SUBJECT: E16-004 Consulting Services for Detailed Design and
Construction Contract Administration for Balzer Creek
Restoration

RECOMMENDATION:
That Expression of Interest E16-004 Consulting Services for Detailed Design and
Construction Contract Administration for Balzer Creek Restoration, be awarded
to Matrix Solutions Inc., Breslau, Ontario, at their estimated fee of $268,213.,
including contingencies of $24,383. plus H.S.T. of $34,867.69, for a total of
$303,080.69, based on a satisfactory contract being negotiated and an upset fee
being established.
BACKGROUND:
Balzer Creek, a tributary of Schneider Creek, drains a watershed area of 259 hectares
and is situated entirely within the City of Kitchener. Much of the drainage network has
been altered to accommodate urbanization and only 1.7 km of open channel remains.
Balzer Creek enters the Country Hills neighbourhood of Kitchener from the outlet of a
stormwater pipe at Old Country Drive and flows into Schneider Creek, east of
Fallowfield Drive. Through routine monitoring, the City of Kitchener identified risk to
property (existing and future anticipated), risk to sanitary sewer infrastructure, and
concerns regarding channel stability along Balzer Creek. Interim emergency works were
completed (September 2015) to protect private property (rear yard infrastructure) behind
Brisbane Court, and directly upstream of Homer Watson Boulevard to stabilize the
creek bank at the location of a badly failed outlet and collapsed stream bank.

This Contract is for consulting services for detailed design and construction contract
administration for Balzer Creek Restoration in alignment with the preferred preliminary
designs presented in Balzer Creek Schedule ‘B’ Class Environmental Assessment
(Ecosystem Recovery, 2015). In conjunction with the detailed design for the channel
works and restoration activities the City of Kitchener additionally requires detailed
design for a multiuse pathway in locations within the study area where trail development
has been previously planned according to the City of Kitchener’s Trails Master Plan.
The City of Kitchener undertook an Environmental Assessment (EA) study with the
consultant Ecosystem Recovery Inc. in 2015 to evaluate the best alternatives to
address various environmental, private property and infrastructure concerns along
Balzer Creek. The Balzer Creek EA study was completed under Schedule “B” of the
Municipal Class Environmental Assessment Process. During the EA a number of
alternative solutions were evaluated by the consulting team using technical,
environmental, economic and social/cultural criteria within a matrix evaluation process
and preferred solutions were identified. As part of the EA study preliminary design work
was prepared for the preferred solutions and two Public Information Centre (PIC)
meetings were held to provide opportunities for public feedback into the process. The
preliminary design work presented in the EA incorporates feedback from both PIC and
the Environmental Committee meetings.
REPORT:
In accordance with Chapter 170 of the Municipal Code pertaining to the Selection of
Professional Services/Consultants, a Consultant’s Review Committee was established
consisting of M. Wilson, Design & Construction Project Manager, N. Gollan, Manager of
Stormwater Utility, T. O’Brien, Park Development Project Manager, E. Riek, Project
Manager of Development Engineering, C. Musselman, Senior Environmental Planner
and L. Stecho, Supervisor of Purchasing.
Expressions of interest were advertised publicly on the City of Kitchener website and on
the internet through the Ontario Public Buyers Association Electronic Tendering
Information System relative to this project. Documents were downloaded by forty (40)
interested parties and by the closing date of Friday February 26, 2016, eight (8)
responses had been received.
The review committee met on Monday March 21, 2016, to review the submissions and a
shortlist of three (3) candidates* was selected for further interviews. The Committee
met on Thursday April 7, 2016 to interview the shortlisted candidates. The Committee
recommends awarding the project to Matrix Solutions Inc., Breslau, Ontario.

ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN:
The recommendation of this report supports the achievement of the city’s strategic
vision through the delivery of core service.
FINANCIAL IMPLICATIONS:
In addition to the costs anticipated in this expression of interest, the design and
implementation of these types of projects typically involves city staff and resources from
across the corporation. These costs are included in the line item "Projected Costs: Staff
Time/Permitting/Material testing", and will be itemized when they exceed $125,000.
Included in this line item are staff time and expenses for all city staff in support of the
project such as Engineering, Kitchener Utilities, and Transportation Planning. The line
item also includes all regulatory permitting, geotechnical and material testing, detouring
and traffic control, alternate access and parking requirements and any other
miscellaneous costs. Projects utilizing in-house staff will include costs for inspection
during construction and contract administration.

The net cost for this expression of interest (A), is fair and reasonable for a purchase of
this scope and the upset limit is within the budget allowance (B) provided within the
budget. Funding for this purchase is included within the approved capital budget. The
estimated surplus (E) will remain within the project and used to help fund the
construction phase.
