Procedure) of the Municipal Code, a motion was brought forward by

Councillor J. Gazzola to discuss Consent items 3 & 4, which was voted on and was
CSD-16-021 - NOISE EXEMPTION REQUEST - CANADIAN CANCER SOCIETY - RELAY
1.
FOR LIFE
The Committee considered Community Services Department report CSD-16-021, dated April
13, 2016 recommending approval of noise exemption for the Canadian Cancer Society,
Waterloo Region Unit, for their Relay For Life event at Resurrection High School.
On motion by Councillor B. Ioannidis -
it was resolved:
That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be
granted to the Canadian Cancer Society, Waterloo Region Unit, for their Relay For Life
Event at Resurrection High School between the hours of 7 a.m. on June 10, and 12
p.m. on June 11, 2016, as outlined in Community Services Department report CSD-16-
021.
INS-16-043 - ON-STREET NO STOPPING REGULATIONS - ASKIN PLACE
2.
The Committee considered Infrastructure Services Department report INS-16-043, dated April 7,
2016 recommending various stopping prohibitions on Askin Place.
On motion by Councillor B. Ioannidis -
it was resolved:
That the Uniform Traffic By-law be amended to prohibit stopping anytime on both sides
of Askin Place from Bradley Drive to a point 15 metres west thereof; and further,
That stopping be prohibited from 8:00 a.m. to 9:30 a.m. and 2:30 p.m. to 4:30 p.m.
Monday to Friday from September 1 to June 30 on the north side (odd-numbered side)
of Askin Place from 15 metres west of Bradley Drive to a point 95 metres west thereof,
as outlined in Infrastructure Services Department report INS-16-043.
INS-16-040 - REGION OF WATERLOO & CITY OF WATERLOO DRINKING WATER 2015

SUMMARY
The Committee considered Infrastructure Services Department report INS-16-040, dated April 19,
2016 recommending receipt of the 2015 Region of Waterloo Annual Water Quality Reports and
the 2015 City of Waterloo Drinking Water Summary Report as required by the Safe Drinking
Water Act. Ms. C. Fletcher was in attendance and responded to questions from the Committee.

INS-16-040 - REGION OF WATERLOO & CITY OF WATERLOO DRINKING WATER 2015

SUMMARY
On motion by Councillor B. Ioannidis -
it was resolved:
That the 2015 Region of Waterloo Annual Water Quality Reports (Greenbrook Water
Supply System, K34 Water Supply System, Mannheim Water Treatment Plant and
Pumping Station, Parkway Water Supply System, Strange St. Water Supply System
by O. Reg 170/03 Schedule 22 of the Safe Drinking Water Act; and further,
That the 2015 City of Waterloo Drinking Water Summary Report be received for
information as required by O. Reg 170/03 Schedule 22 of the Safe Drinking Water Act,
as outlined in Infrastructure Services Department report INS-16-040.
CSD-16-025 - CHICOPEE SKI CLUB - SNOW SCHOOL AND RACING PROGRAM

AFFILIATION
The Committee considered Community Services Department report CSD-16-025, dated April 7,
2016 recommending the Chicopee Ski Club Snow School and Racing Program be approved as
an affiliated minor sport group and added as an insured group. Mr. B. Cheyne was in attendance
and responded to questions from the Committee.
On motion by Councillor B. Ioannidis -
it was resolved:
That the Chicopee Ski Club Snow School and Racing Program be approved as an
affiliated minor sport group with the City of Kitchener, as per the City's Minor Sport
Affiliation policy; and further,
That the Chicopee Ski Club Snow School and Racing Program be added as an insured
outlined in Community Services Department report CSD-16-025.
CSD-16-018 - NOISE EXEMPTION - DOWNTOWN SPECIAL EVENTS

The Committee considered Community Services Department report CSD-16-018, dated April 14,
2016 recommending approval of a noise exemption for various Downtown Special Events.
On motion by Councillor B. Ioannidis -
it was resolved:
That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be

CSD-16-017 - NOISE EXEMPTION REQUEST - EVER AFTER MUSIC FEST - BINGEMANS

The Committee considered Community Services Department report CSD-16-017, dated April 14,
2016 recommending approval of a noise exemption for Ever After Music Fest, to be held at
th
Bingemans Center on June 3, 4, and 5, 2016, between 11:00 a.m. and 11:00 p.m. each day. In
addition, the Committee considered the staff recommendation referred to this date, outlined in
Finance and Corporate Services Department report FCS-16-060 related to approval of a Midway
at the Ever After Music Festival. Ms. G. MacNeil, Ms. J. Sheyer and Mr. J. Young were in
attendance to respond to questions from the Committee.
Mr. R. Mattacchione, Ever After Music Fest, addressed the Committee in support of the
recommendations as outlined in the staff reports. He indicated following the 2015 event, the
organizers reviewed the concerns arising from the Music Festival in 2015 and provided an
overview of the changes proposed for 2016 to mitigate any potential noise complaints. He noted
one of the major changes for 2016 included re-orienting the stage to the opposite direction of its
placement in 2015 to ensure the sound is not directed towards a residential area.

Councillor Y. Fernandes entered the meeting at this time.
Questions were raised regarding the possibility of reducing noise levels on Sunday June 5, 2016
at 9:30 p.m. Mr. Mattacchione advised the final headliner act has already been booked to perform
on Sunday at 9:30 p.m. and it would be impossible to accommodate a reduction in the sound
levels for the closing act.
Mayor B. Vrbanovic questioned what type of regulation, if any would Council have with regards
to the event. Ms. J. Sheryer advised that Council does have the ability to regulate the conditions
p.m. on the Sunday, any noise generated by the Festival would be referred for enforcement and
subject to ticketing. She further advised as a secondary option, Council could advise the event
organizers that a noise exemption would not be permitted past 9:30 p.m. on Sunday for future
events, so the organizers could in future plan accordingly.
In response to questions regarding a reactive noise mitigation plan, Ms. G. MacNeil advised that
staff have recommended hiring a paid-duty Noise Officer, paid for solely by the event organizers
to help identify when noise levels are exceeding the permitted decibel levels.
Questions were raised regarding what impacts there may be for other special events if the noise
exemption was restricted to 9:30 p.m. Mr. J. Young advised there are a number of other events
that may be adversely impacted by the noise restriction as their festival/event may fall on a
Sunday, noting Canada Day/Eve occasionally falls on Sundays, creating possible
precedence.
A motion was brought forward by Councillor S. Davey to refer consideration of the noise
exemption request and approval of the Midway to the May 16, 2016 Council meeting, to allow
staff an opportunity to further dialogue with the event organizer on a reactive response model
with regards to noise mitigation, with consideration being given to ending the noise exemption
at 9:30 p.m. on Sunday.

The following motion was voted on and was on a recorded vote, with Mayor B.
Vrbanovic and Councillors D. Schnider, K. Galloway-Sealock, F. Etherington, Z. Janecki, J.
Gazzola, B. Ioannidis, S. Davey and S. Marsh voting in favour; and, Councillor Y. Fernandes
voting in opposition. Councillor P. Singh was absent and accordingly did not vote.
On motion by Councillor S. Davey -
it was resolved:
be referred to the May 16, 2016
That consideration of the following recommendation,
Council meeting
to allow for further consultation with event organizers regarding a
reactive response to noise mitigation with, consideration being given to ending the noise
exemption at 9:30 p.m. on Sunday:
be granted for the Ever After Music Fest, to be held at Bingemans Center on June 3,
4 and 5th, 2016, between the hours of 11 a.m. and 11:00 a.m., each day,as
outlined in Community Services Department report CSD-16-017. This exemption is
subject to the following conditions, which, if not complied with, will render the noise
exemption null and void:
a) There shall be no offensive language, in the opinion of City staff, generated
from this music festival, audible in any adjacent residential neighbourhood;
b) The event organizers will ensure that there is an on-site contact person
accessible to correspond with City staff at all times during the event;
c) The event organizers agree to respond accordingly to requests from City
staff, during the event, in order to address community concerns that may
arise with regard to the impact of noise heard within adjacent residential
areas;

d) The event organizer will be responsible for the cost of a paid-duty Noise
Officer, to be assigned specifically to this event which shall be paid in full prior
to the Council date of May 16, 2016; and,
e) The maximum decibel level (dba) audible at a point measured at 100 meters
in direct line of sight from the music source, shall not exceed 65 dba.

That Ever After Music Festival be granted permission to operate a Midway at 425
Bingemans Centre Drive from June 3 to June 5, 2016 subject to the following:

and Region of Waterloo Public Health be obtained prior to operating the Midway for
June 3 to June 5, 2016, as outlined in Finance and Corporate Services Department
report FCS-16-060
.
CSD-16-023 - POTENTIAL 2021 CANADA GAMES BID

The Committee considered Community Services Department report CSD-16-023, dated April 7,
2016 recommending endorsement for
of a regional bid for the 2021 Canada Summer Games and submission of a Letter of Intent to bid.
Mr. B. Cheyne was in attendance and responded to questions from the Committee.
Ms. S. Doiron, Regional Sport Tourism Office (RSTO), presented the report, advising that the
RSTO office is requesting support from the City of Kitchener to submit a Letter of Intent to host
the 2021 Canada Games. She noted the RSTO has already addressed the cities of Guelph,
Cambridge and Waterloo and have received their endorsement. She noted it is their intention to
submit a regional bid with all four cities expressing support. She indicated without submitting the
initial Letter of Intent, the Region would have no possibility of being considered as the hosting
location and an opportunity such as this would not be afforded to an Ontario city again for
possibly another 20 to 25 years. She further advised submitting the Letter of Intent and
participating in Phase I of the selection process does not bind the City to future phases, or to
submit a formal bid to host the Games.
Questions were raised regarding potential costs associated with hosting the Games, Ms. Doiron
advised those costs would not be forecasted until Phase II of the bidding process. She agreed to
provide Council with the economic impact study for Sherbrooke, Quebec to provide an example
of the costs associated with the Games, including the economic benefit from hosting the Games.
On motion by Councillor B. Ioannidis -
it was resolved:
That City of Kitchener endorse
investigation of a regional bid for the 2021 Canada Summer Games and submission of
a Letter of Intent to bid, as outlined in Community Services Department report CSD-16-
023.
