Saunderson, Committee Administrator CSD-16-038 - NOISE EXEMPTION - BACKYARD WEDDING - PETRINA KNARR 1. The Committee considered Community Services Department report CSD-16-038, dated May 25, 2016 recommending approval of a noise exemption for Petrina Knarr for an outdoor wedding, located at 43 Nichole Crescent, between the hours of 2:00 p.m. and 11:00 p.m. on July 23, 2016. On motion by Councillor S. Davey - it was resolved: That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to Petrina Batten for an outdoor wedding at 43 Nichole Crescent between the hours of 2:00 p.m. and 11:00 p.m. on July 23, 2016, as outlined in Community Services Department report CSD-16-038. INS-16-052 - NOISE EXEMPTION - FORFAR PARK WETLAND RETROFIT AND KOLB 2. CREEK TRAIL CONSTRUCTION The Committee considered Infrastructure Services Department report CSD-16-052, dated May 27, 2016 recommending approval of a noise exemption for the City of Kitchener and its contractor(s) for construction work during the Forfar Park Wetland Retrofit and Kolb Creek Trail Construction Project between the hours of 7:00 p.m. and 7:00 a.m. for the period of July 2 to October 7, 2016. On motion by Councillor S. Davey - it was resolved: That the City of Kitchener and its contractor(s) be exempt from the provisions of Chapter 450 (Noise) of the City of Kitchener Municipal Code Article 6 Construction Work, during the Forfar Park Wetland Retrofit and Kolb Creek Trail Construction project, in the City of Kitchener, between the hours of 7:00 p.m. and 7:00 a.m. for the period July 2 to October 7, 2016, as outlined in Infrastructure Services Department report INS- 16-052. CSD-16-044 - NOISE EXEMPTION - 145 NEWBURY DRIVE 3. The Committee considered Community Services Department report CSD-16-044, dated May 30, 2016 recommending approval of a noise exemption for Carole and Dan Hunt for an outdoor wedding, located at 145 Newbury Drive, between the hours of 4:00 p.m. and 11:00 p.m. on August 13, 2016. On motion by Councillor S. Davey - it was resolved: COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE JUNE 13, 2016 - 28 - CITY OF KITCHENER CSD-16-044 - NOISE EXEMPTION - 145 NEWBURY DRIVE 3. That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to Carole and Dan Hunt for an outdoor wedding at 145 Newbury Drive between the hours of 4:00 p.m. and 11:00 p.m. on August 13, 2016, as outlined in Community Services Department report CSD-16-044. CSD-16-045 - NOISE EXEMPTION - 124 OTTAWA STREET SOUTH 4. The Committee considered Community Services Department report CSD-16-045, dated May 30, 2016 recommending approval of a noise exemption for Pat Lackenbauer for an outdoor street party, located at 124 Ottawa Street South, between the hours of 10:00 a.m. and 11:00 p.m. on July 28, 2016. On motion by Councillor S. Davey - it was resolved: That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to Pat Lackenbauer for an outdoor street party at 124 Ottawa Street South between the hours of 10:00 a.m. and 11:00 p.m. on July 28, 2016, as outlined in Community Services Department report CSD-16-045. Councillor S. Marsh entered the meeting at this time. CSD-16-043 - VICTUS HOCKEY ACADEMY INC. - SPORTSWORLD ARENA 5. The Committee considered Community Services Department report CSD-16-043, dated May 28, 2016 recommending the authorization of a license agreement with Victus Academy LP for space at Sportsworld Arena, municipally known as 35 Sportsworld Crossing Road. Messrs P. Pickard and J. Dueck were in attendance and responded to questions from the Committee. On motion by Councillor B. Ioannidis - it was resolved: That the Mayor and Clerk be authorized to execute a license agreement with Victus Academy LP for space at Sportsworld Arena, municipally known as 35 Sportsworld Crossing Road, said agreement to be satisfactory to the City Solicitor, as outlined in Community Services Department report CSD-16-043. INS-16-034 - OLD MILL PUMPING STATION ENVIRONMENTAL ASSESSMENT 6. The Committee considered Infrastructure Services Department report INS-16-034, dated May 24, 2016 recommending the Old Mill Sanitary Sewer Pumping Station Environmental Study report be received and filed with the Ministry of the Environment and Climate Change (MOECC) for the mandatory 30-day review period. Ms. L. Cooper and Mr. L. Costa were in attendance and responded to questions from the Committee. On motion by Councillor Y. Fernandes - it was resolved: That the Old Mill Sanitary Sewer Pumping Station Environmental Study Report (ESR) prepared by MTE Consultants Inc., dated May, 2016, be received; and further, That the Old Mill Sanitary Sewer Pumping Station Environmental Study Report (ESR) be filed with the Ministry of the Environment and Climate Change (MOECC) for the mandatory thirty (30) day review period as required by the Environmental Assessment Act, as outlined in Infrastructure Services Department report INS-16-034. INS-16-051 40 KM/H SCHOOL ZONE SPEED LIMIT PILOT PROJECT 7. The Committee considered Infrastructure Services Department report INS-16-051, dated May 25, 2016 recommending 40 km/h school zone speed limit be established along public elementary school frontages. Mr. K. Carmichael was in attendance and responded to questions from the Committee. COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE JUNE 13, 2016 - 29 - CITY OF KITCHENER INS-16-051 40 KM/H SCHOOL ZONE SPEED LIMIT PILOT PR 7. Questions were raised regarding the colour of the traffic speed limit signs, Mr. Carmichael advised that all roadway signs are legislated under the Ontario Highway Traffic Act and municipalities are not permitted to install signs outside of the approved manual. In response to questions regarding police enforcement of the school zone speed limits, Mr. Carmichael advised staff receive reports quarterly from the Waterloo Regional Police Department outlining the areas in the City where traffic enforcement has taken place, the number of hours of enforcement, as well as the type of charges that were issued. He noted the reports are public documents and agreed to forward them to all members of Council upon receipt. Questions were raised regarding the streets and how the schools were selected for the Pilot Program. Mr. Carmichael advised that the locations identified in the Report are the frontage of all public schools located on City streets. He indicated the only public schools omitted from the Program were public schools fronting onto Regional roads, as those streets are arterial roadways and were designed for higher speed limits. He further advised if speed limits were decreased on those roadways it would be unlikely that motorists would adhere to the reduced speed limit. Councillor Z. Janecki requested clarification on the recommended reduced speed limit for Queens Boulevard, noting it was a Regional Road. Mr. Carmichael stated that was a clerical error and requested Queens Boulevard be removed from the staff recommendation. A motion was brought forward by Mayor B. Vrbanovic to approve the recommendation as outlined in the staff report, save and except for the Queens Boulevard location as noted by staff. Councillor S. Marsh brought forward a motion to amend staff to report back on the possibility of providing additional signage advising motorists of pending reduced speed school zones. A further amendment was brought forward by Mayor Vrbanovic to request staff to report back on a possible funding source, and means by which the Program could be implemented prior to September 2016. Questions were raised regarding the French and private schools and whether staff considered implementing the reduced speed limits for those schools. Mr. Carmichael advised staff had not considered any other schools this date, but could report back on the possibility of implementing the reduced speeds zones at other schools beyond those outlined in the staff report. It was requested that the amendments be voted on separately on recorded vote. Carried unanimously. Carried and with Mayor B. Vrbanovic and Councillors K. Galloway-Sealock, S. Marsh, D. Schnider, P. Singh, B. Ioannidis, F. Etherington and Z. Janecki voting in support and Councillors J. Gazzola, S. Davey and Y. Fernandes voting in opposition. Carried unanimously.
