HomeMy WebLinkAbout2016-08-02 HERITAGE KITCHENER MINUTES AUGUST 2, 2016 CITY OF KITCHENER The Heritage Kitchener Committee met this date, commencing at 4:05 p.m. Present: Mr. G. Zeilstra - Chair Councillor J. Gazzola, Ms. M. Bell, and Messrs. S. Miladinovic, S. Thomson, P. Ciuciura and S. Burrows. Staff: L. Bensason, Coordinator of Cultural Heritage Resources S. Livingstone, Committee Administrator CSD-16-029 - HERITAGE PERMIT APPLICATION HPA-2016-IV-006 1. - 10 SIMS ESTATE PLACE - NEW GARAGE The Committee considered Community Services Department report CSD-16-029, dated July 8, 2016 recommending refusal of Heritage Permit Application HPA-2016-IV-006 to permit a new garage at 10 Sims Estate Place. Mr. L. Bensason presented the Report and reviewed the merits of the application stating construction of a garage within the westerly side yard does not conform or appear to meet the intent of Special Regulation 472 of the Zoning By-law, which serves to preserve the open setting and prevent new construction within the westerly side yard. He indicated the proposed location of the garage will impact views to the upland forest and wooded valley of Chicopee Creek referenced in the Designation By-law and will have an impact on the context of setting at a critical public vantage point. In addition, he stated the scale of the proposed garage may compete with, and is not subordinate to, the modest scale of the stone house, as viewed from Sims Estate Place; and, a garage of similar scale can be accommodated within the easterly side yard, where its placement and scale will not visually compete with the stone house as one first approaches and views the property from Sims Estate Place. Mr. Bensason reviewed the recommendation stating that as Heritage Planning Staff are of the opinion that the most appropriate location for the construction of a garage on the subject property is within the easterly rather than westerly side, staff are recommending refusal of the application as submitted. In response to questions from the Committee, Mr. Bensason stated that should the Committee recommend approval of the HPA to permit the garage as proposed, approval would be conditional on the Committee of Adjustment granting a minor variance to allow a structure to be built within the westerly side yard setback. He explained that as the there is no cost to the the applicants were encouraged to submit their application for heritage consideration prior to the Committee of Adjustment. Mr. Greg White and Ms. Wendy Piwowarek addressed the Committee in support of the HPA to permit a new garage at their property located at 10 Sims Estate Place. Mr. White explained the proposal advising they had purchased the property with the intent to build a garage and had sought information from Heritage Planning Staff regarding potential locations for the structure. He indicated a map of the property was provided with two alternative locations for the garage. He stated at that time they were not informed of the zoning regulations and continued with the proposal on the westerly side of the property with the understanding it would be approved. Ms. Piwowarek referred to the proposal stating the land on the westerly side yard is flat and hardened with the proposed garage set back to allow the views of the upland forest. She stated if the garage were to be built on the east side, four or five mature trees would need to be removed or root systems impacted by construction. She described the trees as a silver maple, two Austrian pines and a hickory tree located immediately adjacent to the concrete pad on the easterly yard. She further explained that on the east side of the house, a septic pump has an outlet that runs across the base of the property to a sewer grate on the parking pad. She explained they have been advised not to disturb the outlet and that the construction of a garage would require a thick concrete base where the sewer grate is located. She expressed additional concern the garage on the easterly yard would block views to the native vegetation and that as you walk past the eastern façade, you see the smoke house, chimney and heritage plaque as well as some views of the Sims Estate. She concluded that a garage on the westerly HERITAGE KITCHENER MINUTES AUGUST 2, 2016 - 18 - CITY OF KITCHENER CSD-16-029 - HERITAGE PERMIT APPLICATION HPA-2016-IV-006 1. - 10 SIMS ESTATE PLACE - side would provide a more appropriate transition to the new condominium townhouses and stated they are willing to work with Heritage Staff to reduce the footprint of the proposed garage. In response to questions from the Committee, Mr. White stated he was provided a map with two potential options for the location of the garage when he purchased the home and explained it was not until they put together the proposal they became aware of the special zoning regulations. In response to further questions, Mr. White indicated they currently park on the parking pad located in the easterly yard. Ms. Piwowarek confirmed their preference is to have the garage on the westerly side and expressed a willingness to work with staff to reduce the size of the garage. On motion by Councillor J. Gazzola - it was resolved: That pursuant to Section 33 of the Ontario Heritage Act, Heritage Permit Application HPA-2016-IV-006 to permit construction of a new detached double car garage on the property municipally addressed as 10 Sims Estate Place, be refused CSD-16-046 - HERITAGE PERMIT APPLICATION HPA-2016-IV-011 2. - 300 JOSEPH SCHOERG CRESCENT - DRIVE SHED ALTERATIONS The Committee considered Community Services Department report CSD-16-046, dated June 16, 2016 recommending approval of Heritage Permit Application HPA-2016-IV-011 to permit drive shed alterations at 300 Joseph Schoerg Crescent. Ms. S. Parks presented the Report including the details of previously approved Heritage Permit Applications. Mr. S. Burrows entered the meeting at this time. With regard to the process, Ms. Parks advised that if approved by unanimous consent, the Heritage Permit Application would be approved through delegated authority. Carried Unanimously The following motion was then voted on and was . On motion by Mr. S. Miladinovic - it was resolved: That pursuant to Section 33 of the Ontario Heritage Act, Heritage Permit Application HPA-2016-IV-011 be approved to permit alterations to the drive shed, including new and enlarged window and door openings, on the property municipally addressed as 300 Joseph Schoerg Crescent, in accordance with the plans and supplementary information submitted with the application and subject to the following condition: 1. That the final building permit drawings be reviewed and heritage clearance provided by Heritage Planning staff prior to the issuance of a building permit CSD-16-047 - HERITAGE PERMIT APPLICATION HPA-2016-V-012 3. - 189 QUEEN STREET NORTH - GARAGE ADDITION The Committee considered Community Services Department report CSD-16-047, dated July 7, 2016 recommending approval of Heritage Permit Application HPA-2016-V-012 to permit a garage addition at 189 Queen Street North. Ms. S. Parks presented the Report. HERITAGE KITCHENER MINUTES AUGUST 2, 2016 - 19 - CITY OF KITCHENER CSD-16-047 - HERITAGE PERMIT APPLICATION HPA-2016-V-012 3. - 189 QUEEN STREET NORTH - In response to questions from the Committee, Ms. Parks clarified that although the renderings of the window dormers on the altered drive shed do not depict Tudor Revival style trim, the Applicants have confirmed their intent to trim the dormer gable in that style. With regard to the process, Ms. Parks advised that if approved by unanimous consent, the Heritage Permit Application would be approved through delegated authority. Carried Unanimously The following motion was then voted on and was . On motion by Mr. S. Miladinovic - it was resolved: That pursuant to Section 42 of the Ontario Heritage Act, Heritage Permit Application HPA-2016-V-012 be approved to permit construction of a second storey addition to the garage on the property municipally addressed as 189 Queen Street North, in accordance with the plans and supplementary information submitted with the application and subject to the following condition: 1. That the final building permit drawings be reviewed and heritage clearance provided by Heritage Planning staff prior to the issuance of a building permit. HERITAGE IMPACT ASSESSMENT - WILLIAM STREET AND STRANGE STREET 4. - WATER SUPPLY SYSTEMS CLASS EA - 25 STRANGE STREET, STRANGE STREET PUMPING STATION The Committee considered a memorandum dated July 19, 2016, and Heritage Impact Assessment prepared for the Regional Municipality of Waterloo entitled 25 Strange Street Pumping Station regarding the Class Environmental Assessment (EA) to determine the most appropriate development option for upgrades to the water supply for Kitchener and Waterloo. Mr. Kaoru Yajima, Senior Project Engineer, Water Services, Region of Waterloo, presented the Heritage Impact Assessment (HIA) and provided context to the project advising 25 Strange Street has been identified through the EA process as the optimum location for a new treatment facility. He explained the EA study identified five potential approaches to locating the facilities on the Strange Street site and the HIA examines the impact of the options with respect to the heritage attributes and significance of the property. Mr. Yajima provided an overview of each of the alternatives, including the advantages and disadvantages from an operations and heritage perspective, and indicated that Alternative 5 offers the best compromise and scored highest against the criteria. He noted that Regional Heritage Staff are in support of Alternative 5 as it maintains the original use of the Strange Street Pumping Station, which is water supply. He showed conceptual drawings of the new facility and indicated finishes, including the look of the reservoir, would be determined through the detailed design phase. He reviewed the next steps in the project advising the final EA will be available for public review in fall 2016. Mr. L. Bensason indicated staff would be providing comments to the Region and requested the Committee provide feedback on the HIA presented this date. Committee members indicated the reservoir should be in contrast to the pumping station to signify the importance as water as a resource and to conserve the heritage significance of the original pumping station. It was also suggested that the original style doors and exterior elements be kept consistent with the heritage style. Mr. Yajima acknowledged the feedback from the Committee and advised the comments would be taken back for consideration during detailed design phase but noted that there is a balance between functional requirements for operations and aesthetics. HERITAGE KITCHENER MINUTES AUGUST 2, 2016 - 20 - CITY OF KITCHENER HERITAGE BEST PRACTICES - JUNE 7 DESIGNATION SUB-COMMITTEE MEETING 5. REPORT Mr. L. Bensason provided an update on the Heritage Designation Sub-Committee. He advised the Sub-Committee had completed the matrix of properties listed on the inventory and Municipal Heritage Register in order to priorities the degree of risk to cultural heritage resources. He indicated the Sub-Committee had weighted each property against criteria and determined that of approximately 230 properties, 13 were identified as priorities for designation under Part IV of the Ontario Heritage Act. He elaborated that of the 13, 3 are of immediate priority as the other 10 have processes or studies, such as heritage impact assessments, that are under way. With regard to next steps, Mr. Bensason stated efforts will be made to engage homeowners of the 230 properties of cultural heritage interest soliciting feedback and interest in the designation process. He noted the Sub-Committee will be drafting the contents of a letter which will include information regarding a public open house on the designation process and the efforts within the City of Kitchener to conserve cultural heritage. HERITAGE BEST PRACTICES - OPEN FORUM 6. A discussion took place regarding the list of qualified contractors to work on heritage properties maintained by the Architectural Conservancy of Ontario (ACO). Mr. L. Bensason explained contractors provided to the ACO by city staff are those that were known to have performed work on Part IV or Part V properties, as indicated on the Heritage Permit Applications. He noted the City has provided contributions to the list based on known factors; however, it is unknown what qualifications or experience is required to be added to the ACO list of qualified contractors.
