SUBJECT: Amendments to Chapter 820 of the Municipal Code (Construction
Vehicles)

RECOMMENDATION:
That a by-law be enacted to amend Chapter 820 (Construction Vehicles) of The City of
Kitchener Municipal Code to ensure that owners and occupants of property, and owners and
drivers of vehicles are responsible for ensuring that soil or other landscaping material is not
spilled or tracked onto highways in the City, and to allow the City to clean up such materials at
the expense of the owner of the property from which the material is tracked; and,
That the by-law be taken as having received first and second reading and referred for third
reading this date; and further,
That the Council approved fees for Street Sweeping (Infrastructure Services, Operations) be
applied effective immediately, for road clean-ups when soil or other landscaping material is
spilled or tracked onto highways in the City, as outlined in Finance and Corporate Services
Department report FCS-16-086.
BACKGROUND:
The City has experienced an increase in complaints of soil and other landscaping materials
being tracked on to City streets. Mud and dust from the debris creates a nuisance for
pedestrians, vehicles and neighbouring properties.
REPORT:
The amendments will place responsibilities on to owners and occupants of properties as well as
on to owners and drivers of vehicles to ensure their loads are secure and that vehicles do not
track mud and debris on to City highways.

The amendments will also allow the City to recover costs of necessary clean ups from owners of
the property where the soil or debris comes from, and to recover such charges by placing them
on the tax roll for the property.
The City will seek set fine approval under this by-law.
ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN:
The aforementioned amendments support the City’s strategic priorities of safe and thriving
neighbourhoods and of efficient and effective City services.
FINANCIAL IMPLICATIONS:
These amendments will allow the City to recover costs of road clean ups. The 2016 Council
approved fees for street sweeping are as follows:
regular hours- minimum charge $272.70
overtime hours – minimum charge $324.90
double-time hours – minimum charge $382.85
CONCLUSION:
The proposed amendments to Chapter 820 (Construction Vehicles) will allow staff to more
effectively address complaints and to recover street cleaning costs caused by by-law violations.
