OF THE
CORPORATION OF THE CITY OF KITCHENER
(Being a by -law to amend Chapter 739 of The City of
Kitchener Municipal Code with respect to Fireworks and
Firecrackers.)
WHEREAS it is deemed expedient to amend Chapter 739 of The City of
Kitchener Municipal Code as adopted by By -law 88 -100;
NOW THEREFORE the Council of the Corporation of the City of Kitchener
enacts as follows:
1. Article 1 of Chapter 739 of The City of Kitchener Municipal Code is hereby
amended by deleting section 739.1.5 and replacing it with the following:
" "display" means the setting off of fireworks, but shall not include the setting off of
fireworks done on land appurtenant to a private residence by the owner or tenant of
such residence or a person authorized by him/her to do so provided it is done on
the following days:
a) Victoria Day or a day immediately preceding or succeeding
Victoria Day;
b) Canada Day or a day immediately preceding or succeeding
Canada Day; and
c) Diwali or a day immediately preceding or succeeding Diwali
except where a day immediately preceding or succeeding Diwali
falls on October 31 or November 11 in which case that preceding
or succeeding day shall be excluded and another day shall be
added to provide three successive days including Diwali from
which to select a day to set off Diwali fireworks."
2. Article 1 of Chapter 739 of The City of Kitchener Municipal Code is hereby
amended by adding the following definition thereto and renumbering the sections
thereof accordingly:
Diwali" shall mean the third day of the South Asian Diwali Festival on which the
main Diwali celebrations, including fireworks, normally take place."
2. Article 3 of Chapter 739 of The City of Kitchener Municipal Code is hereby
amended by deleting section 739.1 in its entirety and replacing it with the
following:

"No person shall sell any fireworks in the City on any day or days during the year
except on the six days immediately preceding Victoria Day, Canada Day, and
Diwali, provided that nothing in this section shall prevent the sale on any day for
the purpose of a fireworks display to a person who is the holder of a permit for
such display under section 739.4.2 hereof."
