The Community and Infrastructure Services Committee met this date, commencing at 1:29 p.m.

Pursuant to Chapter 25 (Procedure) of the Municipal Code, a motion was brought forward by
Councillor J. Gazzola to discuss Consent items 1, 2, 3, 7 and 13, which was voted on and
Carried.
INS-16-041 - TRAVELWISE TRANSPORTATION MANAGEMENT ASSOCIATION
1.
The Committee considered Infrastructure Services Department report INS-16-041, dated June
27, 2016 recommending that the City enter into a Travelwise Program Services Agreement to
allow for membership in the Transportation Management Association (TMA) established by the
Region of Waterloo. Messrs J. Readman and K. Carmichael were in attendance and
responded to questions from the Committee.
On motion by Councillor S. Davey -
it was resolved:
That the Mayor and Clerk be authorized to execute the Travelwise Program Services
Agreement, subject to the satisfaction of the City Solicitor, with the Regional
Municipality of Waterloo and other participating organizations for the provision of
transportation demand management services for the year of 2016; and further,
That the Director of Transportation be authorized to execute renewals and/or
amendments to this Agreement as well as future new Agreements with respect to the
Travelwise Program, subject to the satisfaction of the City Solicitor, provided that any
associated costs are within the approved departmental budget, as outlined in
Infrastructure Services Department report INS-16-041.
INS-16-053 - ON-STREET PARKING REGULATIONS - MARKET LANE

The Committee considered Infrastructure Services Department report INS-16-052, dated July 4,
2016 recommending a stopping prohibition at any time on both sides of Market Lane. Mr. K.
Carmichael was in attendance and responded to questions from the Committee.
On motion by Councillor S. Davey -
it was resolved:
That the Uniform Traffic By-law be amended to prohibit stopping at any time on both
sides of Market Lane, as outlined in Infrastructure Services Department report INS-16-
053.
INS-16-056 - ON-STREET PARKING REGULATIONS - DUMFRIES AVENUE

The Committee considered Infrastructure Services Department report INS-16-056, dated July 8,
2016 recommending the parking prohibition at any time currently located on the north (even-

to the south (odd-numbered side).
On motion by Councillor S. Davey -
it was resolved:
That the Uniform Traffic By-law be amended to shift
north (even-numbered side) to the south (odd-numbered side) of Dumfries Avenue
between Stirling Avenue North and Krug Street, as outlined in Infrastructure Services
Department report INS-16-056.
INS-16-057 - ON-STREET PARKING REGULATIONS - MAX BECKER DRIVE

The Committee considered Infrastructure Services Department report INS-16-057, dated July
6, 2016 recommending prohibition of parking on the north side of Max Becker Drive.
On motion by Councillor S. Davey -
it was resolved:
That the Uniform Traffic By-law be amended to prohibit parking on the north side of
Max Becker Drive from Copper Leaf Street to a point 62 metres west thereof, as
outlined in Infrastructure Services Department report INS-16-057.
INS-16-058 - ON-STREET PARKING REGULATIONS - PERIWINKLE STREET

The Committee considered Infrastructure Services Department report INS-16-058, dated July
8, 2016 recommending a parking prohibition at any time on the east (odd-numbered side) of
Periwinkle Street.
On motion by Councillor S. Davey -
it was resolved:
That the Uniform Traffic By-law be amended to prohibit parking at any time on the east
(odd-numbered side) of Periwinkle Street from a point 36 metres south of Sweet William
Street, around the corner, to a point 45 metres east thereof, as outlined in Infrastructure
Services Department report INS-16-058.
INS-16-059 - ON-STREET PARKING REGULATIONS - JOSEPH STREET

The Committee considered Infrastructure Services Department report INS-16-059, dated July 11,
2016 recommending various stopping prohibitions on Joseph Street.
On motion by Councillor S. Davey -
it was resolved:
That stopping be prohibited at any time on the north (even-numbered) side of Joseph
Street from Victoria Street South to the west limit of Joseph Street; and,
That stopping be prohibited at any time on the south (odd-numbered) side of Joseph
Street from Victoria Street South to a point 30 metres west thereof; and,

west thereof; and,

Services Department report INS-16-059.
INS-16-060 - ON-STREET PARKING REGULATIONS - WESTFOREST TRAIL

The Committee considered Infrastructure Services Department report INS-16-060, dated July 15,
2016 recommending parking be permitted for three (3) consecutive hours on the north side of
Westforest Trail.
Councillor P. Singh left the meeting at this time.
In response to questions, Mr. K. Carmichael advised that staff have had a number of discussions
with the Principal and parents of the children that attend Sandhills Public School about the lack of
parking available for school drop off and pick up. He noted that although staff are endeavouring
to discourage parking in and around school zones, there were challenges with this site. Staff
believe providing a parking option on the side street not directly in front of the school may
alleviate some of the concerns identified without creating any additional safety hazards.
At the request of Councillor Y. Fernandes, Mr. Carmichael agreed at various times throughout the
school year to informally survey the parents on the new parking regulations.
On motion by Councillor S. Davey -
it was resolved:
That the Uniform Traffic By-law be amended to permit parking for three (3) consecutive
hours, as per the General Provisions of the Uniform Traffic By-law, on the north side of
Westforest Trail from a point 50 metres west of Victoria Street South to a point 100
metres west thereof, as outlined in Infrastructure Services Department report INS-16-
060.
Councillor P. Singh entered the meeting at this time.
CSD-16-056 - NOISE EXEMPTION - OKTOBERFEST
8.
The Committee considered Community Services Department report CSD-16-056, dated July 20,
2016 recommending approval of a noise exemption to K-W Oktoberfest Inc. for a series of events
being held at various clubs between October 7 and October 15, 2016.
On motion by Councillor S. Davey -
it was resolved:
That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be
granted to K-W Oktoberfest Inc. for a series of events being held at various clubs
between October 7 and October 15, 2016, as outlined in the letter from K-W Oktoberfest
Inc., dated March 29, 2016, as attached to Community Services Department report
CSD-16-056.
CSD-16-055 - NOISE EXEMPTION - FROSH CIRCUS - BINGEMANS

The Committee considered Community Services Department report CSD-16-055, dated July 21,
2016 recommending approval of a noise exemption to the organizers of Frosh Circus for an
2016.

CSD-16-055 - NOISE EXEMPTION - FROSH CIRCUS -

On motion by Councillor S. Davey -
it was resolved:
That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be
September 9, 2016, between the hours of 2:30 p.m. and 11:00 p.m., as outlined in
Community Services Department report CSD-16-055; and further,
That the exemption is subject to the following conditions, which, if not complied with, will
render the noise exemption null and void:
a) There shall be no offensive language, in the opinion of City staff, generated from
this music festival, audible in any adjacent residential neighbourhood. The event
organizers will ensure that there is an on-site contact person accessible to
correspond with City staff at all times during the event;
b) The event organizer will be responsible for the cost of a pay-duty Noise Officer, to
be assigned specifically to this event;
c) The event organizers agree to respond accordingly to requests from City staff,
during the event, in order to address community concerns that may arise with
regard to the impact of noise heard within adjacent residential areas;
d) The maximum decibel level (dba) audible from a residential area shall not exceed
65 dba; and,
e) If in the opinion of the investigating Officer, the bass is deemed to be excessive,
the event organizer agrees to respond accordingly and adjust the level of bass
output to a level where it is no longer a nuisance.
CSD-16-039 - NOISE EXEMPTION - 423 LAWRENCE AVENUE (66 GOTTSCHEER COURT)

The Committee considered Community Services Department report CSD-16-039, dated July 20,
2016 recommending approval of a noise exemption to Sherry Landry for a special event, located
at 423 Lawrence Avenue, between the hours of 3:00 p.m. to 11:00 p.m. on September 3, 2016. In
addition, the Committee was in receipt this date of email correspondence from Mr. S. Vrentzos,
dated August 5, 2016, requesting an amendment to the location from 423 Lawrence Avenue to
66 Gottscheer Court.
A motion was brought forward by Councillor S. Davey to approve the recommendation as
outlined in the staff report with an amendment to change the location of the noise exemption to 66
Gottscheer Court.
It was noted any recommendation arising from this matter would be considered at a special
Council meeting later this date.
On motion by Councillor S. Davey -
it was resolved:
That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be
granted to Sherry Landry for a special event to be held at 66 Gottscheer Court on
September 3, 2016, between the hours of 3:00 p.m. and 11:00 p.m., outlined in
Community Services Department report CSD-16-039.
CSD-16-051 - NOISE EXEMPTION - BREITHAUPT PARK CAMPING EVENT - MT. HOPE

NEIGHBOURHOOD ASSOCIATION
The Committee considered Community Services Department report CSD-16-051, dated July 21,
2016 recommending approval of a noise and park exemption to the Mt. Hope Neighborhood
Association for a camping event, located at Breithaupt Park, between the hours of 5:00 p.m. and
10:00 a.m. on August 27-28, 2016.

CSD-16-051 - NOISE EXEMPTION - BREITHAUPT PARK CAMPING EVENT - MT. HOPE

NEIGHBOURHOOD ASSOCIATION
It was noted any recommendation arising from this matter would be considered at a special
Council meeting later this date.
On motion by Councillor S. Davey -
it was resolved:
That an exemption to Chapters 450 (Noise) and 270 (Parks) of the City of Kitchener
Municipal Code be granted to the Mt. Hope Neighborhood Association, for their
Camping Event to be held at Breithaupt Park on Saturday August 27-28, 2016, between
the hours of 5:00 p.m. and 10:00 a.m., as outlined in Community Services Department
report CSD-16-051.
CSD-16-059 - NOISE EXEMPTION - MUDDERELLA TORONTO - BINGEMANS

The Committee considered Community Services Department report CSD-16-059, dated July 20,
2016 recommending approval of a noise exemption to Mudderella Toronto for an event, located
at Bingemans Park, between the hours of 7:00 a.m. to 7:00 p.m. on August 27, 2016.
It was noted any recommendation arising from this matter would be considered at a special
Council meeting later this date.
On motion by Councillor S. Davey -
it was resolved:
That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be
granted to Mudderella Toronto at Bingemans Park, between the hours of 7:00 a.m. and
7:00 p.m. on August 27, 2016, as outlined in Community Services Department report
CSD-16-059.
CSD-16-048 - AMENDMENT - CHAPTER 408 (ANIMALS - REGULATION) BY-LAW
13.
FEEDING WILDLIFE PROVISION
The Committee considered Community Services Department report CSD-16-048, dated July 21,
2016 recommending the enactment of a By-law to amend Chapter 408 (Animals - Regulation) of
the City of Kitchener Municipal Code to add a section prohibiting the feeding of wildlife. In
addition, the Committee was in receipt this date of email correspondence dated August 8, 2016,
from a resident in support of the recommendation outlined in Report CSD-16-048. Ms. G.
MacNeil was in attendance and responded to questions from the Committee.
It was suggested, and Ms. MacNeil agreed, to follow up with Communications on the possibility

it was resolved:
That a By-law be enacted to amend Chapter 408 (Animals - Regulation) of the City of

INS-16-062 - SCHOOL TRAFFIC SAFETY CHANGES FOR THE 2016-17 SCHOOL YEAR

The Committee considered Infrastructure Services Department report INS-16-062, dated July 15,
2016 recommending a School Bus Loading Zone be established on Hoffman Street and a
relocation of Adult Crossing Guards at various locations. Mr. K. Carmichael was in attendance
and responded to questions from the Committee.

INS-16-062 - SCHOOL TRAFFIC SAFETY CHANGES FOR THE 2016-17 SCHOOL YEAR

On motion by Councillor S. Marsh -
it was resolved:
That the Adult Crossing Guard assisted School Crossings on Frederick Street at East
Avenue be relocated to Frederick Street & Lancaster Street; and,
That the Adult Crossing Guard assisted School Crossing on Victoria Street South at
Oprington Drive be relocated to Ottawa Street South and Wilderness Drive; and,
That a School Bus Loading Zone be established on Hoffman Street from a point 21
metres north of Southdale Drive to a point 13 metres north thereof; and further,
That the Uniform Traffic By-law be amended accordingly, as outlined in Infrastructure
Services Department report INS-16-062.
CSD-16-054 - BILL 204 PROMOTING AFFORDABLE HOUSING ACT

The Committee considered Community Services Department report CSD-16-054, dated July 28,
2016 recommending the report be submitted to the Province, along with any comments via the
online feedback form. Mr. B. Sloan and Ms. L. Nelson were in attendance and responded to
questions from the Committee.
It was noted any recommendation arising from this matter would be considered at a special
Council meeting later this date.
On motion by Councillor Y. Fernandes -
it was resolved:
That Community Services Department report CSD-16-054 regarding Bill 204 -
Promoting Affordable Housing Act be submitted to the Province, along with any
comments via the online feedback form.
