Bunn, Committee Administrator Pursuant to Chapter 25 (Procedure) of the Municipal Code, a motion was brought forward by Councillor S. Marsh to discuss Item 5, and Councillor F. Etherington to discuss Item 8, listed on the Agenda as Consent items, which were voted on and Carried. 1. INS-17-003 WILSON AVENUE BIKE LANE IMPLEMENTATION The Committee considered Infrastructure Services Department report INS-17-003, dated March 15, 2017 regarding the installation of on-street bicycle lanes on both sides of Wilson Avenue and the proposed on-street parking changes. Mr. Ray Hart was in attendance to speak in opposition to the recommendation outlined in Report INS-17-003, expressing concerns related to existing deterioration of the road surface and high vehicle speeds on Wilson Avenue. He questioned the timing of installation of cycling lanes, noting the road will be reconstructed in 2022. He suggested that alternatively the recommendation be deferred until road improvements are made. In response to questions regarding the quality of the road surface on Wilson Avenue, Mr. K. Carmichael indicated that through coordination with Operations and Transportation Services Divisions, improvements are generally made to the road surface before cycling lanes are installed. He indicated that there are many examples of functional bike lanes on poor quality road surfaces that are well used. He noted that staff will continue to study the area for functionality and usage. In response to further questions, Mr. Carmichael advised that under the current design, additional space for the cyclist lane would not be possible. He noted that a rebuild of the road could consider wider lanes; however, an additional cost would be associated with expanding the road surface. On motion by Councillor Y. Fernandes - it was resolved: That on-street bicycle lanes be installed on both sides of Wilson Avenue from Kingsdale Community Centre to Traynor Avenue; and, That on-street parking be prohibited on the north side of Wilson Avenue between Kingsdale Community Centre and Traynor Avenue; and further, That the Uniform Traffic Bylaw be amended, as outlined in Infrastructure Services Department report INS-17-003. COMMUNITY &INFRASTRUCTURE SERVICES COMMITTEEMINUTES APRIL 3, 2017 - 18 - CITY OF KITCHENER 2. CSD-17-023 NAMING OF PRIVATE STREETS 900 ORR COURT MATTAMY HOMES LIMITED The Committee considered Community Services Department report CSD-17-023, dated February 10, 2017 regarding the naming of private streets within the proposed multiple residential development located at 900 Orr Court. On motion by Councillor F. Etherington - it was resolved: name private streets within the proposed multiple residential development located at 900 Orr Court, as outlined in Community Services Department report CSD-17-023; and further, preparation and registration of the necessary Bylaw(s) for the naming of the private 3. INS-17-024 ON-STREET PARKING REGULATIONS INLET AVENUE The Committee considered Infrastructure Services Department report INS-17-024, dated March 8, 2017 recommending approval of a stopping prohibition from Monday to Friday, September 1 to June 30 on the east side of Inlet Avenue. On motion by Councillor F. Etherington - it was resolved: a.m. and, 2:30 p.m. to 4:00 p.m. from Monday to Friday between September 1 and June 30 on the east (odd-numbered) side of Inlet Avenue between Owen Avenue and Hickson Drive, as outlined in Infrastructure Services Department report INS-17- 4. INS-17-025 NOISE EXEMPTION VICTORIA STREET NORTH BRIDGE UTILITY RELOCATION (MTO) The Committee considered Infrastructure Services Department report INS-17-025, dated March 10, 2017 recommending approval of a noise exemption for the Victoria Street North Bridge Utility Relocation project. In response to questions, Mr. K. Carmichael explained that based on the current policy for noise exemption; there are no restrictions on the time of day that loud noise is permitted. He indicated that generally, the Ministry of Transportation is conscientious of the neighbourhoods that work is being completed in and attempts to limit the amount of essential work in the evening. On motion by Councillor F. Etherington - it was resolved: Ontario (MTO) and its contractor(s) be exempt from the provisions of Chapter 450 (Noise) of the City of Kitchener Municipal Code Article 6 Construction Work during the Utility Relocations for the bridge replacement and road rehabilitation project on Highway 85 at Victoria Street North in the City of Kitchener between the hours of 7:00 p.m. and 7:00 a.m., and extended for the period of April 30, 2017 to October 20, 2017, as outlined in Infrastructure Services Department report INS- 17- 5. INS-17-028 PARK NAMING 11 GORDON AVENUE The Committee considered Infrastructure Services Department report INS-17-028, dated March 20, 2017 regarding the naming of a park on Gordon Avenue. COMMUNITY &INFRASTRUCTURE SERVICES COMMITTEEMINUTES APRIL 3, 2017 - 19 - CITY OF KITCHENER 5. INS-17-028 PARK NAMING 11 GORDON AVENUE On motion by Councillor F. Etherington - it was resolved: nue, be named Gordon Green; and further, That staff be directed to install the standard park identification sign, as outlined in Infrastructure Services Department report INS-17-028 6. CSD-17-029 ZONE CHANGE APPLICATION ZC17/001/V/JVW 98, 100, 100½, 110 VICTORIA STREET SOUTH AND 55 BRAMM STREET 2373074 ONTARIO LIMITED (MOMENTUM DEVELOPMENTS) Councillor P. Singh declared a pecuniary interest with respect to zone change application ZC17/001/V/JVW as members of his family own property in close proximity to the subject lands; accordingly, he did not participate in any discussions or voting regarding the application. The Committee considered Community Services Department report CSD-17-029, dated March 6, 2017 recommending approval of Zone Change Application ZC17/001/V/JVW, for lands located at Victoria Street South and Bramm Street, for the purpose of removing Holding Provision 73H. In addition, the Committee was in receipt this date of a revised Appendix A Map No. 1. In response to questions, Mr. M. May, Deputy CAO, Community Services, indicated the map was revised to reflect a more accurate subject area in relation to the frontage along Victoria Street. On motion by Councillor F. Etherington - it was resolved: That Zone Change Application ZC17/001/V/JVW for 98, 100, 100½, 110 Victoria Street South and 55 Bramm Street 2373074 Ontario Limited (Momentum Developments) for the purpose of changing the zoning by removing Holding Provision 73H from the lands specified in the attached Map No.1, as outlined in Community Services Department report CSD-17- 7. CSD-17-028 - NOISE EXEMPTIONS DOWNTOWN SPECIAL EVENTS The Committee considered Community Services Department report CSD-17-028, dated March 13, 2017 recommending approval of a noise exemption for various Downtown Special Events. Councillor P. Singh clude three additional events: July 6, Goudies Block Party #2, and July 12 and August 16, Apollo Cinema Under the Stars. On motion by Councillor F. Etherington - it was resolved: That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be Services Department report CSD-17-028, with the addition of the following: July 6, Goudies Block Party #2 from 6:00 p.m. to 10:00 p.m., and July 12 and August 16, Apollo Cinema Under the Stars from 8:00 p.m. to 11:00 p.m. 8. CSD-17-017 KITCHENER FIRE DEPARTMENT MASTER PLAN, 2017-2022 The Committee considered Community Services Department report CSD-17-017, dated February 16, 2017 recommending approval of the Kitchener Fire Department Master Plan (KFDMP) as the Kitchener Fire . COMMUNITY &INFRASTRUCTURE SERVICES COMMITTEEMINUTES APRIL 3, 2017 - 20 - CITY OF KITCHENER 8. CSD-17-017 KITCHENER FIRE DEPARTMENT MASTER PLAN, 2017-2022 Prior to the meeting, an email was circulated to the Committee members from Mr. M. May on behalf of the Fire Chief requesting a deferral, as he was unable to attend the April 3, 2017 meeting. On motion by Councillor S. Davey - it was resolved: n of the following motion be deferred to the May 1, 2017 Community and Infrastructure Services Committee Meeting: That the Kitchener Fire Department Master Plan (KFDMP) attached as Appendix A to Community Services Department report CSD-17-017, be approved as the guiding document for the Kitchener Fire Department; and that staff be directed to refer implementation of the strategic and operational actions to the departmental business planning process as applicable 9. CSD-17-014 DELEGATED AUTHORITY FOR SMALL-SCALE NOISE EXEMPTIONS The Committee considered Community Services Department report CSD-17-014, dated March 9, 2017 recommending delegation of authority to Bylaw Enforcement staff to provide noise exemptions for small private events or public neighbourhood events. Ms. G. MacNeil was in attendance and responded to questions from the Committee. On motion by Councillor F. Fernandes - it was resolved: That Bylaw Enforcement staff be delegated the authority to provide noise exemptions for small private events or public neighbourhood events, as outlined in Community Services Department report CSD-17- 10. BREITHAUPT PARK BALL DIAMOND IMPROVEMENTS UPDATE In response to questions, Ms. C. Fletcher indicated that in order to get the lights installed this fall, direction would need to be given prior to August 31, 2017. On motion by Councillor S. Marsh - it was resolved: That consideration of the following motion be deferred to a meeting prior to August 31, 2017; to allow time for the implementation of measures to mitigate concerns raised by area residents in advance of the lighting installation being considered by Council: That lights be installed at two ball diamonds in Breithaupt Park to address the immediate need for ball diamond inventory and to begin to close the gap between demand and availability of diamond inventory as part of a longer-term, city-wide ball diamond inventory management strategy, as outlined in Infrastructure Services Department report INS-17-008 The Committee recessed at 10:48 a.m. and reconvened at 2:02 p.m. chaired by Councillor B. Ioannidis with all members present. 11. INS-17-023 ON-STREET PARKING REGULATIONS FORFAR AVENUE The Committee considered Infrastructure Services Department report INS-17-023, dated March 5, 2017 recommending a parking prohibition on the east side of Forfar Avenue. On motion by Councillor Y. Fernandes - it was resolved: COMMUNITY &INFRASTRUCTURE SERVICES COMMITTEEMINUTES APRIL 3, 2017 - 21 - CITY OF KITCHENER 11. INS-17-023 ON-STREET PARKING REGULATIONS FORFAR AVENUE That the Uniform Traffic Bylaw be amended to prohibit parking at any time on the east (odd numbered) side of Forfar Avenue from Rothsay Avenue to a point 230 metres south of Rothsay Avenue, as outlined in Infrastructure Services Department report INS- 17-023. 12. CAO-17-014 2016 ARTIST-IN-RESIDENCE COMMISSION The Committee considered report CAO-17-014, dated February 17, 2017 recommending approval -in- Residence, Sarah Granskou. Ms. S. DiDonato presented the staff report. Ms. Sarah Granskou addressed the Committee in support of the staff recommendation and thanked the City for the opportunity to be the 2016 Artist-in-Residence. On motion by Councillor Y. Fernandes - it was resolved: -in-Residence, Sarah CAO-17- 014; and further, That the Mayor and Clerk be authorized to execute the Artist-in-Residence 2016 Commission Agreement with Sarah Granskou, in a form satisfactory to the City Solicitor, such agreement encompassing the terms set out in Report CAO-17-014 13. CSD-17-027 NOISE EXEMPTION REQUEST EVER AFTER MUSIC FEST - BINGEMANS The Committee considered Community Services Department report CSD-17-027, dated March 13, 2017 recommending approval of a noise exemption for Ever After Music Festival, being held at Bingemans Centre on June 2, 3, and 4, 2017. Ms. Minto Schneider, Waterloo Region Tourism Marketing Corp., addressed the Committee in support of the staff recommendation. She presented statistics indicating the Ever After Music Festival has contributed to an increase in hotel occupancy. She noted this demonstrates the Mr. Rob Mattacchione, Beyond Oz Productions, spoke in support of the requested noise exemption, advising only seven noise complaints were received last year compared to the 57 complaints received in 2015. He stated awareness of the Festival continues to grow, particularly in the United States with ticket sales being generated in over 30 states. He noted that while other festivals are in decline, the Ever After Music Festival has significant positive momentum. In response to questions, Mr. Mattacchione advised it would be detrimental to the Festival if they were required to shut down prior to 11:00 p.m. on Sunday, adding the Saturday and Sunday shows are critical to developing brand awareness. He commented that Waterloo Region is fostering a good reputation as a destination to which artists want to travel. Responding further, he indicated that in 2016 with the exception of one brief spike, noise readings never exceeded 65 dBA, which was the permitted decibel level approved by Council. He estimated the overall economic impact of the Festival to date at approximately $20M. The following motion was voted on and was Carried Unanimously on a recorded vote by all members present. On motion by Councillor Y. Fernandes - it was resolved: COMMUNITY &INFRASTRUCTURE SERVICES COMMITTEEMINUTES APRIL 3, 2017 - 22 - CITY OF KITCHENER 13. CSD-17-027 NOISE EXEMPTION REQUEST EVER AFTER MUSIC FEST - BINGEMANS That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted for the Ever After Music Festival, to be held at Bingemans Centre on June th 2, 3 and 4, 2017, between the hours of 11:00 a.m. and 11:00 p.m., each day, subject to the following conditions, which, if not complied with, will render the noise exemption null and void: a) There shall be no offensive language, in the opinion of City staff, generated from this music festival, audible in any adjacent residential neighbourhood. b) The event organizers will ensure that there is an on-site contact person accessible to correspond with City staff at all times during the event; and c) The event organizers agree to respond accordingly to requests from City staff, during the event, in order to address community concerns that may arise with regard to the impact of noise heard within adjacent residential areas. d) The maximum decibel level (dba) audible from a residential area shall not exceed 65 dba. e) The event organizer will be responsible for the cost of a paid-duty Noise Officer, to be assigned specifically to this event which shall be paid in full prior to the Council date of April 17, 2017. The Committee recessed at 2:39 p.m. and reconvened at 2:40 p.m. chaired by Councillor B. Ioannidis with all members present. 14. CSD-17-030 AGE-FRIENDLY KITCHENER-DRAFT ACTION PLAN The Committee considered Community Services Department report CSD-17-030, dated March 16, 2017 regarding the endorsement of the draft Age-Friendly Kitchener Action Plan. Mr. Doug McKlusky, Age Friendly Community Advisory Committee, presented the Action Plan, advising that since 2015, staff with the assistance of the Advisory Committee, has engaged the -friendly assets and to determine opportunities for further improvements. He added approximately 1200 residents were engaged as a part of this process, adding they indicated that it was important to be able to age in their own neighbourhoods but policies, services and supports were required to enable them to do so. He noted moving forward a comprehensive implementation plan will outline the actions that will be addressed over the next five years. He commented that the priorities outlined in the Age- Friendly Kitchener Action Plan mirror and support those set out in the recently approved Neighbourhood Strategy. On motion by Mayor B. Vrbanovic - it was resolved: That the draft Age- Community Services Department report CSD-17-030, be endorsed as the City of -friendly planning, decision making and program/service delivery for older adults; and further, That the implementation of the draft Action Plan be referred to the corporate business 15. INS-17-026 CYCLING MASTER PLAN AND BIKEKITCHENER UPDATE The Committee considered Infrastructure Services Department report INS-17-026, dated March 10, 2017 recommending endorsement of the Cycling in Kitchener The 2016 report, and direction to prepare a similar report every two years. COMMUNITY &INFRASTRUCTURE SERVICES COMMITTEEMINUTES APRIL 3, 2017 - 23 - CITY OF KITCHENER 15. INS-17-026 CYCLING MASTER PLAN AND BIKEKITCHENER UPDATE Mr. D. Pimentel gave a presentation updating the Committee on both the infrastructure implemented and the BikeKitchener programming over the past two years. He indicated that new cycling infrastructure was implemented on 22 roadways in 2015 and 2016, adding 34 roadways are proposed to receive new infrastructure over the next two years. He reviewed the positive feedback received for a number of the program initiatives, particularly Bikecheck, which parked 1261 bicycles in 2016. The following motion was voted on and was Carried Unanimously on a recorded vote by all members present. On motion by Councillor S. Marsh - it was resolved: - Infrastructure Services Department report INS-17-026, be endorsed; and further, That a similar report be prepared every two (2) years, to coincide with the BikeKitchener 16.
