Livingstone, Committee Administrator CSD-16-040 - DRAFT PLAN OF SUBDIVISION - 30T-12203 1. - ZONE CHANGE APPLICATION - ZC12/17/C/JVW - ROBERT FERRIE DRIVE AND CARYNDALE DRIVE, CHALON ESTATES The Committee considered Community Services Department report CSD-16-040, dated May 9, 2016 recommending draft approval to Plan of Subdivision Application 30T-12203 for Chalon Estates and approval of Zone Change Application ZC/12/17/C/JVW requesting a change in zoning from Agricultural Zone (A-1) to Residential Three Zone (R-3), Residential Four Zone (R- 4), Residential Six Zone (R-6), Public Park Zone (P-1), Open Space Zone (P-2), and Hazard Lands (P-3). In addition, the Committee was in receipt this date of email correspondence from Ms. A. LaCroix-Bellinger dated June 10, 2016 and Mr. D. Halapair dated June 12, 2016. Ms. J. vonWesterholt presented the Report and responded to questions from the Committee. Mr. D. Aston, MHBC Planning, appeared on behalf of Chalon Estates and addressed the Committee in support of the development. He explained the approach to the proposed subdivision and detailed how resident concerns were addressed throughout the process. In addition, he pro the zone change. On motion by Councillor Y. Fernandes - it was resolved: That the City of Kitchener, pursuant to Section 51(31) of the Planning Act R.S.O. 1990, Chapter P13 as amended, and delegation by-law 2002-64, grant draft approval to Plan of Subdivision Application 30T- Kitchener, for Chalon Estates, and further, That Zone Change Application ZC/12/17/C/JVW (Chalon Estates) requesting a change in zoning from Agricultural Zone (A-1) to Residential Three Zone (R-3),Residential Four Zone (R-4), Residential Six Zone(R-6), Public Park Zone (P-1), Open Space Zone (P-2), Hazard Lands (P-3) be approved in the for- 9, 2016 attached to Community Services Department report CSD-16-040 as Appendix . CSD-16-035 - OFFICIAL PLAN AMENDMENT OP15/04/H/AP 2. - ZONE CHANGE APPLICATION ZC15/014/H/AP - HIDDEN VALLEY RESIDENTIAL COMMUNITY PLAN AMENEDMENT - 1054 AND 1070 HIDDEN VALLEY ROAD, 1232118 ONTARIO INC. The Committee considered Community Services Department report CSD-16-035, dated May 20, 2016 recommending refusal of Official Plan Amendment Application OP15/04/H/AP; that Council not request an amendment to section 15.D.12.2.a of the Final New Official Plan; refusal of Zone Change Application ZC15/014/H/AP; and, refusal of the request to modify Policy 3.3 of the Hidden Valley Residential Community Plan. In addition, the Committee was in PLANNING & STRATEGIC INITIATIVES COMMITTEE MINUTES JUNE 13, 2016 -19- CITY OF KITCHENER CSD-16-035 - OFFICIAL PLAN AMENDMENT OP15/04/H/AP 2. - ZONE CHANGE APPLICATION ZC15/014/H/AP - HIDDEN VALLEY RESIDENTIAL COMMUNITY PLAN AMENEDMENT - 1054 AND 1070 HIDDEN VALLEY ROAD, 1232118 ONTARIO INC. receipt this date of email correspondence dated June 13, 2016 from Mr. B. Green, GSP Group, enclosing a petition and letters in support of the development, as well as correspondence dated June 13, 2016 from Ms. C. Wiebe. Mr. A. Pinnell presented the Report detailing the planning rationale and responded to questions from the Committee. Mr. Brandon Flewwelling, GSP Group Inc., appeared on behalf of the applicant and gave a presentation in support of the proposed development of 40 executive condominium townhomes in Hidden Valley. He explained the site location and characteristics of the proposal regarding the concerns expressed by the residents at a neighbourhood meeting, such as overlook, and how they have been addressed within the proposed plan. He highlighted the setbacks of the development from the existing homes and pointed out that landscaping and fencing would be finalized within the Site Plan approval process. In addition, he reviewed the requested approvals in context of the existing policies indicating they are directed at providing a range of lot sizes/housing types, increasing affordability and avoidance of sprawl. Regarding position, he indicated the site could accommodate 8 lots if zoned R-2 which would not be an efficient use of land and infrastructure and noted R-6 is being requested to permit the development of the townhomes at a density lower than the maximum permitted by the proposed zoning. In response to questions regarding the ecological impact of the development due to runoff from increased impervious cover, Mr. Flewwelling advised stormwater management and grading have been preliminarily examined and would be constructed in accordance to City guidelines during detailed design. He responded to further questions indicating lower density from 40 units could be considered; however, he acknowledged a large chasm between staff supported R-2 zoning and the requested R-6 zoning to permit the type of development proposed. Ms. Carole Wiebe, MHBC Planning, appeared on behalf of Hidden Valley estates and Mr. P. Kruse. She application stating the policies first established in the Hidden Valley Community Plan have been carried forward as a Special Policy area in both the 1994 Official Plan and 2014 Official Plans. She elaborated that Special Policies in 1994 applied a maximum residential density of 4 units per hectare and have been carried forward to 2014 to maintain the rural character and ambience distinctive to Hidden Valley. She requested Council recognize and preserve the unique s recommendation and noted other areas within the City could accommodate the density proposed by the applicant. Mr. Dan Sack, Applicant, addressed the Committee in support of the development. He provided the history and context of the plan indicating the development would provide an opportunity for residents to downsize while remaining in their community. He stated residents who attended the neighbourhood meeting originally may have thought the development would consist of starter townhomes; however, the integrity of the homes in the area has been reflected in the proposal through the building material and design and positive feedback has been received. He referred to the petition circulated to the Committee this date noting that 22 residents of Hidden Valley have signed in support. Mr. Sack responded to questions advising staff have indicated support for an R-2 zone within the subject property which would permit up to 7 single detached dwellings. He stated he is open to dialogue regarding potentially reducing the number of units; however, the cost of installing sanitary sewer along Hidden Valley Road would not be financially feasible for 7 units. He responded to further questions regarding a possible deferral stating he would be open to dialogue with staff; however, he would like the development to proceed sooner than later. Mr. Alex Malcolm, Area Resident, addressed the Committee in support of the development stating smaller homes in the area would provide the opportunity for downsizing as well as greater potential for individuals to afford to live in the area by purchasing townhomes. PLANNING & STRATEGIC INITIATIVES COMMITTEE MINUTES JUNE 13, 2016 -20- CITY OF KITCHENER CSD-16-035 - OFFICIAL PLAN AMENDMENT OP15/04/H/AP 2. - ZONE CHANGE APPLICATION ZC15/014/H/AP - HIDDEN VALLEY RESIDENTIAL COMMUNITY PLAN AMENEDMENT - 1054 AND 1070 HIDDEN VALLEY ROAD, 1232118 ONTARIO INC. Mr. Rich Weinstein encouraged the uniqueness of the community to be preserved. He questioned the validity of the petition and the rationale for a deferral in order to consider a petition signed by individuals that live outside of the Hidden Valley community. Councillor B. Ioannidis responded advising he would seek a deferral to examine both sides of the issue, noting that the Applicant may be open to revising his plan to lower the density. A discussion took place regarding the merit of retaining R-1 zoning for estate lots and the availability of building lots of this calibre throughout the City. Mr. Pinnell reviewed planning principles and the characteristics of Hidden Valley noting the proposal represents five percent of R-1 lots throughout the City. He explained the importance of retaining the R-1 zoning to provide diversity for housing types and pointed out there are thousands of lots that could accommodate higher density development in other areas in Kitchener. Councillor B. Ioannidis brought forward a motion to defer consideration of the Report to the Council meeting of June 27, 2016 to allow the developer to consider modifying the proposal by lowering density from the proposed 40 units. LOST Councillor Ioannidis motion was then voted on and wason a recorded vote with Councillors B. Ioannidis, F. Etherington, P. Singh, S. Marsh and S. Davey voting in favour; and, Mayor B. Vrbanovic and Councillors D. Schnider, J. Gazzola, K. Galloway-Sealock, Y. Fernandes and Z. Janecki voting in opposition. Carried Unanimously The following motion was then voted on and was on a recorded vote. On motion by Councillor J. Gazzola - it was resolved: That Official Plan Amendment Application OP15/04/H/AP (1232118 Ontario Inc., 1054 and 1070 Hidden Valley Road) Official Plan, not be adopted; and, That Council not request that the Regional Municipality of Waterloo amend section 15.D.12.2.a) of the Final New Official Plan; and, That Zone Change Application ZC15/014/H/AP (1232118 Ontario Inc., 1054 and 1070 Hidden Valley Road) for the purpose of changing the zoning from Residential One Zone (R-1) to Residential Six Zone (R-6) with Special Use Provision 456U and Special Regulation Provision 678R, be refused; and further, That the request of 1232118 Ontario Inc. for 1054 and 1070 Hidden Valley Road to modify Policy 3.3 of the Hidden Valley Residential Community Plan, be refused, as outlined in Community Services Department report CSD-16-035 3.
