SUBJECT: Notice of Intention to Demolish
structure at 1255-1291 Fisher Hallman Road
RECOMMENDATION:
That in accordance with Section 27(3) of the Ontario Heritage Act, Council receive for
information the written Notice of Intention to Demolish the circa 1979 single detached
dwelling on the property municipally addressed as 1255-1291 Fisher Hallman Road.

BACKGROUND:
The Community Services Department is in receipt of Application for Demolition Control
Exemption DC16/009/F/CL (excerpt attached) in order to demolish the single detached dwelling
built circa 1979 on theproperty municipally addressed as 1255-1291Fisher Hallman Road.

Part IV, Section 27(3), of the Ontario Heritage Actprovides certain protections to properties

(3) If property included in the register under subsection (1.2) has not been designated under
section 29, the owner of the property shall not demolish or remove a building or
structure on the property or permit the demolition or removal of the building or structure
unless the owner gives the council of the municipality at least 60 days notice in writing
or remove the building or structure or to permit the
demolition or removal of the building or structure.
The Act also gives Council the powers to establish a Municipal Heritage Committee (MHC) to
advise and assist on heritage matters.Though there is no requirement under the Actfor Council
to consult its MHC when considering a Section 27(3) notice from a property owner, it would be
appropriate for the Committee to provide Council with a recommendation.
Per the Act, Council has 60 days from April 22, 2016 (date of receipt of the Application), to act, if
it so chooses, on this notice of intention to demolish.
Options
Under the Act, Council does not approve or refuse
demolish. options include:
1. Request further information;
2. Receive the notice of intention to demolish, allowing the notice period to run its course,
at the end of which the Building Division may issue a demolition permit as early as June
22, 2016 (as recommended in this report); or
3. Council may issue a Notice of Intention to Designate,at which point Council would have
the authority to deny demolition.
In this case, Option #2 is the recommended course of action, as the demolition will only affect a
non-heritage attribute, the single detached dwelling built circa 1979.
