HERITAGE KITCHENER MINUTES
SEPTEMBER 6, 2016 CITY OF KITCHENER
The Heritage Kitchener Committee met this date, commencing at 4:00 p.m.

Amendment - CSD-16-067 (HPA-2016-IV-006)

- PROPOSED SINGLE-CAR GARAGE
The Committee considered a memo dated August 18, 2016 from Mr. L. Bensason outlining an
amendment to Heritage Permit Application HPA-2016-IV-006 to permit construction of a
detached single car garage in the westerly side yard at 10 Sims Estate Place. In addition, the
Committee was in receipt this date of Community Services Department report CSD-16-067
recommending approval of the revised heritage permit application which reduces the size of
the garage originally proposed from a double-car to a single-car. Mr. L. Bensason presented
the Report which detailed the past consideration of the matter, and advised of the merits of the
revision noting staff have continued to work with the property owners and believe the potential
impact of a 1-car garage in the westerly side ward may be within acceptable range given its
small scale. Mr. Bensason noted Committee of Adjustment approval for a minor variance to
permit the structure within the 13m sideyard setback would still be required, in addition to
Mr. Graham White and Ms. Wendy Piwaworek gave a presentation in support of HPA-2016-IV-
006 which was revised from the original submission considered at the August 2, 2016 Heritage
Kitchener Committee meeting. The applicants reviewed the revisions and merits of their
submission noting the reduced footprint and scale of the one-car garage located on the
westerly sideyard preserves the view of the smokehouse and of the cottage from the east. In
addition, the revision allows the existing mature trees to remain as well as prevent the
necessary relocation of the sewer pump chamber in the easterly sideyard.
Members of the Committee expressed support for the revised proposal for a single car garage
in the westerly yard. In response to questions regarding the impact of the reduction in the scale
of the garage, Ms. Piwaworek indicated the length of the garage has been increased to provide
additional storage rather than impacting the vista.
Mr. P. Ciuciura expressed opposition to the revision noting the setback was established to
maximize the view of the house and landscape. He indicated relocating the pump chamber is
standard construction practice and pointed out that although trees can be replanted, once a
structure is built within the sideyard the view is gone permanently. He stated he continues to
support the easterly side yard as the preferred location for the garage.
On motion by Councillor J. Gazzola -
it was resolved:
That pursuant to Section 33 of the Ontario Heritage Act, Heritage Permit Application
HPA-2016-IV-006 as amended to permit construction of a detached single-car garage
on the property municipally addressed as 10 Sims Estate Place, be approved in
accordance with the plans and supplementary information submitted with the amended
application and subject to the following condition:
1. That the final building permit drawings be reviewed and heritage clearance
provided by Heritage Planning staff prior to the issuance of a building permit

- SHED DEMOLITION
The Committee considered Community Services Department report CSD-16-063, dated
August 18, 2016 recommending approval of Heritage Permit Application HPA-2016-V-019 to
permit demolition of shed at 170 Queen Street North. Ms. S. Parks presented the Report.Mr.
Jeff Wittich and Ms. Aileen Wittich were in attendance to respond to questions.
With regard to the process, Ms. Parks advised that if approved by unanimous consent, the
Heritage Permit Application would be approved through delegated authority.

On motion by Mr. B. Page -
it was resolved:
THAT pursuant to Section 42 of the Ontario Heritage Act, Heritage Permit Application
HPA-2016-V-019 be approved to permit demolition of an accessory structure on the
property municipally addressed as 170 Queen Street North, in accordance with the
plans and supplementary information submitted with the application and subject to the
following condition:
1. That the final building (demolition) permit drawings be reviewed and heritage
clearance provided by Heritage Planning staff prior to the issuance of a
building permit.
HERITAGE HOUSE PLAQUE PROGRAM MEMO FROM HERITAGE PROMOTION

SUB-COMMITTEE
The Committee considered a memorandum dated September 6, 2016 entitled Proposed
, highlighting an initiative of the Heritage Sub-Committee to
develop a heritage house plaque program. Ms. S. Parks introduced the item and reviewed the
material.
On motion by Mr. B. Page, the Committee agreed to support the further development of the
proposed Heritage House Plaque Program, with a more detailed report to be presented to
Heritage Kitchener for its approval in the future.

MEETING REPORT
Ms. S. Parks reviewed the activities of the Heritage Promotion Sub-Committee as outlined in
the August 2, 2016 meeting notes.
HERITAGE BEST PRACTICES - OPEN FORUM
5.
The Committee participated in a brief discussion regarding Heritage Best Practices. Mr. G.
Zeilstra reminded the Committee that the term of the appointments ends on November 30,
2016. Ms. D. Livingstone advised application forms for citizen appointment to committees are
available online at www.kitchener.ca and agreed to send an email to committee members.
