HomeMy WebLinkAboutFCS-17-117 - Encroachment Agreement - Rogers Communications REPORT TO:Committee of the Whole DATE OF MEETING:June 5, 2017 SUBMITTED BY:Erin Mogck, Associate City Solicitor 519-741- 2200 ext. 7060 PREPARED BY: Erin Mogck, Associate City Solicitor 519-741- 2200 ext. 7060 WARD(S) INVOLVED: 3 DATE OF REPORT:May 24, 2017 REPORT NO.:FCS-17-117 SUBJECT:Encroachment AgreementRequest – Rogers’ vaults and ducts to be installed at Shelley Drive and Vanier Drive ___________________________________________________________________________ RECOMMENDATION: “That the Mayor and Clerk be authorized to execute an Encroachment Agreement, satisfactory to the City Solicitor, with Rogers CommunicationsInc. to allow for the installation of new ducts and vaultsoverCity of Kitchener land at the corner of Shelley Drive and Vanier Drive.” BACKGROUND: Rogers Communications Inc. approached the City of Kitchener for permission to install and maintain fibre optic cables, including ducts and vaults, within the boundary of Vanier Park. REPORT: Rogers Communications Inc. requests permission to enter onto City Land at the corner of Shelley Drive and Vanier Drive to place 20 metres of new ducts and install two GLB3660 vaults (36” Lengthx 60” Widthx 36” Depth; or 0.91m Length x 1.52m Width x 0.76m Depth), as well as a cabinet on one of the vaults (24” Depthx 32” Width x 48” Height; or 0.61m Depthx 0.82m Widthx 1.22m Height) for the purposes of sustaining service to their customers. The location of the work is within greenspace of Vanier Park. Through the encroachment circulation process, the Grand River Conservation Authority was contacted. The subject area is regulated because a floodplain is present. Since the installation of new services and the associated temporary works are considered development under the Conservation Authorities Act, Rogers Communications Inc. applied for a permit from the Grand River Conservation Authority. The Grand River Conservation Authority has approved theproposed work by Rogers Communications Inc. and the creek areawill be protected. *** This information is available in accessible formats upon request. *** Please call 519-741-2345 or TTY 1-866-969-9994 for assistance. 4.- 1 There were no other concerns from any other parties circulated. Furthermore, Rogers Communications Inc.will be responsible for the maintenance of the structures. ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: The recommendation outlined in this report supports the achievement of the city’s strategic vision through the delivery of core service. FINANCIAL IMPLICATIONS: Fees for the encroachment agreement have been paid in accordance with the City’s Fee Schedule. The annual fee for encroaching onto parkland or greenspace will become payable once the agreement is authorized by Council. COMMUNITY ENGAGEMENT: INFORM – This report has been posted to the City’s website with the agenda in advance of the Standing Committee.
