MINUTES OF THE REGULAR MEETING HELD MAY 17, 2016
MEMBERS PRESENT:

Mr. D. Cybalski, Chair, called this meeting to order at 10:14 a.m.
This meeting of the Committee of Adjustment sitting as a Standing Committee of City Council was
called to consider one application regarding a variance to the City of Kitchener Sign By-law. The
Committee will not make a decision on this application but rather will make recommendations which
will be forwarded to the Committee of the Whole and Council for final decisions.
The Chair explained that the Committee's decisions with respect to sign variances are
recommendations to City Council and not a final decision. He advised that the Committee's
recommendation will be forwarded to City Council on Monday, June 6, 2016 at 7:00 p.m., and the
applicant may register with the City Clerk to appear at the meeting if desired.

The Committee was advised the applicant is requesting permission to install a ground-
supported non-accessory third party sign which will advertise tenants located at 386 Maple
Avenue, whereas the By-law does not permit non-accessory third party signs.
The Committee considered the report of the Planning Division, dated May 6, 2016, advising the
subject property is zoned General Industrial (M-2) and is designated General Industrial in the
Official Plan.
The applicant is requesting permission to erect a ground-supported sign containing non-
accessory copy. In addition to the business located on the subject property, the sign would
contain copy advertising third party businesses located at 386 Maple Ave. Non-accessory (or
third party) signs are defined as signs that contain copy that does not relate to the lot upon
which the sign is located.
The non-accessory businesses are located on a flag-shaped property (386 Maple Ave) that is
predominantly located behind the subject property (400 Maple Ave). As the non-accessory
businesses are on a lot that does not have sufficient frontage, they cannot construct a ground-
supported sign on their property. The third party copy on the proposed ground-supported sign
would provide better visibility to the public for the businesses.
The proposed sign will have a height of 3.7 metres, signage area of 1.56 sq.m. per side and a
setback of 0.4 metres from the lot line. The sign complies with all other regulations of the Sign
By-law.

Staff is of the opinion that the variance requested for the sign could be considered minor as the
third party copy relates to businesses located adjacent to 400 Maple Ave. It is desirable for any
business to have signage easily visible from the street. Except for the third party advertising,
the sign complies with all other regulations of the Sign By-law. It is noted that Fire Department
staff has no concerns with the proposed sign in terms of addressing for identification for
emergency services.
Based on the above comments, staff is of the opinion that the sign is minor, and meets the
general intent of the Sign By-law and is appropriate for the lot.
The Committee considered the report of the Region of Waterloo, Transportation Planner, dated
April 30, 2016, advising they have no concerns with this application.
Mr. G. Fitz-Henry was in attendance in support of the subject application and staff
recommendation.

That the application of 2378007 Ontario Inc. requesting permission to install a ground-supported
non-accessory third party sign advertising tenants located at 386 Maple Avenue; whereas the By-
law does not permit non-accessory third party signs, on Part Lot 117, Plan 666, being Parts 1 and
BE APPROVED
5 on Reference Plan 58R-13605, 400 Maple Avenue, Kitchener, Ontario, , subject
to the following condition:
1. That the owner shall obtain a sign permit from the Planning Division.
It is the opinion of this Committee that:
1. The variance approved in this application is minor in nature.
2. This application is desirable for the appropriate development of the property.
3. The general intent and purpose of Chapter 680 (Signs) of the City of Kitchener Municipal
Code is being maintained on the subject property.
