BACKGROUND: Midway events are licensed within The City of Kitchener by Municipal Code Chapter 542 Exhibition, Circus, Midway Or Carnival as well as Council Policy I-920 Midway Location Notice. Council Policy I-920 (the Policy) requires that prior to the approval of an application for a midway location licence under Municipal Code Chapter 542 (Chapter 542), the proposed site and details such as the dates and hours of operation be brought before the Finance and Corporate Services Committee. Furthermore, the Policy requires the applicant to notify residential properties, if applicable, within 120 metres of the proposed midway location of the hours and dates of operation. REPORT: Correspondence has been received from Cosimo Gravina of Ever After Music Festival requesting permission to operate a midway at 425 Bingemans Centre Drive, from June 2 to June 4, 2017. The midway will be located behind the stage in the area next to the water park entrance of the Bingemans property.The Ever After Music Festival has changed the times of the midways to begin operation later in the day on the Saturday and Sunday. This year the midway will begin operation at 1:00 p.m. which is different than previous year in which the midway began at 11:00 a.m. The midway will end at the same time as previous years. As directed in Chapter 542, the Region of Waterloo Public Health office and the City of Kitchener Operations Division have been advised of this midway request. No concerns have been indicated by the Region of Waterloo Public Health office. The City of Kitchener Operations division has advised the midway operator must manage all refuse receptacles onthe private property andthe midway operator is responsible for the collection and disposal of the debris. As such, Operations staff will not be providing any sanitation service for the midway.Inspections from Region of Waterloo Public Health office and approvals from the Planning Division remain a requirement before the licence can be issued to the operator. The Fire Division,aBusiness Licensing Inspector, Manager of Special Events, and the Manager of Licensing will all attend before and during the event to inspect and ensure compliance. As per the policy, licensing staff completed the 120-meter calculation and it returned zero residential properties; thus, no notification is needed for this licence. In 2016, the midway, which was only a Ferris wheel, was operated at the Ever After music festival. No complaints specific to the midway were received by staff, although there were several noise complaints received for other aspects of the 3-day festival. The Bylaw Enforcement Division is working with the applicant to address noise issues from the concert portion of the festival. The noise exemption for the entire festival is expected to be received by Council on April 24, 2017. In addition, as part of the 2016-2017 Comprehensive Business Licensing Review, Chapter 542 and the associated Policy and processes for midway events will be evaluated for efficiency and effective city services as well as customer service enhancements.
