SUBJECT: Noise Exemption Victoria Street North Bridge Utility
Relocation (MTO)

RECOMMENDATION:
That the Ministry of Transportation, Ontario (MTO) and its contractor(s) be
exempt from the provisions of Chapter 450 Noise of the City of Kitchener
Municipal Code Article 6 Construction Work during the Utility Relocations for the
bridge replacement and road rehabilitation project on Highway 85 at Victoria
Street North in the City of Kitchener. The request for the noise by-law exemption
is between the hours of 7:00 p.m. and 7:00 a.m. and is requested to be extended
for the period of April 30, 2017 to October 20, 2017.
BACKGROUND:
The Ministry of Transportation of Ontario (MTO) has engaged the MMM Group to
complete the design and tender award for the relocation of utilities and services through
the bridge replacement and road rehabilitation project for the Victoria Street North
bridge spanning over Highway 85.
This project will include the utility and services relocation work for an impending 2018
reconstruction of the Victoria Street North bridge structure for further Highway 85
widening and improvements. Due to the significant traffic volumes experienced during
daytime periods, it has been requested to complete this work during evening and
overnight hours.

The bridge installation is slated for early 2018 and is a part of the comprehensive plan
to install the new controlled access Highway 7between Kitchener and Guelph. The
new bridge cannot be installed until the utility relocations are complete. The schedule
for the existing Victoria Street North bridge demolition and construction of the new
bridge work is contingent upon the completion of the utility relocations. The contractor
will elect to work around the clock to meet the contract schedule.
In January, 2016, Council approved report INS-16-002, providing the Ministry of
Transportation, Ontario and its contractors with a noise exemption from March 1, 2016
through April 30, 2017 to complete this work. This report serves to request an extension
to this noise exemption until October 20, 2017.
REPORT:
The majority of the area surrounding the proposed work site is commercial businesses;
therefore noise impacts will be minimal. The noise source nearest to the residential
areas will be within the MTO right of way close to the highway traffic flow. The majority
of the construction noise will be generated below the top of the bank on both sides of
the highway.
Noise created by the utility relocation works will be mostly bulldozers, scrapers, cranes,
excavators. The materials will be delivered to the site during regular hours of 7:00 a.m.
to 7:00 p.m.
The provision of this requested noise exemption will assist in minimizing the duration of
the closure of Victoria Street North, thereby reducing the impact on the motoring public,
as well as ensuring that the New Highway 7 project maintains appropriate timelines.
Due to project delays in property acquisitions and late tendering, the previous INS-16-
002 report for the existing noise exemption approved in 2016 (valid March 1, 2016 to
April 20, 2017) is requested to be extended to October 20, 2017 in order meet updated
scheduling.
ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN:
This recommendation of this report supports the achievement of the c
vision through the delivery of core service.
FINANCIAL IMPLICATIONS:
None.

COMMUNICATIONS:
MMM Group will notify businesses and residents within 400
metres of the Victoria Street North bridge in advance of the construction. Details in the
letter will include the description of the construction work, duration of the work along
with 24 hour contact information for the public.
