SUBJECT: Noise Exemption Extension Highways 8 and 401, Ministry of
Transportation, Ontario (MTO)

RECOMMENDATION:
That the previously approved noise exemption, through report INS-14-098,
exempting the Ministry of Transportation, Ontario (MTO) and its contractor(s)
from the provisions of Chapter 450 of the Municipal Code Article 6 Construction
Work for the widening of Highways 401 and 8 (MTO Contract Number 2014-3014),
be extended until July 31, 2019. The request for the noise by-law exemption is
between the hours of 7:00 p.m. and 7:00 a.m. for the period April 1, 2016 to July
31,2019.
BACKGROUND:
At its meeting on December 8, 2014, the Community and Infrastructure Services
Committee approved a noise exemption request through report INS-14-098 per the
following resolution:
That the Ministry of Transportation, Ontario (MTO) and its contractor(s) be exempt from
the provisions of Article 6 (Construction Work) of the City of Kitchener Municipal Code
Chapter 450 (Noise) for the Highway 401 reconstruction and widening project, reference
WP 4-00-00, between the hours of 7:00 pm and 7:00 am from April 1, 2015 to April 1,
2016.
This request was originally requested until November 30, 2018, however the Committee
only approved the first year of this noise exemption request until April 1, 2016.
This report serves to request an extension to this noise exemption.

REPORT:
The Ministry of Transportation, Ontario (MTO) has been executing the highway
widening project for Highway 401 between Highways 8 and 24. This project, MTO
Contract Number 2014-3014, commenced in April, 2015. At that time, the City of
Kitchener approved a noise exemption for this project until April 1, 2016.
The MTO has advised that limited night work remains within the City of Kitchener,
including:
Traffic control activities on Highways 401 and 8
Installation and maintenance of highway signage
Highway and Regional lane closures within permitted times (outside of rush
hours)
Traffic painting.
The totality of night work within the City of Kitchener that remains for this project is
limited to traffic control changes through the remaining stages of the project. This
involves traffic lane shifts through barrels and signage, estimated to occur for short 2-3
day periods approximately ten (10) times over the remaining three (3) years of the
contract.
Noise expected to be generated is limited to these low impact operations outlined above
which will result in minimal to no noise impact. The nearest residential property to this
highway work is separated approximately 400 metres from the work area. Noise
impacts on this residential area are expected to be none.
The MTO will be advising the public of this night work through highway signage.
ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN:
This recommendation of this report supports the achievement of the c
vision through the delivery of core service.
FINANCIAL IMPLICATIONS:
None.
COMMUNICATIONS:
The MTO will be posting an advisory of night work operations on highway signs, in
advance of each construction stage that will require the required night work.
