SUBJECT: NOISE EXEMPTION REQUEST KOI FEST AT THE PARKING LOT

RECOMMENDATION:
That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code
be granted for KOI Festival at the Parking Lot, to be held at the Centre in the

Square on June 25, 2015, between the hours of 8:00 AM and 10:30 PM. This
exemption is subject to the following conditions, which, if not complied with, will
render the noise exemption null and void:
a) There shall be no offensive language, in the opinion of City staff, generated
from this music festival, audible in any adjacent residential neighbourhood.
The event organizers will ensure that there is an on-site contact person
accessible to correspond with City staff at all times during the event;
b) The event organizer will be responsible for the cost of a pay-duty Noise
Officer, to be assigned specifically to this event;
c) The event organizers agree to respond accordingly to requests from City
staff, during the event, in order to address community concerns that may
arise with regard to the impact of noise heard within adjacent residential
areas; and
d) The maximum decibel level (dba) audible from a residential area shall not
exceed 65 dba.

KOI Fest in the Parking Lot will be held at Centre in the Square on June25,2016.
This event is an outdoor live music concert. As such, the event requires an exemption

REPORT:
This is the first time that Centre in the Square has partnered with KOI and will be
holding the event outdoors at the Centre in the Square and in the outdoor area along
Otto St. The event organizers have indicated the potential attendance to be a maximum
of 4,000 people. Staff have been working with event organizers and they will be
developing a notice that will be circulated to residents that live in the surrounding
neighborhood, this will ensure that all affected residential areas in close proximity to the
Centre in the Square are well informed in advance of the event.
The noise exemption is proposed to take effect starting at 8AM, in order to cover the
period in which sound checks may take place on the Saturday morning.

The performing entertainers will begin at noon on Saturday June 25, 2016.There will
be two stages, one large stage which will be located in the Centre in the Square parking
lot pointed west at the Regional building. The second stage will be smaller and will be
located at the Centre in the Square main entrance, it will be pointed in the direction of
the Church of Good Sheppard, which is located at the corner of Queen St N and
Margaret Ave. The smaller stage will be free of charge to the public and will consist of
bands that will play for a half hour in length and the acts on this stage will be completed
by 5pm.
It should be noted that weather conditions can play a role with regard to sound
dispersion. At this point it is difficult to predict the impact of weather during the event,
however it will be closely monitored during the event.
Staff and the event organizers will conduct sound testing the morning of the event to
ensure that the equipment is set to produce the appropriate output to be able to conform
to the prescribed dba level.
The By-law Enforcement Division will be assigning a Noise Officer to monitor this event.
The event organizers will ensure that there is an on-site contact available during the
event who will be available to By-law Enforcement staff, if required, to address any
concerns raised.
