BACKGROUND: Midway events are licensed within The City of Kitchener by Municipal Code Chapter 542 – Exhibition, Circus, Midway or Carnival as well as Council Policy I-920 – Midway Location – Notice. Council Policy I-920 (the Policy) requires that prior to the approval of an application for a midway location licence under Municipal Code Chapter 542 (Chapter 542), the proposed site and details such as the dates and hours of operation be brought before the Finance and Corporate Services Committee. Furthermore, the Policy requires the applicant to notify residents within 120 metres of the proposed midway location of the hours and dates of operation. This process allows neighbouring residents to express any concerns they might have and provides staff with an opportunity to potentially address those concerns. In the past, certain conditions have also been put into place with respect to granting licenses for midways in order to alleviate noise concerns residents in the surrounding area might have. REPORT: Correspondence has been received from Linda Homeniuk, Vice President of Homeniuk Rides Incorporated, requesting permission to operate a midway at 100 The Boardwalk (Ira Needles Blvd), from May 25 to May 28, 2017 and September 28 to October 1, 2017. The midway will be located in the Wal-Mart location parking lot. As directed in Chapter 542, the Region of Waterloo Public Health office and the City of Kitchener Operations Division have been advised of this midway request. No concerns have been indicated by either. Inspections from Region of Waterloo Public Health office as well as approvals from the Planning and Operations Divisions are a requirement before the official licence can be issued to the operator. Ms. Homeniuk has been provided with the mailing labels for the 120-meter notification requirement. The notification was sent on February 3, 2017 as reported by Ms. Homeniuk. No comments have been received by the deadline for submitting this report. Any comments received after the submission of this report will be forwarded for Council’s consideration prior to the March 20, 2017 Council meeting This Midway has been operating in the City of Waterloo area of The Boardwalk plaza for the past four years. In 2016, the Midway requested their first licence within the City of Kitchener boundaries. No complaints were received about the event. In addition, all proceeds from this year’s Midway will be donated to the Women’s Crisis Services. As part of the 2017 Comprehensive Business Licensing Review, Chapter 542 and the associated Policy and processes for midway event applications will be evaluated for efficiency and effective city services, as well as, customer service enhancements. ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: The recommendation of this report supports the achievement of the city’s strategic vision through the delivery of core service. 3 - 2 FINANCIAL IMPLICATIONS: The business licensing fee for a midway event licence is $525.00. COMMUNITY ENGAGEMENT: Inform – This report has been posted to the City’s website with the agenda in advance of the council / committee meeting. Consult – Ms. Homeniuk has notified the area residents as per the 120-metre requirement. Through the notification process residents who have concerns have been invited to contact the Manager of Licensing to express their concerns prior to the Council meeting on March 20, 2017.
