Singh to discuss Item 1, and by Mayor B. Vrbanovic to discuss Item 8 listed on the Agenda as Consent items, which were voted on and Carried. CSD -17-037 - NOISE EXEMPTION — HOLY TRINITY SERBIAN CHURCH - 700 FISCHER HALLMAN ROAD: MAY 28. 2017. JULY 29 & 30. 2017 The Committee considered Community Services Department report CSD -17-037, dated April 5, 2017 recommending approval of a noise exemption for two festivals at Holy Trinity Serbian Church, being held May 28th and July 29th & 30th, 2017. Members raised concerns relating to: garbage collection during and after the festivals, and illegal parking. Ms. G. MacNeil noted she would express the concern to the event organizers. On motion by Councillor Y. Fernandes - it was resolved: "That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to the Holy Trinity Serbian Orthodox Church at 700 Fischer Hallman Road, for two (2) festivals to be held on May 28, 2017 and, July 29 and July 30, 2017, between the hours of 11:00 a.m. and 11:00 p.m., as outlined in Community Services Department report CSD -17-037." CSD -17-038 - NOISE EXEMPTION — CONSTRUCTION WORK - 286 KINGSWOOD DRIVE: JUNE 21, 2017 & AUGUST 9, 2017 The Committee considered Community Services Department report CSD -17-038, dated April 5, 2017 recommending approval of a noise exemption to Reid's Heritage Construction (RHC) for construction work at 286 Kingswood Drive on June 21St and August 9 h 2017. On motion by Councillor Y. Fernandes - it was resolved: "That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to Reid's Heritage Construction (RHC) at 286 Kingswood Drive, on June 21, 2017 and on August 9, 2017, between the hours of 6:00 a.m. and 12:00 a.m., as outlined in Community Services Department report CSD -17-038." COMMUNITY & INFRASTRUCTURE SERVICES COMMITTEE MINUTES CSD -17-039 - NOISE EXEMPTION — 2ND ANNUAL SHERWOOD SHINDIG - 124 OTTAWA STREET SOUTH; JULY 29, 2017 The Committee considered Community Services Department report CSD -17-039, dated April 5, 2017 recommending approval of a noise exemption to Pat Lackenbauer for an outdoor street party at 124 Ottawa Street South on July 29, 2017. On motion by Councillor Y. Fernandes - it was resolved: "That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to Pat Lackenbauer for an outdoor street party at 124 Ottawa Street South between the hours of 12:00 p.m. and 11:00 p.m. on July 29, 2017, as outlined in Community Services Department report CSD -17-039." CSD -17-040 - NOISE EXEMPTION — K -W OKTOBERFEST INC. -VARIOUS LOCATIONS: OCTOBER 6 TO 14, 2017 The Committee considered Community Services Department report CSD -17-040, dated April 5, 2017 recommending approval of a noise exemption to K -W Oktoberfest Inc. for a series of events being held at various locations between October 6th and 14th, 2017. On motion by Councillor Y. Fernandes - it was resolved: "That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to K -W Oktoberfest Inc. for a series of events being held at various clubs between October 6 and October 14, 2017, as outlined in the letter from K -W Oktoberfest Inc., dated February 22, 2017, attached to Community Services Department report CSD -17-040." CSD -17-041 - NOISE EXEMPTION — TACOFEST — THEMUSEUM - 10 KING STREET WEST: JUNE 16, 2017 The Committee considered Community Services Department report CSD -17-041, dated April 5, 2017 recommending approval of a noise exemption to Community Support Connections for Tacofest at THEMUSEUM, being held on June 16, 2017. On motion by Councillor Y. Fernandes - it was resolved: "That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to Community Support Connections for Tacofest at 10 King Street West, THEMUSEUM, to be held on June 16, 2017 between the hours of 6:00 p.m. and 10:30 p.m., as outlined in Community Services Department report CSD -17-041." CSD -17-042 - NOISE EXEMPTION — SAI BHAKTI DHAM FAMILY DAY & - 150TH ANNIVERSARY OF CANADA - 1250 STRASBURG ROAD: JULY 8, 2017 The Committee considered Community Services Department report CSD -17-042, dated April 5, 2017 recommending approval of a noise exemption to Sai Bhakti Dham for an outdoor event at 1250 Strasburg Road, being held on July 8, 2017. On motion by Councillor Y. Fernandes - it was resolved: "That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to Sai Bhakti Dham for an outdoor event at 1250 Strasburg Road between the hours of 9:00 a.m. and 7:00 p.m. to be held on July 8, 2017, as outlined in Community Services Department report CSD -17-042." COMMUNITY & INFRASTRUCTURE SERVICES COMMITTEE MINUTES INS -17-034 -NOISE EXEMPTION — FISCHER HALLMAN ROAD NIGHT PAVING - REGION OF WATERLOO The Committee considered Infrastructure Services Department report INS -17-034, dated April 12, 2017 recommending approval of a noise exemption during the Fischer Hallman Road Surface Asphalt works for one week in May or July 2017. On motion by Councillor Y. Fernandes - it was resolved: "That the Region of Waterloo and its contractor(s) be exempt from the provisions of Chapter 450 (Noise) of the City of Kitchener Municipal Code Article 6 Construction Work during the Fischer Hallman Road Surface Asphalt works, in the City of Kitchener. The request for the noise by-law exemption is between the hours of 7:00 p.m. and 7:00 a.m. for one week in May or July 2017, as outlined in Infrastructure Services Department report INS -17-034." INS -17-035 -NOISE EXEMPTION — HWY 8 RESURFACING - MINISTRY OF TRANSPORTATION The Committee considered Infrastructure Services Department report INS -17-035, dated April 12, 2017 recommending approval of a noise exemption during the Highway 8 resurfacing from mid-July until completion in November 2017. In response to questions, Mr. K. Carmichael explained the Ministry of Transportation prefers completing road resurfacing during off-peak hours to avoid disruption of traffic during busier times. He agreed to provide the contact information for the Ministry of Transportation to any concerned residents. On motion by Councillor Y. Fernandes - it was resolved: "That the Ministry of Transportation and its contractor(s) be exempt from the provisions of Chapter 450 (Noise) of the City of Kitchener Municipal Code Article 6 Construction Work during the Highway 8 resurfacing from approximately 100 metres north of the Franklin Street underpass, southeasterly to 100 metres north of the Grand River Bridge. The request for the noise by-law exemption is between the hours of 7:00 p.m. and 7:00 a.m. from mid-July until completion in November 2017, as outlined in Infrastructure Services Department report INS -17-035." INS -17-031 -ON-STREET PARKING REGULATIONS - BRIDLEWREATH STREET The Committee considered Infrastructure Services Department report INS -17-031, dated March 28, 2017 recommending approval of a stopping prohibition from Monday to Friday, September 1st to June 30th on the north side of Bridlewreath Street. On motion by Councillor Y. Fernandes - it was resolved: "That the Uniform Traffic Bylaw be amended to prohibit stopping from 8:00 a.m. to 9:30 a.m. and, 2:30 p.m. to 4:00 p.m., Monday to Friday, between September 1 and June 30, on the north (even -numbered) side of Bridlewreath Street from Activa Avenue to Bridlewreath Court, as outlined in Infrastructure Services Department report INS -17- 031." 10. INS -17-032 -SCHOOL TRAFFIC REVIEW - CHAPEL HILL DRIVE The Committee considered Infrastructure Services Department report INS -17-032, dated March 31, 2017 recommending approval of a stopping prohibition from Monday to Friday, September 1st to June 30th on the south/west side of Chapel Hill Drive and the proposed speed limit changes. COMMUNITY & INFRASTRUCTURE SERVICES COMMITTEE MINUTES 10. INS -17-032 -SCHOOL TRAFFIC REVIEW - CHAPEL HILL DRIVE (CONT'D) On motion by Councillor Y. Fernandes - it was resolved: "That stopping be prohibited from 8:00 a.m. to 9:30 a.m. and, 2:30 p.m. to 4:00 p.m., Monday to Friday, September 1 to June 30, on the south/west (odd -numbered) side of Chapel Hill Drive between Caryndale Drive and Evenstone Avenue, as outlined in Infrastructure Services Department report INS -17-032; and, That a speed limit of 40km/h be implemented on Chapel Hill Drive along the frontage of Carmel New Church School between Caryndale Drive and Evenstone Avenue; and further, That the Uniform Traffic Bylaw be amended accordingly." 11. CSD -17-017 - KITCHENER FIRE DEPARTMENT MASTER PLAN 2017-2022 The Committee considered Community Services Department report CSD -17-017, dated February 16, 2017 recommending the approval of the Kitchener Fire Department Master Plan (KFDMP) as the guiding document for the Kitchener Fire Department. Mr. J. Rehill, was in attendance and gave a presentation on the Kitchener Fire Department Master Plan. Mr. Rehill provided a summary of the key features of the document, noting that the Plan recommends 59 strategic and operational action items centred around six common themes: public fire safety education; fire safety standards; enforcement and emergency response; efficient and effective operations; staff development; and, strengthening partnerships. In response to questions, Mr. Rehill explained the Fire Department's website contains fire safety and emergency preparedness information that can be translated into many different languages to inform diverse audiences. It was noted when Syrian refugees were settling in the City of Kitchener, the Fire Department worked with a translator to provide fire safety information to the new residents. In response to further questions, Mr. Rehill explained the Fire Department was working with Wilfred Laurier University to design and implement strategic marketing for the direct -detect program. He further noted, a strategic action item of the Master Plan is to increase the number of residents enrolled in the direct -detect fire monitoring system as a revenue generating tool for the Fire Department. The following motion was voted on and was Carried Unanimously on a recorded vote by all members present. On motion by Councillor K. Galloway-Sealock - it was resolved: "That the Kitchener Fire Department Master Plan (KFDMP) attached as Appendix A to Community Services Department report CSD -17-017, be approved as the guiding document for the Kitchener Fire Department; and that staff be directed to refer implementation of the strategic and operational actions to the departmental business planning process as applicable." 12. INS -17-033 - DAVID BERGEY DRIVE BIKE LANE IMPLEMENTATION The Committee considered Infrastructure Services Department report INS -17-033, dated April 18, 2017 regarding the installation of on -street bicycle lanes on both sides of David Bergey Drive and the proposed on -street parking changes. Mr. D. Pimentel responded to questions from the Committee. COMMUNITY & INFRASTRUCTURE SERVICES COMMITTEE MINUTES 12. INS -17-033 - DAVID BERGEY DRIVE BIKE LANE IMPLEMENTATION (CONT'D) Mr. M. EI-Sharnouby addressed the Committee in opposition to the proposed staff recommendation to prohibit parking on David Bergey Drive on both sides of the street. He indicated he was not opposed to bike lanes; however, the implementation of a bike lane on David Bergey Drive would significantly reduce the amount of available parking in the neighbourhood. He also presented the Committee with a petition signed by residents of the condominium corporation "Mallard Place" at 20 David Bergey Drive. Councillor K. Galloway-Sealock proposed a possible amend to the staff recommendation by replacing clause two with the following: "That on -street parking be prohibited on both sides of David Bergey Drive between Ottawa Street South and Activa Avenue, with the exception of a parking bay for 10 spaces in close proximity of 20 David Bergey Drive, and further," In response to questions, Mr. K. Carmichael advised funds for the inclusion of a parking bay could be accommodated in the capital budget for traffic calming projects. He advised he was unable to provide the total cost of the parking bay, but noted staff could bring the additional information forward to a subsequent meeting if requested by the Committee. A motion was brought forward by Councillor P. Singh to defer consideration of the staff recommendation to the May 15, 2017 Council meeting to allow time for staff to prepare additional information on the implementation of the proposed parking alternative. On motion by Councillor P. Singh - it was resolved: "That consideration of the following motion be deferred to the May 15, 2017 Council meeting to allow for staff to prepare additional information on the implementation and operation costs of the proposed parking alternative: `That on -street bicycle lanes be installed on both sides of David Bergey Drive from Ottawa Street to Activa Avenue, as outlined in Infrastructure Services report INS - 17 -033; and, That on -street parking be prohibited on both sides of David Bergey Drive between Ottawa Street South and Activa Avenue; and further, That the Uniform Traffic Bylaw be amended accordingly'." Councillors K. Galloway-Sealock and S. Davey left the meeting at this time. 13. INS -17-029 - DOON SOUTH DRIVE TRAFFIC CALMING REVIEW The Committee considered Infrastructure Services Department report INS -17-029, dated March 15, 2017 regarding the Doon South Drive traffic calming review. Mr. K. Carmichael responded to questions from the Committee. The following motion was voted on and was Carried on a recorded vote, with Mayor B. Vrbanovic and Councillors B. loannidis, D. Schnider, S. Marsh, P. Singh, Y. Fernandes, Z. Janecki and F. Etherington voting in favour; and, Councillor J. Gazzola voting in opposition. Councillors K. Galloway-Sealock and S. Davey were absent and accordingly did not vote. COMMUNITY & INFRASTRUCTURE SERVICES COMMITTEE MINUTES MAY 1. 2017 -29- CITY OF KITCHENER 13. INS-17-029 - DOON SOUTH DRIVE TRAFFIC CALMING REVIEW (CONT'D) On motion by Councillor Y. Fernandes - it was resolved: "That intersection narrowings be installed on Doon South Drive at Windrush Trail and Forest Edge Trail, as outlined in Infrastructure Services Department report INS -17-029; and, That three (3) speed cushions be installed along Doon South Drive between Doon Mills Drive and Robert Ferrie Drive; and, That a pedestrian refuge island be installed on Doon South Drive approximately 60 metres west of Woodsmere Drive at the trail crossing; and, That intersection improvements be made at Doon South Drive and Doon Village Road to provide safer pedestrian road crossings; and, That parking be prohibited at any time in the immediate area of the speed cushions; and, That parking be prohibited at any time in the immediate area of the pedestrian refuge island; and further, That the Uniform Traffic By -Law be amended accordingly." Councillors K. Galloway-Sealock and S. Davey re-entered the meeting at this time. 14. CSD -17-034 - DEVELOPMENT INCENTIVES FOR AFFORDABLE HOUSING IMPLEMENTATION The Committee considered Community Services Department report CSD -17-034, dated April 20, 2017 recommending the endorsement of development incentives for affordable housing implementation. Mr. A. Pinard, Ms. L. Nelson, and Mr. B. Sloan were in attendance and responded to questions from the Committee. In response to questions, Mr. D. Chapman explained the City would not lose development charges revenue as a result of the proposed policy. He indicated there would be a loss of investment income as the development charges would not be received at the time of application. Councillor P. Singh requested an amendment to the proposed Eligibility Criteria for the Development Charges Payment Milestone for Affordable Rental Housing Policy by replacing point 4.1.b), with: "4.1. b) Eligible projects may include a development where affordable rental housing units are managed and operated by a Not -For -Profit Corporation. A minimum of 20 percent of the residential units in the development shall be affordable rental housing units." A motion was brought forward by Councillor S. Marsh to approve the recommendation as outlined in the staff report. The following motion was voted on and was Carried Unanimously on a recorded vote by all members present COMMUNITY & INFRASTRUCTURE SERVICES COMMITTEE MINUTES 14. CSD -17-034 - DEVELOPMENT INCENTIVES FOR AFFORDABLE HOUSING IMPLEMENTATION (CONT'D) On motion by Councillor S. Marsh - it was resolved: "That a new Council Policy regarding Development Charges Payment Milestone for Affordable Rental Housing effective July 1, 2017, attached to Community Services Department report CSD -17-034 as Appendix A, as amended, be approved; and, That a new Council Policy regarding Development Application Fees and Building Permit Fees for Affordable Rental Housing effective July 1, 2017, attached to Report CSD -17- 034 as Appendix B, be approved, and that a budget of $30,000 annually for a period of five years be referred to the 2018 budget process; and, That staff update internal processes and procedures in order to implement new Council Policies regarding affordable rental housing by July 1, 2017; and further, That the City of Kitchener encourage the Region of Waterloo to investigate development incentives for affordable housing and should the Region initiate a related Community Improvement Plan (CIP) for their jurisdiction, City of Kitchener staff are authorized to proceed with any formal CIP public process (if required at the local level) in order to partner on a joint initiative." 15.
