SUBJECT: ENCROACHMENT AGREEMENT REQUEST – RAILING OVER
ROAD ALLOWANCE AT 276 KING STREET WEST

RECOMMENDATION:
“That, subject to obtaining all necessary approvals, the Mayor and Clerk be authorized to
execute an Encroachment Agreement with Waterloo Standard Condominium Corporation
#424 for a railing extending over the City sidewalk in front of 276 King Street West, said
agreement to be to the satisfaction of the City Solicitor.”
BACKGROUND:
This property is known as the Eaton Lofts. Dakon Construction Ltd., on behalf of the owner of
the property, approached the City of Kitchener to ask for permission for a staircase railing to
project over the City sidewalk.
REPORT:
As part of the Eaton Loft Stair Replacement Project conducted by Dakon Construction Ltd., the
Condominium Corporation would like to be authorized to encroach over the City sidewalk.
The railing runs about 1 foot (0.3m) along the face of the building at the right and left of the
stairwell leading to the entrance. The part of the railing that will be encroaching will only project
approximately 4 inches (0.1m). Please find a drawing in Appendix A illustrating the location of
the proposed stair railing.
Through the encroachment circulation process, there are no objections; however, there are still
a few outstanding comments yet to be received.

ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN:
The recommendation of this report supports the achievement of the City’s strategic vision
through the delivery of core services.
FINANCIAL IMPLICATIONS:
The application fee of $269 has been paid in accordance with the City’s fee schedule. An
additional $230 processing fee is payable once authorized by Council, and it is expected to be
received in accordance with the City’s fee schedule.
COMMUNITY ENGAGEMENT:
INFORM – This report has been posted to the city’s website with the agenda in advance of the
Council meeting.
CONSULT - Internal staff and outside utility companies have been circulated for their comments
and/or approval.
CONCLUSION:
Once support for authorizing the encroachment of the staircase railing has been received from
Council, it will be in order to authorize the execution of an encroachment agreement with the
Condominium Corporation.
