McCormick, Manager Parking Enterprise,519-741-2200 x7155 WARD(S) INVOLVED:10 DATE OF REPORT:April 12, 2017 REPORT NO.:INS-17-039 SUBJECT:ParkingAgreement with Her Majesty the Queen, in right of Canada, as represented by the Minister of Public Works and Government Services ___________________________________________________________________________ RECOMMENDATIONS: Thatthe Chief Administrative Officer or a Deputy Chief Administrative Officer be authorized to execute anew extensionparking agreement with Her Majesty the Queen, in right of Canada, as represented by the Minister of Public Works and Government Servicesto operate public parking at 166 Frederick Street during events at The Centre in the Square property for ten (10)years, with a right to terminate by either party on sixty (60) days’ notice and with amonth to month renewal option thereafter, said agreement to be to the satisfaction of the City Solicitor; andfurther, That Council delegate authority to Chief Administrative Officer or a Deputy Chief Administrative Officer to execute future or renewal agreementswith respect to public parking at 166 FrederickSt., said agreements to be to the satisfaction of the City Solicitor. BACKGROUND: The Parking Enterprise provides parking services in and around The Centre in the Square property for various theatre events. The parking facilities include both surface lots and the Civic District Garage underground facilities. The majority of surface lot spaces including 166 Frederick Street produces a premium parking rate of $9.00 and the remaining spaces including the garage earns the standard rate of $7.50. The City of Kitchener (the “City”) has had a long standing business relationship since August1980 with Her Majesty the Queen, in right of Canada, as represented by the *** This information is available in accessible formats upon request. *** Please call 519-741-2345 or TTY 1-866-969-9994 for assistance. 2.- 1 Minister of Public Works and Government Services (PWGS) in the management of the parking area behind 166 Frederick Street during events at The Centre in the Square property (CITS). As compensation to PWGS for the City’s use of the parking lot during events at The Centre in the Square, the City agreed to provide a complete service for snow plowing, snow removal and de-icing of the parking lot and municipal sidewalks fronting on Frederick and Otto Streets. The City also assumes liability which may arise out of or in connection with the entry onto and use of the parking lot by the City, during events at The Centre in the Square. This arrangement has continued on a month to month basis since the commencement of the agreement in 1980. 2. - 2 The surface parking lot at 166 Frederick Street comprisesapproximately 49spacesand premium rate spacesare used by customers of the CITS for theatre performance nights. There are 596off-street parking spaces in the immediate area of the CITS managed by the Parking Enterprise of which 31% or 184 are surface spaces. The 412 spaces with in the Civic District Garage make up the difference. The surface spaces continue to be very popular with parking customers during CITS theatre nights. REPORT: PWGS has recently approached the City to renew the agreement for a term of tenyears with a right to terminate by either party on sixty (60) days’ notice.Staff’s recommendation is to renewand formalize an existing agreement. Key terms of the agreement include offsetting use of the parking lot on CITS performance nights in exchange for snow removal and de-icing services by the City. Regular maintenance of the surface lot including asphaltrepairs and line painting is provided by PWGS. ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: The recommendation of this report supports the achievement of the city’s strategic vision through the delivery of core service. FINANCIAL IMPLICATIONS: ThePWGS lot at 166 Frederick on average generates $25,000 per annum in gross income from gate receipts from Theatre nights. A net income of approximately $8,000 per annum is earnedafter deducting part-time staff wagesandsnow clearing expenses. Although the net income for this lot is not asignificantamount,the proximity location of this lot to CITS servesamuch needed purpose in supplying convenient parking forour customers on Theatre nights.
