TO ZONING BY-LAW 85-1

RECOMMENDATION:
That City-initiated amendment ZC16/005/COK/SRM (Annual Zoning By-law
Update) to Zoning By-law 85-1, be approved in the form shown
By-, 2016, attached to Report CSD-16-057.
REPORT:
An amendment to Zoning By-law 85-1 is proposed in order to improve administration
and provide clarification in certain areas of the By-law. The last Zoning By-law update
was approved in May 2015. A number of minor changes have been identified through
the daily use of the By-law by various City staff since that time.These changes are
minor and do not impact the comprehensive by-law review underway (CRoZBy). Some
of the changes are summarized below and all changes are
By-attached to this report.
1.Section 5.20 is proposed to be amended to require an eave encroachment of 0.5
metres, rather than 0.3 metres, to recognize the common eave size for single
detached dwellings. A 1.5 metre maintenance easement, inclusive of the 0.5
metre eave encroachment agreement, is still required and is not proposed to
change.
2. Section 5.31 regulates the location of food carts in the City. The proposed
update will clarify that a food cart is a small vehicle that is not occupied and is
used only used as a food stand.

3. Shipping containers are not currently regulated by the Zoning By-law and can be
located within any zone in accordance with regulations for other buildings.
Planning staff recommend adding a definition and a
new General Regulation, Section 5.32, to regulate shipping containers in
Residential zones.
4.Off-street Parking Regulation 6.3 f) in regards to Commercial Vehicles and
Equipment is amended to clarify that agricultural implements or commercial and
industrial equipment may be permitted to be stored within a building or structure
in a Residential zone provided that they are used for personal use and shall not
be related to a business.
5. Property addresses as shown on Map Nos. 1 to 4 and 6 (attached to the
proposed by-law) are modified to update mapping and/or remove redundant
Special Provisions that are either no longer on the property or have no current
relevance to the site.
6. 975 Strasburg (Map No. 5 attached to the proposed by-law) requires the
addition of aspecial regulation provision, 679R, to legalize the existing
undersized interior garage parking spaces on this property only. Access stairs
and dividing walls internal to the garages have resulted in parking spaces which
do not meet the minimum standard in the Zoning By-law.
The proposed Zoning By-law, which incorporates all of the changes, clarifications or
corrections noted above, will enable staff and the public using the By-law to be more
consistent in use and interpretation of the regulations.

UNDER SECTION 34 OF THE PLANNING ACT
2016 Annual Zoning By-law Update
The City of Kitchener is proposing a number of updates or minor revisions to the existing Zoning By-law 85-1. These
revisions represent improvements or clarifications to the By-law which will assist in the implementation and interpretation
of various sections. Most of the amendments apply to lands City-wide.
The public meeting will be held by the Planning & Strategic Initiatives Committee, a Committee of Council which deals
with planning matters, on:

Any person may attend the public meeting and make written and/or verbal representation either in support of, or in
opposition to, the above noted proposals. If a person or public body does not make oral submissions at this public
meeting or make a written submission prior to approval/refusal of these proposals, the person or public body is
not entitled to appeal the decision to the Ontario Municipal Board, and may not be added as a party to the
hearing of an appeal unless there are reasonable grounds in the opinion of the Board.

OF THE
CORPORATION OF THE CITY OF KITCHENER
(Being a by-law to amend By-law 85-1, as amended, known as the
Zoning By-law for the City of Kitchener City of Kitchener Annual
Zoning By-law Update)
WHEREAS it is deemed expedient to amend By-law 85-1, as amended;
NOW THEREFORE the Council of The Corporation of the City of Kitchener enacts as
follows:
1) Section 4.2 of By-law 85-1, the definition of is hereby amended by adding the
.
2) Section 4.2 of By-law 85-1, the definition of is hereby amended by:
a) deleting subsection iii) in its entirety.
3) Section 4.2 of By-law 85-1 is hereby amended by adding the following new definition in proper alphabetical
order:
means a vessel commonly or specifically designed for transportation of freight
goods or commodities and shall include, but not be limited to, cargo containers and truck trailers.
4) Section 5.5.2 a) of By-law 85-1, in a required
interior side yard; provided, however, no parts thereof may encroach beyond the lot line. This
subsection shall not apply to an exterior side yard abutting a street.
5) Section 5.6.2 b) of By-law 85-1 is hereby amended by replacing the number

SHIPPING CONTAINERS
.1Ashipping container shall only be temporarily permitted in the driveway of a residentially
zoned property for a period not exceeding thirty (30) days in any given year, provided
that the shipping container is located wholly within a lot and must be set back a minimum
of 0.5 metres from the front lot line.
.2 Notwithstanding Section 5.32.1, a shipping container shall not be permanently permitted
on any property that is residentially zoned for a period exceeding thirty (30) days in any
given year, except where it is used as construction material for a residential dwelling,
subject to the Ontario Building Code and all regulations of the applicable zone.

1) with Special Regulation Provision 1R and Special Use Provision 83U to Neighbourhood Institutional
Zone (I-1) with Special Regulation Provision 1R;
b) Area 2 on Map No. 2 in the City of Kitchener, attached hereto, from Neighbourhood Institutional Zone (I-
1) with Special Regulation Provisions 1R and 93R and Special Use Provision 83U to Neighbourhood
Institutional Zone (I-1) with Special Regulation Provisions 1R and 93R;
c) Area 3 on Map No. 2 in the City of Kitchener, attached hereto, from Neighbourhood Institutional Zone (I-
