HomeMy WebLinkAboutCouncil - 2016-09-12 S SPECIAL COUNCIL MINUTES SEPTEMBER 12, 2016 CITY OF KITCHENER A special meeting of City Council was held at 6:08 p.m. this date, chaired by Mayor B. Vrbanovic with all members present except Councillors F. Etherington, J. Gazzola and B. Ioannidis. Notice of this meeting had been previously given to all members of Council by the City Clerk pursuant to Chapter 25 (Council Procedure) of the Municipal Code. 1. FCS-16-146 – 2016 DEBT ISSUE REVISION Council considered Finance and Corporate Services Department report FCS-16-146 (R. Hagey), dated September 1, 2016, requesting reconsideration of the motion passed at the January 18, 2016 special Council meeting regarding the inclusion of ‘Urban Forest - $256,000’ on the list of items identified for 2016 debenture financing. Moved by Councillor S. Davey Seconded by Councillor D. Schnider “That the January 18, 2016 motion which approved the inclusion of ‘Urban Forest - $256,000’ on the list of items identified for 2016 debenture financing, be reconsidered.” Carried with the required 2/3 majority. Moved by Councillor S. Davey Seconded by Councillor D. Schnider “That “Urban Forest - $256,000” be removed from the list of items identified for 2016 debenture financing, as approved at the January 18, 2016 special Council meeting and be replaced with “KOF Maintenance - $200,000” and “Activa Twin Pads - $56,000”.” Carried. 2. CSD-16-050 – NOISE EXEMPTION – FUZENATION – 41 ARDELT PLACE Council considered a recommendation arising from the Community and Infrastructure Services Committee meeting held earlier this date regarding a noise exemption request for the FUZEnation event at 41 Ardelt Place. A recorded vote was requested. Moved by Councillor S. Davey Seconded by Councillor D. Schnider “That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to the organizers of the FUZEnation event to be held at 41 Ardelt Place, on Thursday September 29, 2016 between the hours of 8:30 a.m. – 9:00 p.m. and on Friday September 30, 2016, between the hours of 8:30 a.m. and 11:00 p.m. This exemption is subject to the following conditions, which, if not complied with, will render the noise exemption null and void: a) There shall be no offensive language, in the opinion of City staff, generated from this music festival, audible in any adjacent residential neighbourhood. The event organizers will ensure that there is an on-site contact person accessible to correspond with City staff at all times during the event; b) The event organizer will be responsible for the cost of a pay-duty Noise Officer to be assigned specifically to this event; c) The event organizers agree to respond accordingly to requests from City staff, during the event in order to address community concerns that may arise with regard to the impact of noise heard within adjacent residential areas; d) The maximum decibel level (dba) audible from a residential area shall not exceed 65 dba; and, SPECIAL COUNCIL MINUTES SEPTEMBER 12, 2016 -158- CITY OF KITCHENER e) If. in the opinion of the investigating Officer, the bass is deemed to be excessive, the event organizer agrees to respond accordingly and adjust the level of bass output to a level where it is no longer a nuisance as outlined in Community Services Department report CSD-16-050," In Favour: Mayor B. Gazzola Motion Carried. 3. CSD-16-062 — NOISE EXEMPTION — 87 SHELDON AVENUE Council was requested to waive notice and consider a recommendation arising from the Community and Infrastructure Services Committee meeting held earlier this date regarding a noise exemption request. Moved by Councillor K. Galloway-Sealock Seconded by Councillor D. Schnider "That pursuant to Section 25.7.14 of Chapter 25 (Council Procedure) of the Municipal Code, Council waive the requirement for Notice of Motion with respect to a noise exemption request for 87 Sheldon Avenue." Carried with required 213 majority of Council. Moved by Councillor K. Galloway-Sealock Seconded by Councillor D. Schnider "That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to Margaret Hay for an outdoor birthday party at 87 Sheldon Avenue North between the hours of 8:30 p.m. and 11:00 p.m. on September 17, 2016 as outlined in Community Services Department report CSD-16-062." Carried. 4. BY-LAW FOR THREE READINGS Moved by Councillor Y. Fernandes Seconded by Councillor D. Schnid'er "That leave be given the Mover and Seconder to introduce a by-law to confiirm all actions and proceedings of the Council and that the same be taken as read a first, second and third times, be finally passed and numbered 2016-086 by the Clerk."
