HomeMy WebLinkAboutFCS-17-005 - Encroachment for Elevators - 10 King REPORT TO: Council DATE OF MEETING: January 9, 2017 SUBMITTED BY: Erin Mogck, Associate City Solicitor 519-741- 2200 ext. 7060 PREPARED BY: Erin Mogck, Associate City Solicitor 519-741- 2200 ext. 7060 WARD(S) INVOLVED: 10 DATE OF REPORT: December 29, 2016 REPORT NO.: FCS-17-005 SUBJECT: Encroachment Agreement for Elevator Access – City of Kitchener to encroach over 8 Queen Street North ___________________________________________________________________________ RECOMMENDATION: “That the Mayor and Clerk be authorized to execute an Encroachment Agreement, satisfactory to the City Solicitor, with 8 Queen Inc. to allow for the installation of a cantilevered walkway platform over the roof of 8 Queen Street North for access to City owned elevator banks.” BACKGROUND: The Corporation of the City of Kitchener owns the property at 10 King Street West, currently occupied by THEMUSEUM. There are elevators located within the building at 10 King Street West that have recently been inspected by the Technical Standards and Safety Authority (TSSA). The TSSA has ordered the Corporation of the City of Kitchener to provide roof top access to these elevators. The TSSA rule essentially states that all roof access to elevator machine rooms must have a guarded walkway. Previously, a compliant walkway existed across the roof at 8 Queen Street North, and elevator technicians would have to walk across the roof on this walkway. However, when the property owner of 8 Queen Street North wanted to replace the roof of their building within the last year, the owner requested part of the wood walkway be removed by City staff. Since the pressure treated wood walkway was previously built across the adjacent property as a courtesy to the City, the City wishes to extend the same consideration to 8 Queen Inc. The section of the walkway that was removed will be rebuilt cantilevered over the roof so as not to affect the neighbour’s new roof. *** This information is available in accessible formats upon request. *** Please call 519-741-2345 or TTY 1-866-969-9994 for assistance. 1. - 1 REPORT: The proposed cantilevered walkway for access to the elevator banks is the optimal solution for both property owners of these adjacent properties. The neighbouring property owner has been in consultation with the City and is amenable to this proposal. The City has engineered drawings for the proposed structure. It will be a galvanized steel access platform with guard rails. The platform will be 3 feet 3 inches wide and 9 feet 3 inches in length. The cantilevered walkway for access to the elevator banks is necessary for the City of Kitchener to be compliant with the TSSA regulations. The design of the walkway will physically be over the top of the roof, but not touching the roof. The City has applied for a building permit to build the structure, which is dependent on the completion of this encroachment agreement. The cantilevered walkway must be constructed by February 26, 2017 for the City to be compliant. Furthermore, the City will be responsible for the maintenance of the structure. ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: The recommendation outlined in this report supports the achievement of the city’s strategic vision through the delivery of core service. FINANCIAL IMPLICATIONS: The cost to install the galvanised steel is approximately $32,000 and will be funded from THEMUSEUM capital account. Non-compliance with the TSSA regulations may result in additional costs. COMMUNITY ENGAGEMENT: INFORM – This report has been posted to the City’s website with the agenda in advance of the Standing Committee.
