SUBJECT:Fence Variances – 87 Stanley Avenue and 901 Gravel Ridge

RECOMMENDATIONS:
“That the application of David and Alyanne Colyn (FN 2016-005 – 87 Stanley Avenue)
requesting permission to legalize a wood fence having a height of 1.8m (6’) located 0.6m
(1.968’) from the lot line abutting Tagge Street rather than the required 1.5m (4.92’), on Lot
BE APPROVED
97, Plan 1773, 87 Stanley Avenue, Kitchener, Ontario, , subject to the
following condition:
1. That the owner shall submit and obtain approval of a Landscape Plan from the
City’s Director of Planning. The landscape plan shall show landscaping to be
installed between the fence and the side lot line abutting Tagge Street. All
landscaping shall be completed by May 31, 2017 and shall be maintained in
accordance with the approved landscape plan.”

“That the application of Ammori Ganem-Mohamed (FN 2016-006 – 901 Gravel Ridge
Place) requesting permission to construct a wood fence having a height of 1.8m (6’)
located 0.62m (2.034’) from the lot line abutting Gravel Ridge Trail rather than the required
1.5m (4.92’) on Lot 68, Registered Plan 58M-544, 901 Gravel Ridge Place, Kitchener,
BE APPROVED
Ontario,, subject to the following condition:
1. That the owner shall submit and obtain approval of a Landscape Plan from the
City’s Director of Planning. The landscape plan shall show landscaping to be
installed between the fence and the side lot line abutting Gravel Ridge Trail. All
landscaping shall be completed by May 31st, 2017 and shall be maintained in
accordance with the approved landscape plan. ”

The Committee of Adjustment met as a standing committee of City Council on Tuesday,
September 20, 2016, to
consider two applications pursuant toChapter 630 (FENCES) of the
.
City of Kitchener Municipal Code
These recommendations are being forwarded to you on behalf of the Committee of
Adjustment for your consideration.
ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN:
The recommendations of this report support the achievement of the City’s strategic
vision through the delivery of core service.
Respecting Sign By-law and Fence By-law variances, the Committee of Adjustment
operates as a Standing Committee of City Council, and as such represents efficient and
effective government.
FINANCIAL IMPLICATIONS:
None
COMMUNITY ENGAGEMENT:
INFORM - As directed by the Sign By-law and Fence By-Law, notice of Applications for
Variance to the Sign By-law and Fence By-law are published in the Record 15 - 18 days
prior to the Committee of Adjustment meeting at which the application will be
considered. Notice of an application is also mailed to property owners within 30 metres
of the subject property.
INFORM - This report has been posted to the City’s website with the agenda in advance
of the council / committee meeting.
ENTRUST – The Committee of Adjustment is a Quasi-Judicial Committee of citizen
members operating as a Standing Committee of City Council.
